TOWN OF CICERO TOWN COUNCIL MEETING MINUTES TUESDAY, JANUARY 4, 2022 at 7:00 PM Call to Order: President Strong called the meeting to order and lead the Pledge of Allegiance. Ms. Gary gave the prayer. President Strong called for roll call. Members of the Cicero Town Council were present or absent as follows: Present: Chad Amos Absent: Chad Blueher Jerry Cook Chris Lutz Dan Strong Declare a Quorum Present: President Strong declared a quorum present. Others Present: Rhonda Gary, Clerk Treasurer Jeff Rednour, Police Chief Lance Overholser, Fire Chief Frank Zawadzki, Cicero/Jackson Township Plan Commission Director Terry Cooper, Street & Utilities Director Jim Hunter, Parks Superintendent Aaron Culp, Town Attorney Bruce Freeman, Storm Water Management Board President Approval of Agenda: Mr. Lutz made a motion to approve the agenda as amended. Mr. Cook seconded, motion carried. Approval of Prior Minutes: Town Council Staff Meeting Minutes, December 16, 2021, 7:00 PM Town Council Meeting Minutes, December 21, 2021, 7:00 PM Town Council Meeting Minutes, December 29, 2021, 9:00 AM Mr. Blueher made a motion to approve the minutes listed above. Mr. Amos seconded, motion passed. Approval of Claims: Mr. Lutz made a motion to approve the claims dated 1/4/22. Mr. Cook seconded, motion passed. Council Committee Reports: 1. OTC Report – Mr. Blueher had nothing to report. 2. EDC Report – Mr. Amos had nothing at this time. 3. SWU Management Board Report – President Freeman reported that the SWU board met on 12/29/21. They discussed grant opportunities, moving forward on the Brinton Street project as well as the sump pump issues at Morse Landing Drive. President Freeman plans to get the ball rolling on Brinton Street and Morse Landing Drive is next. Legal Counsel Report – Mr. Culp had nothing at this time. 1  Cicero/Jackson Township Plan Commission Report – Director's Report Permit Revenue: 2021 = $11,982 YTD: $164,609.00 December 2020 = $6,624.00 YTD: $93,146.00 Difference: Month = $5,358.00 YTD: $71,463.00 A total of 27 building permits were issued in December 2021. Twenty-one were inside corporate limits (of which 9 were new homes). A total of 6 permits were issued in Jackson Township (of which 1 was a new home). Mr. Blueher inquired about the action taken on the easement encroachment at Tamarack. Mr. Zawadzki stated that he has reached out to the HOA, but has had no response. It was suggested that Mr. Zawadzki meet with the HOA to draft a form letter in hopes of preventing future violations. Mr. Lutz suggested bringing the issue to Mr. Isaacs attention. Town Engineer Report – Mr. Bryant was not present; but did submit the following: 1. Tamarack – Section 4: Watermain installation is complete and has been successfully tested. Final inspection of work to develop a punch list is anticipated in the near future as weather permits. 2. Auburn Estates – With the completion of the Tamarack Section 4 water system extension, the contractor is working towards final connection and testing of their water system extension. 3. Water & Wastewater Treatment Plant: a. a. Wastewater Treatment Plant – Following engineering agreement approval at the prior meeting, begin work with subconsultants and scheduling detailed design, plan and specification preparation. b. b. Water Treatment Plant - Awaiting approval to drill test holes on the second property. To approach additional property owners post-holidays for another possible option. Old Business: 1. Annexation Ordinance 09-21-2021-2 – Mr. Culp stated that the annexation ordinance is ready to consider for final adoption. Mr. Amos made a motion to approve Ordinance 09-21-2021-2. Mr. Lutz seconded, motion carried. New Business: 1. Election of Officers – President of the Council – Mr. Lutz made a motion to open nominations for council president. Mr. Cook seconded, motion carried. Mr. Lutz nominated Mr. Amos. There were no other nominations. Mr. Cook seconded, motion carried. Mr. Amos made a motion to close nominations. President Strong closed nominations. Motion carried 4-1 with Mr. Amos voting nay. Mr. Amos took over as council president. President Amos thanked Mr. Strong for his service to the council. Vice President of Council – Mr. Strong made a motion to open nominations for vice president of the council. Mr. Lutz seconded, motion carried. Mr. Strong nominated Mr. Blueher. There were no other nominations. Mr. Strong made a motion to close nominations. Mr. Cook seconded, motion carried. Mr. Strong’s motion carried 5-0. 2  Council To Appoint 2022 Department Heads & Liaisons There was no change in department heads or liaisons as Mr. Lutz made a motion to approve the following reappointments: Fire Chief – Mr. Overholser – liaison Mr. Lutz. Police Chief – Mr. Rednour – liaison President Amos. Street/Utilities Director – Mr. Cooper – liaison Mr. Cook and Mr. Strong Plan Commission Director – Mr. Zawadzki – liaison Mr. Strong Park Superintendent – Mr. Hunter – liaison Mr. Blueher Mr. Cook seconded the appointments listed above, motion carried. Other Appointments The Cicero Metropolitan Police Commission – 3-year term Mr. Cook nominated Mr. Knott for reappointment to the Cicero Metropolitan Police Commission. Mr. Lutz seconded, motion carried. Appointment to Storm Water Management Board – 3-year term Mr. Lenze’s term is complete, but he is interested in staying on the board. Mr. Freeman stated that Mr. Lenze is an asset to Storm Water Management Board. Mr. Cook made a motion to nominate Mr. Lenze to the SWU Board. Mr. Blueher seconded, motion carried. Cicero Redevelopment Commission – 1-year term President Amos appointed Mr. Blueher, Mr. Cook and Mr. Strong to the Cicero Redevelopment Commission. Mr. Strong made a motion nominate Mr. Lutz and Mr. Amos to the Cicero Redevelopment Commission. Mr. Blueher seconded, motion carried. Appointments to Cicero Economic Development Commission – Reappointed each January President Amos reappointed Mr. Cox and Mr. Everett to the EDC. Mr. Lutz made a motion to reappoint Ms. O’Conner Buckner to the EDC. Mr. Blueher seconded, motion passed. Council Appointment to the Hamilton County Emergency Management Advisory Council. Mr. Blueher made a motion to re-appoint Fire Chief Overholser to the Hamilton County Emergency Management Advisory Council. Mr. Cook seconded, motion passed. 2. Encumbrances – Mr. Lutz made a motion to approve the encumbrances. Mr. Strong seconded, motion carried. Miscellaneous: 1. Executive Session – Council will hold off until Mr. Culp has a chance to speak to Ms. Roberts. 2. RDC Meeting – Council agreed to meet at 6:45 on 1/13/22.
