MINUTES CICERO TOWN COUNCIL MEETING June 4, 2013, Town Hall 7:00 PM Cicero Town Hall, 70 N. Byron Street Call To Order: President Jerry Cook called the meeting to order and led the Pledge of Allegiance. Dennis Schrumpf gave prayer. President Cook called for the roll call and the members of the Town Council were present or absent as follows: Present: Jerry Cook Absent: Kay Hartley Brett Foster – 7:15 pm Eric Hayden Dennis Schrumpf President Cook declared a quorum present. Others Present: Jan Unger, Clerk Treasurer Pat Comer, Street & Utility Director Dave Hildebrand, Police Chief Steve Peachey, Fire Chief Paul Munoz, Cicero/Jackson Township Plan Commission Director Aaron Culp, Town Attorney Keith Bryant, Town Attorney Paul Utterback, Storm Water Management Board President Approval of Prior Minutes: Town Council Meeting Minutes for May 21, 2013 – Mr. Foster made a motion to approve the Minutes for May 21, 2013. Mr. Schrumpf seconded, motion passed. Approval of Agenda Mr. Schrumpf made a motion to approve the agenda as presented. Mr. Foster seconded, motion passed. Approval of Claims Ms. Unger stated that she would like to add the claims for the Fire and Police Commissioners this evening. Mr. Foster made a motion to approve the claims including the Fire and Police Commissioners pay. Mr. Schrumpf seconded, motion passed. Petitions by Citizens There were none. President’s Report President Cook had nothing. Council Committee Reports There were none. Legal Counsel Report- John Culp: Aaron Culp stated that he had nothing this evening. Cicero/Jackson Township Plan Commission Report Mr. Munoz informed the Council that the Consultant for the Town’s Comprehensive Plan, K.K. Gerhart-Fritz, has been asked to do a class at Ball State on long range 1  planning. She was previously a professor at Ball State. She is going to use Cicero as her class room and the Town will benefit from the results of her class without a charge. Town Engineer Report Mr. Bryant stated the following: 1. Jackson Street Pedestrian Path Project: INDOT still has the letting for July. 2. S. Stringtown Pike Ballpark Walkway: The contractor has been back and completed the punch list. This project is complete. 3. Cicero-Downtown Sewer Improvements (I&I): United is still working the Survey and Design work. 4. Wiley Street Storm Drain: United is working on the plans for Mr. Comer’s crew to complete this project. Old Business Council To Discuss Bond Issue For Cicero-Downtown Sewer Improvements (I&I). Mr. Cook introduced Mr. Deen Rogers and Ashley Mejean with H.J. Umbaugh & Associates. Ms. Mejean distributed copies of the Financial Information. Mr. Rogers reviewed for the Council the amortization schedule without refunding and with refund of the existing bonds. He explained that with the refunding the debt service reserve amount would be lower, from $340,373 to $288,498. With what the Town has in debt service reserve currently there would be no additional funds needed. Additionally, the Town’s rates would be based on the lower amount. The benefit in this is with the refunding there would be no additional rate increase needed to fund the bonds. Mr. Rogers stated that the Storm Water Management Board has agreed to pledge up to $50,000 per year toward the bond payment for up to six years. Mr. Paul Utterback, president of the Storm Water Management Board stated that was correct. Mr. Foster made a motion to approve proceeding with refunding the existing bonds. Mr. Schrumpf seconded, motion passed unanimously. New Business There was none. Miscellaneous Business 1. Mr. Cambre, park superintendent, informed the Council that the parks department has planted approximately 100 River Birch and Red Oaks they received from Senator Jim Buck’s office. Mr. Cambre also stated that the parks department has purchased Red Oaks from the DNR and most of those are planted. All of these trees are planted in the baseball park area. 2. Mr. Foster informed the Council that the town received the June property tax money from the two TIF Districts. The Southeast TIF received $26,235.00 and the Southwest TIF received $48,560.91. 3. Mr. Comer informed the Council that he has asked Aaron Culp to write an enforcement ordinance for illegal discharge of storm water. Mr. Comer stated that he needed this Ordinance in effect by July 17th. 2 Comments from the Public 1. Mr. Mike Murphy stated that Mr. Munoz, Mr. Comer and he attended the IDEM Conference and Cicero came through with a good showing. The Rain Barrel Program is being well received. The main focus of the conference was sustainability. Signatures on Official Documents! Mr. Hayden made a motion to adjourn the Town Council Meeting. Mr. Foster seconded.
