4 TOWN OF CICERO TOWN COUNCIL MEETING MINUTES October 20, 2015 At 7:00 PM Call To Order: President Kay Hartley called the meeting to order and asked the attending Boy Scouts to lead the Pledge of Allegiance. Mr. Schrumpf gave the prayer. President Hartley called for the roll call and the members of the Town Council were present or absent as follows: Present: Kay Hartley Absent: Brett Foster Chad Amos Eric Hayden Dennis Schrumpf President Hartley declared a quorum present. Others Present: Jan Unger, Clerk Treasurer Pat Comer, Street & Utilities Director Steve Peachey, Fire Chief Aaron Culp, Town Attorney Approval of Agenda: Ms. Hartley removed the discussion on the Town Hall under Old Business and added Council to Select Registrar and Paying Agenda for new bond under old business. Mr. Amos made a motion to approve the agenda as amended. Mr. Foster seconded, motion passed. Approval of Prior Minutes: Town Council Meeting Minutes, October 6, 2015, 7:00 PM – Mr. Amos made a motion to approve the Town Council Meeting Minutes, October 6, 2015. Mr. Schrumpf seconded, motion passed. Approval of Claims: Mr. Hayden made a motion to approve the claims as presented. Mr. Amos seconded, motion passed. Petitions by Citizens: Brett Ravenscroft addressed the Council inquiring about the Noise Ordinance that they were working on. Mr. Hayden informed Mr. Ravenscroft that Chief Hildebrand offered the Lazy Frogg a temporary permit for weekends until the Town worked out the details of the Ordinance. Mr. Culp stated that the Town wants to make sure it is written correctly so that it will apply Town wide. The temporary permit would be for each weekend as to not interfere with the Lazy Frogg doing business. Mr. Hayden stated that with the temporary permit the Town would be able to do some testing and checking of decibel levels and work on determining what would work for us. There would also be criteria in the ordinance determining duration, hours, and sound level of the music/noise. These things are all being discussed. Major Hunter stated that with the temporary permit they were hoping to listen to and get decibel levels in several locations. Major Hunter stated that they have not received a request from Lazy Frogg for a Page 1 of 3 temporary permit at this time. Mr. Culp stated that the Town did not want to adopt an ordinance and then have someone always being in violation. Gregg Boyd stated that he has met with Chief Hildebrand and was informed of the temporary permit with advance notice. Mr. Boyd stated that it would be difficult to organize an audience and musicians at this late date and he is not sure that they could do anything at this time. Mr. Boyd stated that he did not realize the temporary permit would be a stepping stone, and the only possible night he could utilize might be Halloween. Mr. Boyd stated that you could not please 100% of the people all of the time. Mr. Culp stated that the temporary permit was a simple application. Mr. Culp stated that the ordinance may be ready but they wanted to check decibel levels before it is finished, therefore it may not get completed until Spring. President’s Report: 1. President Hartley stated that there is a Public Notice from Street Director Pat Comer stating Brinton Street in Cicero will be closed from SR 19 to the Railroad for up to three weeks beginning October 26th, 2015, for widening and paving. Council Committee Reports: 1. There were none. Legal Counsel Report-Aaron Culp Mr. Culp stated that he had nothing. Cicero/Jackson Township Plan Commission Report: There was nothing. Town Engineer Report-Mr. Keith Bryant: Mr. Bryant was unable to attend but forwarded the following information: 1. UV Project: They had the preconstruction meeting with the Contractor. The contractor has materials ordered and is planning their subcontractors and schedules now to complete the project. 2. Hidden Bay Water Lines: The contractor is placing the road patch base work and performing grading and seeding. They will schedule asphalt surface for the roadways soon. Mr. Comer added that Midwest will begin paving in Hidden Bay on October 26, 2015. 3. Brinton Street Widening: The contractor is planning their schedule. Once we know when they will begin, we will inform everyone. 4. State Road 19 Sidewalk: Still awaiting the INDOT Permit. I have emailed them again today. Mr. Amos may be able to discuss the other INDOT issues on the project. Old Business: Council To Hear Update On The SR 19 Project. Mr. Comer stated that the Town received the permit from INDOT for the Town’s work this afternoon. Mr. Comer stated that the Town has to inform INDOT 5 days before they start so INDOT can approve starting. He stated that Dorsey will probably start late next week. CVS customers will have to use the SR 19 and Dean Street entrance. Mr. Comer stated that the permit was for the original items Cicero was to complete which are ADA ramps and sidewalks, but not curbs. Mr. Amos will check on this. Page 2 of 3 Council To Select Registrar And Paying Agenda For New Bond Issue. Ms. Hartley stated that the Town received five bank proposals. The least expensive was from Main Source for a total of $7,200. Mr. Amos made a motion to approve Main Source. Mr. Foster seconded, motion passed. New Business Council To Consider Resolution 10-20-2015-1 A Resolution Adopting The Hamilton County, Indiana Comprehensive Emergency Management Plan For Cicero, Indiana. Mr. Amos made a motion to approve Resolution 10-20-2015-1 a Resolution Adopting the Hamilton County, Indiana Comprehensive Emergency Management Plan for Cicero, Indiana. Mr. Schrumpf seconded, motion passed. Miscellaneous There was nothing. Comments By Citizens There were none. Signatures on Official Documents! Motion To Adjourn: Mr. Foster made a motion to adjourn.
