TOWN OF CICERO TOWN COUNCIL MEETING MINUTES WEDNESDAY, NOVEMBER 5, 2025 at 7:00 PM Call to Order: President Cox called the meeting to order and led the Pledge of Allegiance. Ms. Gary gave the prayer. President Cox called for roll call. Members of the Cicero Town Council were present or absent as follows: Present: Joseph Cox Absent: Jacob Everett Eric Hayden Dennis Johnson Emily Pearson Declare a Quorum Present: President Cox declared a quorum with all five members present. Others Present: Rhonda Gary, Clerk Treasurer Jeff Rednour, Police Chief Lance Overholser, Fire Chief Frank Zawadzki, Cicero/Jackson Township Plan Commission Director Terry Cooper, Street & Utilities Director Jim Hunter, Parks Superintendent Aaron Culp, Town Attorney Keith Bryant, Town Engineer Bruce Freeman, Storm Water Management Board President Dan Strong, Project Coordinator Approval of Agenda: Mr. Johnson made a motion to approve the agenda as amended. Ms. Pearson seconded, motion carried 5-0. Approval of Prior Minutes: Town Council Staff Meeting Minutes, October 16, 2025, 7:00 PM Town Council Meeting Minutes, October 21, 2025, 7:00 PM Mr. Hayden made a motion to approve the minutes listed above. Mr. Johnson seconded, motion carried 5-0. Approval of 11/5/25 Claims: Mr. Johnson made a motion to approve the claims dated 11/5/25. Ms. Pearson seconded, motion carried 5-0. Council Committee Reports: 1. EDC Report – No update. 2. SWU Management Board Report – SWU President Freeman stated that the board met with Parks Superintendent Hunter concerning a drainage issue at Red Bridge Community Building. SWU has agreed to fund the project. 1 Legal Counsel Report – Mr. Culp had nothing. Mr. Hayden cautioned the council members about additional legal fees and amount that has been spent. Cicero/Jackson Township Plan Commission Report – Director's Report - October 2025 Permit Revenue: October 2025 = $7,647, YTD: $48,872 October 2024 = $6,976 YTD: $53,370 Difference: Month = $671 YTD: -$4,497 A total of 27 building permits were issued for October of 2025. Sixteen were within the corporate limits (of which 0 have been new homes). Eleven permits were issued in Jackson Township (of which, 0 was for new a home). Estimated Cost of projects permitted: $1,102,956. Plan Commission meeting is scheduled for November 12th, 7pm at Cicero Town Hall. The BZA meeting is scheduled for November 21st, 7pm at the Town Hall as well. Town Engineer Report – 1. Wastewater – Mr. Bryant reported that construction continues. Reynolds completed the sludge dewatering system installation to allow digester cleaning and demolition work proceeding the needed rehabilitation work is moving ahead. Transfer into the new oxidation ditch and clarifier has been completed and the existing oxidation ditch is being cleaned so that it and the two existing clarifiers can be rehabilitated. Afterwards, Mr. Hayden made a motion to approve Pay Application #16. Mr. Johnson seconded, motion carried 5-0. 2. West Jackson Street – Mr. Bryant stated that the sod is in and they are working on completing the striping. New lights/globes have been ordered. They have a few miscellaneous items to do, but they are basically finished. Mr. Everett inquired about watering the sod and who is responsible for this. Mr. Bryant said that the contractor is responsible. Afterwards, Mr. Hayden made a motion to approve Pay Application #7. Mr. Johnson seconded, motion carried 5-0. On a side note, the council’s consensus is to repair the damaged rail but to install with town forces. 3. 2025 Community Crossings Matching Grant – Mr. Bryant reported that the paving is done on Morse Landing Drive and Catherine/Flannigan Streets. They did a walkthrough and punch list is complete. Pay Application No. 1 will be coming soon. 4. Morse Landing Drive Project – Mr. Bryant stated that the project will be advertised in December for bids in January 2026. This has been coordinated with the Stormwater Utility Board. More information to follow. Old Business: Grant Writer – Mr. Everett made a motion to approve and allow President Cox to sign the Letter of Agreement for Grant Project Services. Ms. Pearson seconded, motion carried 5-0. New Business: Mr. Zawadzki stated that the town is required to update the stormwater ordinance. Ms. Pearson made a motion to approve Stormwater Ordinance No. 11-05-2025-01. Mr. Everett seconded, motion carried 5-0. 2 Miscellaneous: a. Council was asked to put together a priority list for future Community Crossings Matching Grant opportunities. They believe that the Main/Jackson intersection is a good candidate. b. Council requested a monthly run report from Chief Overholser. Comments by Citizens: There were none. Motion to Adjourn: Mr. Johnson made the motion. Ms. Pearson seconded, motion carried 5-0. TOWN OF CICERO TOWN COUNCIL EXECUTIVE SESSION AGENDA WEDNESDAY, NOVEMBER 5, 2025 at 6:00 PM Call to Order: Present: Joseph Cox Absent: Jacob Everett Eric Hayden Dennis Johnson Emily Pearson Others Present: Rhonda Gary, Clerk Treasurer Dan Strong, Project Coordinator On November 5, 2025, Cicero Town Council will hold an Executive Session at 6:00 PM at Cicero Town Hall, 70 N Byron Street, Cicero, IN according to Indiana Code 5-14-1.5-6.1(b)(2)(D) A real property transaction including: (i) a purchase; (ii) a lease as lessor; (iii) a lease as lessee; (iv) a transfer; (v) an exchange; or (vi) a sale; by the governing body up to the time a contract or option is executed by the parties. This clause does not affect a political subdivision's duty to comply with any other statute that governs the conduct of the real property transaction, including IC 36-1-10 or IC 36-1-11. Also, for discussion on November 5, 2025, Cicero Town Council will hold an Executive Session at 6:00 PM at Cicero Town Hall, 70 N Byron Street, Cicero, IN according to Indiana Code IC 5-14-1.5-6.1(b)(2) (B) Initiation of litigation or litigation that is either pending or has been threatened specifically in writing. As used in this clause, "litigation" includes any judicial action or administrative law proceeding under federal or state law. Motion to Adjourn: 1
