TOWN OF CICERO
TOWN COUNCIL MEETING MINUTES
TUESDAY, APRIL 4, 2023 at 7:00 PM
Call to Order: Vice President Lutz called the meeting to order and led the Pledge of
Allegiance. Ms. Gary gave the prayer. Vice President Lutz called for roll call. Members of the
Cicero Town Council were present or absent as follows:

Declare a Quorum Present: Vice President Lutz declared a quorum with three members
present.

Open Bids for Fire Department Repairs – Moved to Old Business.
Approval of Agenda: Mr. Hayden made a motion to approve the agenda as amended. Mr.
Cook seconded, motion carried.
Public Hearing on Additional Appropriation for Parks Department: Mr. Cook made a
motion to open the public hearing. Mr. Hayden seconded, motion carried. The only comment
from the public was from Mr. Bowen who stated that the parks are looking great. Mr. Hayden
made a motion to close the public hearing. Mr. Cook seconded, motion carried. Mr. Hayden
made a motion to approve Ordinance Number 04-04-2023-01 Additional Appropriation. Mr.
Cook seconded, motion carried.
Approval of Prior Minutes:

Mr. Hayden made a motion to approve the Town Council Staff Meeting
Memorandum. Mr. Cook seconded, motion carried. Mr. Hayden made a motion
to table the Town Council Meeting Minutes. Mr. Cook seconded, motion carried.

Approval of Claims: Mr. Hayden inquired about a legal voucher. He has concerns about hiring
outside council and would like to get that spending under control. Mr. Cook made a motion to
approve the claims dated 4/4/23. Mr. Hayden seconded, motion carried.
Council Committee Reports:
1. OTC Report – Mr. Blueher was not present.
2. EDC Report – Mr. Cox was not present.
3. SWU Management Board Report – SWU President Freeman stated that the board is
meeting with the contractor on 4/20 at 1:00 to get started on the Brinton Street Project.
Legal Counsel Report – Mr. Culp had nothing at this time.
Cicero/Jackson Township Plan Commission Report – March 2023
• Permit Revenue: March 2023 = $13,025 YTD: $22,984
March 2022 = $16,220 YTD: $43,568
Difference: Month = -$3,195 YTD: -$20,584
• A total of 26 building permits were issued in March 2023. Seventeen were within the
corporate limits (of which, 5 were for new homes). Nine permits were issued in Jackson
Township (of which, 1 was for a new home). Estimated Cost of projects permitted
$5,307,138.
Additional updates:
• Auburn Estates Subdivision – all of Section 1 has been permitted. Tamarack Section 4 –
69 lots, there are seven that remain to be permitted.
• Education – Mr. Zawadzki is now certified in Damage Assessment by Hamilton County
Emergency Management.
• Permitting process for the WWTP project has been completed.
Town Engineer Report –
1. Tamarack – Mr. Bryant got a response from MI Homes indicating that the punch list
items are done for Sections 1-3. There is a drainage issue that is to be addressed. At that
time, United will verify completion of the punch list and recommend infrastructure
approval by the Town.
2. Auburn Estates – Mr. Bryant reported that Lennar Homes has indicated that they have
established the survey monuments, but they have not confirmed completion of all punch
list items as of yet.
3. Water – Mr. Bryant stated that the Town has approval to proceed with the third test well
site. They are waiting for a date to drill from Peerless Midwest which is weather
dependent.
4. Wastewater – Mr. Bryant is waiting for IDEM construction permit review to set dates
advertising, bid and bond dates. He is coordinating bond work with Mr. Culp, bond
counsel and rate consultant.
Old Business: Mr. Hayden made a motion to rescind approval of firehouse concrete repairs,
stating that there was a procedural issue. Chief Overholser stated that the third bid was received
from Concrete Brothers, LLC; however, it was received too late. Afterwards, bids for the
concrete repair were opened as follows:

Prater and Sons Concrete - $132,980.00
All Around Concrete, LLC - $169,770.00.
Mr. Cook made a motion to accept the bid from Prater and Sons Concrete. Mr. Hayden
seconded, motion carried.
New Business:
1. HHASA – Baseball Agreements– Use of Real Estate & Concession – Mr. Cook made
a motion to allow President Blueher to sign both agreements. Mr. Cook then
amended his motion to allow Vice President Lutz to sign the agreements. Mr.
Hayden seconded, motion carried.
2. EMC Invoice – Removed from the Agenda.
3. LOML – Ms. Gary distributed the LOML form for council review. Mr. Hayden made
a motion to approve $2,500.00 to LOML for the July 4th pamphlet. Mr. Cook
seconded, motion carried.
Miscellaneous: Mr. Hayden made a motion to rescind approval of enacting Ordinance 09-04-
2007-2. Mr. Cook seconded, motion carried. Vice President Lutz asked Ms. Gary to add
this to the Staff Meeting Agenda.
Comments by Citizens:
a. Mr. Bowen was present to request use of the town dock for the July 4th festivities. Ms.
Gary will get a letter for President Blueher to sign if approved. Mr. Hayden made a
motion to approve request and allow President to sign the letter. Mr. Cook seconded,
motion carried.
b. Hamilton County Councilman Mr. Hall was present and invited any and all who would
like to attend the county council meeting tomorrow evening. He also stated that there
will be a ribbon cutting on 5/9/23 at 10:30 for the Steve Nation Trail. Mr. Hall also
said that he has drainage maps available upon request.
Motion to Adjourn: Mr. Cook made the motion. Mr. Hayden seconded, motion carried.
