MINUTES CICERO TOWN COUNCIL MEETING March 19, 2013, Town Hall 7:00 PM Cicero Town Hall, 70 N. Byron Street Call To Order: President Jerry Cook called the meeting to order and led the Pledge of Allegiance. Mr. Brett Foster gave prayer. President Cook called for the roll call and the members of the Town Council were present or absent as follows: Present: Eric Hayden Absent: Jerry Cook Brett Foster Kay Hartley Dennis Schrumpf President Cook declared a quorum present. Others Present: Jan Unger, Clerk Treasurer Charlie Cambre, Park Superintendent Pat Comer, Street & Utility Director Dave Hildebrand, Police Chief Steve Peachey, Fire Chief Paul Munoz, Plan Commission Director Aaron Culp, Town Attorney Keith Bryant, Town Engineer Paul Utterback Storm Water Management Board President Approval of Prior Minutes: Town Council Meeting Minutes for March 5th, 2013 – Ms. Hartley made a motion to approve the Minutes for March 5th, 2013. Mr. Hayden seconded, motion passed. Approval of Agenda Mr. Cook added Parks to the additional appropriation discuss and removed the discussion on water shutoff procedures. Mr. Hayden made a motion to approve the agenda as amended. Mr. Schrumpf seconded, motion passed. Approval of Claims Ms. Hartley made a motion to approve the claims as presented. Mr. Schrumpf seconded, motion passed. Petitions by Citizens Russell Ross with the American Legion addressed the Council asking for a donation for replacement flags that are displayed along Jackson Street and the Causeway. Mr. Schrumpf made a motion to approve donating $500.00 to the American Legion for the replacement flags. Mr. Foster seconded, motion passed. Christy Wilson, President of Friends of the Parks, addressed the Council stating that Friends of the Parks sponsors the concert series, Chili Cook-off, and this year they will be coordinating the car show. Ms. Wilson stated that they are looking for sponsors for these events and they are asking for $100 from the Town. The Town’s name will be on an 8 x 11 display board that will be at each event. Ms. Hartley made a motion to approve a 1 $100.00 donation to Friends of the Park. Mr. Foster seconded, motion passed. Mr. Munoz asked that the Town’s Website be included on the sponsor board. President’s Report President Cook informed the Council that that the DLGF allowed the Emergency Loan to go through for Jackson Township. They will start the process to appropriate funds. The loan may take a couple of weeks to process. The Trustee will write a check to Cicero for $45,000 once the emergency loan is processed. Mr. Foster stated that the Settlement amount of $45,000 for funds owed to the Town of Cicero for ALS service in 2012 will avoid potential litigation and a possible lengthy court battle. He also stated that Jackson Township breached the inter-local agreement between Cicero and Jackson Township in the amount of $108,750. Cicero has not received any compensation to date for ALS services provided to Jackson Township in 2012. President Cook informed the Council that Lt. Lance Overholser, one of our FF/Paramedics, received an Angel Medic Award. There were 5 FF/Medics from Hamilton County recognized and Lance was one of them. The award was presented by St. Vincents Hospital in Indianapolis. The purpose of this award is to provide public recognition for those contributions made to patient care that align with the St. Vincent; Core Values: Wisdom: Integrating excellence and stewardship; Reverence: Respect and compassion for the dignity and diversity of life; Service of the Poor: Generosity of spirit, especially for persons most in need; Dedication; Affirming the hope and joy of our ministry through creativity, courageous innovation, and integrity; Inspiring trust through personal leadership. Chief Peachey read the nomination letter for Lt. Overholser. Council Committee Reports There were none. Legal Counsel Report- Aaron Culp: Mr. Culp had nothing. Cicero/Jackson Township Plan Commission Report Mr. Munoz addressed the Council stated that he would like to have permission for President Cook to sign a letter to the Indiana Economic Development Corporation stating that Mainstreet is leaving the Town in good standings. Mr. Foster made a motion to approve the letter and allow President Cook to sign it. Ms. Hartley seconded motion passed. Town Engineer Report Mr. Bryant addressed the following: 1. Jackson Street Pedestrian Walkway is still moving ahead. The structural changes have been presented to INDOT. United is anticipating getting the approval back from INDOT soon, which might lead to an earlier bid date. 2. Stringtown Path is substantially completed and Mr. Bryant asked that the Council give President Cook permission to sign the Substantial Completion notice. Mr. Foster made a motion to approve President Cook signing the Substantial Completion notice. Mr. Hayden seconded, motion passed. Ms. Hartley inquired about the retainage, and Mr. Bryant stated that the Town was still holding that. Mr. Cook inquired about how the Stringtown Trail would connect with Noblesville and Mr. Cambre stated that David Cox said that they were planning to gravel parts of the levy, and that eventually the trail would pick up with the Midland Trace and go all the way to Indianapolis. 2 3. Mr. Bryant stated that he would have a Task Order for the I & I project at the next Council Meeting. Old Business Council To Consider Resolution No. 03-19-2013-1 A Resolution Making A Preliminary Determination To Issue Sewage Works Revenue Bonds Of The Town Of Cicero, Indiana. Ms. Hartley inquired about Section 3 in the Resolution which stated: The officers and representatives of the Town and any member of the Town Council are hereby authorized, empowered and directed, on behalf of the Town, to take any other action as such individual deems necessary or desirable to effectuate the foregoing resolutions, and any actions heretofore made or taken be, and hereby are, ratified and approved. This prompted a discussion and Mr. Culp stated that in this incident the individual referred to the Town Council. Mr. Hayden made a motion to pass Consider Resolution No. 03-19- 2013-1 A Resolution Making A Preliminary Determination To Issue Sewage Works Revenue Bonds Of The Town Of Cicero, Indiana. Mr. Schrumpf seconded, motion passed New Business Council To Consider Donation To Lights Over Morse. There was a brief discussion and then Mr. Foster made a motion to approve a $500.00 donation to Lights Over Morse. Mr. Schrumpf seconded, motion passed. Council To Consider Approving Advertising For Additional Appropriations. Mr. Cook stated that the Police have asked for an additional appropriation for the purchase of vehicles in the amount of $8,500 and for fuel in the amount of $3000. Additionally, the Parks Department is asking for an additional appropriation in the amount of $18,057 for the purchase of a truck. Mr. Cook stated that the Council needed to give the clerk treasurer permission to advertise for the additional appropriations and a public hearing. Mr. Schrumpf made a motion to approve the advertisement of the additional appropriations. Ms. Hartley seconded, motion passed. Council To Consider Approving Four Year Contract with INDOT For Street Sweeping On SR 19 And Give Council President Permission To Sign. Mr. Cook asked for permission to sign the four year contract with INDOT for Street Sweeping. Mr. Cook stated that there has been a slight increase in the contract from $480 to $576. Mr. Foster made a motion to approve the contract and allow Mr. Cook to sign. Mr. Schrumpf seconded, motion passed. Miscellaneous Business There was none. Comments from the Public There were none. 3 Signatures on Official Documents! Ms. Hartley made a motion to adjourn the Town Council Meeting. Mr. Foster seconded.
