TOWN OF CICERO TOWN COUNCIL MEETING MINUTES TUESDAY, JULY 5, 2022 at 7:00 PM Call to Order: President Amos called the meeting to order and lead the Pledge of Allegiance. Mrs. Gary gave the prayer. President Amos called for roll call. Members of the Cicero Town Council were present or absent as follows: Present: Chad Amos Absent: Chris Lutz Chad Blueher Jerry Cook Dan Strong Declare a Quorum Present: President Amos declared a quorum present. Others Present: Rhonda Gary, Clerk Treasurer Jeff Rednour, Police Chief Lance Overholser, Fire Chief Frank Zawadzki, Cicero/Jackson Township Plan Commission Director Terry Cooper, Street & Utilities Director Jim Hunter, Parks Superintendent Aaron Culp, Town Attorney Bruce Freeman, Storm Water Management Board President Approval of Agenda: Mr. Blueher made a motion to approve the agenda. Mr. Cook seconded; motion carried. Approval of Prior Minutes: Town Council Special Meeting Minutes, June 16, 2022, 6:00 PM Town Council Staff Meeting Minutes, June 16, 2022, 7:00 PM Town Council Meeting Minutes, June 21, 2022, 7:00 PM Mr. Strong made a motion to approve the minutes listed above. Mr. Cook seconded; motion carried. Approval of Claims: Mr. Blueher made a motion to approve the claims dated 7/5/22 as presented. Mr. Cook seconded, motion passed. Council Committee Reports: 1. OTC Report – Mr. Blueher stated that the last meeting was cancelled. He has no new news. The street festival is still on for 8/27/22. 2. EDC Report – Mr. Cox was not present. 3. SWU Management Board Report – SWU President Freeman relayed that Ms. Henderson has submitted the CDBG application to Indiana OCRA. Award announcement will take place on August 25, 2022. Keep your fingers crossed that the town is awarded the grant. 1 Legal Counsel Report – Mr. Culp had nothing at this time. Cicero/Jackson Township Plan Commission – Director's Report – June 2022 Permit Revenue: June 2022 = $21,230 YTD: $126,879 June 2021 = $6,629 YTD: $70,869 Difference: Month = $14,601 YTD: $56,010 A total of 32 building permits were issued in June 2022. Thirty were inside corporate limits (of which 19 were new homes). A total of two permits were issued in Jackson Township (of which, one was a new home). Mr. Strong made a motion to approve the agreement with Dark Side Roasters and allow President Amos to sign. Mr. Blueher seconded, motion carried. Town Engineer Report – 1. Tamarack – Mr. Bryant reported that town infrastructure is complete for the most part. Waiting cleanup, home site grading to prepare Section 3 and 4 punch list. Final acceptance of Sections 1 and 2 infrastructure awaiting final completion / information from developer. 2. Auburn Estates – Mr. Bryant stated that the town infrastructure is complete for the most part. He is awaiting developer completion of punch list for final acceptance. 3. Water – Mr. Bryant said that he is awaiting progression and results of the test wells. 4. Wastewater Treatment Plant – Mr. Bryant relayed that design continues with plan and specification preparation, equipment evaluation and detailing, etc. A review meeting was conducted today with plant personnel. Old Business: a. Rezoning – Corner of Tollgate & 236th Street – Mr. Strong made a motion to untable the rezoning at the corner of Tollgate Road and 236th Street. Mr. Cook seconded, motion carried. At the request of Via Credit Union, Mr. Strong made a motion to formally dismiss the request for rezoning. Mr. Blueher seconded, motion carried. b. Stringtown Pike Rehab Bids from Baumgartner Asphalt Services, Midwest Paving, E & B Paving, Grady Brothers, Inc. and Howard Companies were opened. Grady Brothers had the lowest bid. Mr. Strong made a motion to table pending Mr. Bryant’s review. Mr. Blueher seconded, motion carried. New Business: There was none. Miscellaneous: a. Mr. Blueher made a motion to allow President Amos to sign Pro Bono Engagement Letter. Mr. Cook seconded, motion carried. b. Mr. Blueher gave a shout out to the Cicero Fire Department and First Responders. Ms. Blueher fell and broke her leg and Mr. Blueher thanked them for their speedy response and care given to his wife. c. President Amos thanked the Cicero Police, Fire, Utility/Street and Parks Departments for all their efforts on the 4th. Mr. Strong stated that the town had record crowds and echoed President Amos’ words. 2 Comments by Citizens: Mr. Lambert with BerryComm thanked the town for taking complaints from disgruntled residents concerning the installation of BerryComm fiber. He went on to say that they have a new guy, Drew Boruff, and hopes that things will go a little smoother. Motion to Adjourn: Mr. Blueher made the motion. Mr. Cook seconded, motion carried.
