TOWN OF CICERO TOWN COUNCIL MEETING MINUTES TUESDAY, DECEMBER 20, 2022 at 7:00 PM Call to Order: President Amos called the meeting to order and lead the Pledge of Allegiance. Ms. Gary gave the prayer. President Amos called for roll call. Members of the Cicero Town Council were present or absent as follows: Present: Chad Amos Absent: Chad Blueher Jerry Cook Chris Lutz Dan Strong Declare a Quorum Present: President Amos declared a quorum with four members present. Others Present: Rhonda Gary, Clerk Treasurer Jeff Rednour, Police Chief Lance Overholser, Fire Chief Frank Zawadzki, Cicero/Jackson Township Plan Commission Director Terry Cooper, Street & Utilities Director Jim Hunter, Parks Superintendent Aaron Culp, Town Attorney Keith Bryant, Town Engineer Bruce Freeman, Storm Water Management Board President Open Bids for Vehicle – Bids were opened and read aloud as follows: 1. Mr. Cook: Mr. Pharis - $10,200.00 2. Mr. Strong: TNT Sales & Services, Inc - $8,500.00 3. Mr. Lutz: Merchants Auto Group, Inc - $8,300.00 4. Mr. Cook: Mr. Boone - $8,255.00 5. President Amos: Mr. Shively - $9,260.00 6. Mr. Lutz: Mr. Scott - $15,000.00 7. President Amos: Mr. Hunter - $12,750.00 8. Mr. Strong: Mr. Sullivan - $11,752.00 Mr. Strong made a motion to accept Mr. Scott’s bid of $15,000.00. Mr. Cook seconded, motion carried. In the event that the highest bid for the vehicle should not transpire, Mr. Strong made a motion to accept the second highest bid which is contingent on the terms of the sale of the surplus vehicle. Mr. Cook seconded, motion carried. Approval of Agenda: Mr. Lutz made a motion to approve the agenda as presented. Mr. Cook seconded, motion carried. 1 Approval of Prior Minutes: Town Council Meeting Minutes, November 15, 2022, 7:00 PM Town Council Meeting Minutes, December 6, 2022, 7:00 PM Mr. Strong made a motion to rescind the 11/15/2022 Town Council Meeting Minutes. Mr. Lutz seconded, motion carried. Mr. Lutz made a motion to approve the 11/15/2022 Town Council meeting minutes as amended. Mr. Cook seconded, motion carried. Mr. Strong made a motion to approve 12/6/2022 Council Meeting Minutes. Mr. Lutz seconded, motion carried. Approval of 12/20/22 Claims: Mr. Cook made a motion to approve the claims dated 12/20/22 as presented. Mr. Lutz seconded, motion passed. Council Committee Reports: 1. OTC Report – Mr. Blueher was not present. 2. EDC Report – Mr. Cox stated that he has received the third parking proposal. EDC will review that proposal. He also stated that EDC will undergo restructuring at the beginning of the year with Mr. Hayden and his departure as they transition to the Cicero Town Council. Mr. Cox reported that he has recruited Mr. Mann to join the Cicero EDC. 3. SWU Management Board Report – SWU President Freeman said that the SWU Board will begin bidding out the Brinton Street Project at the beginning of the new year. They plan to begin working on that project in the spring. Legal Counsel Report – Mr. Culp had nothing at this time. Cicero/Jackson Township Plan Commission – Mr. Zawadzki had nothing to update. Town Engineer Report – 1. Tamarack – Mr. Bryant stated that Sections 1, 2 & 3 have been inspected. Section 1 has minor things to do. Section 2 needs to be cleaned up. A punch list has been done for Sections and nearly completed 1 & 2. He asked that the council consider accepting the infrastructure. A full punch list for Section 3 will be prepared following additional meter pit, valve and locator wire checks by the Water Department staff. 2. Auburn Estates – Mr. Bryant said that they are waiting for verification of completion of all punch list items in Section 1. Lennar is to respond with the status and completion schedule. 3. Water – Mr. Bryant reported that they are still waiting for access to the third well site for test wells. 4. Wastewater Treatment Plant – Mr. Bryant relayed that design continues and they are about a month out from discussion of potential bid dates. Mr. Bryant stated that we could probably start the bonding process in early 2023 when asked. Old Business: 1. Redistricting Ordinance 12-20-2022-1 - Mr. Lutz made a motion to approve Ordinance 12-20-2022-1. Mr. Cook seconded, motion carried. 2 New Business: 1. Mr. Mann appointment to EDC – President Amos stated that Mr. Mann will be appointed to EDC for a two-year council presidential appointment. 2. Ordinance 12-20-2022-2 Opioid Fund – Restricted – Mr. Lutz made a motion to approve Ordinance 12-20-2022-2. Mr. Strong seconded, motion carried. 3. Ordinance 12-20-2022-3 Opioid Fund – Unrestricted – Mr. Strong made a motion to approve Ordinance 12-20-2022-3. Mr. Cook seconded, motion carried. 4. Transfer Resolution 12-20-2022-4 – Mr. Cook made a motion to approve the Transfer Resolution 12-20-2022-4. Mr. Strong seconded, motion carried. 5. Clothing Allowance – Police Department – Removed from agenda. Miscellaneous: a. President Amos presented Mr. Higgins with a plaque and gift card from the town as he is retiring after 34+ years of service with the Town of Cicero. He went on to thank him for his dedication to the town as did other members of the council. b. Mr. Lutz took over the meeting by acknowledging Mr. Strong and Mr. Amos whose town council term will end on 12/31/22. Mr. Lutz presented each member with a plaque on behalf of the council for their commitment to the Town of Cicero. Mr. Lutz also presented Mr. Strong a gift card in recognition of his dedication to the town. Comments by Citizens: SWU President Freeman inquired about warming places with the winter storm coming this weekend. President Amos responded that the town does have a warming place located at the fire department. Chief Overholser followed up that the town does have a plan in place.
