FINANCE COMMITTEE AUGUST 6, 2019 MINUTES NON-PUBLIC MEETING City Attorney Lance Baker met in a non-public meeting with four members of the City of Clarksville Finance Committee on Tuesday, August 6, 2019, at 3:30 p.m. in the City Hall Conference Room, 1 Public Square, Clarksville, Tennessee, to discuss the Liberty Park Development, LLC v. City case and the Laurie Marquis v. City case. PUBLIC MEETING CALL TO ORDER The public meeting was called to order by Chairman Jeff Burkhart at 4:06 p.m. ATTENDANCE PRESENT: Jeff Burkhart, Tim Chandler, Valerie Guzman, Stacey Streetman ABSENT: Jeff Henley Mayor Joe Pitts and CFO Laurie Matta were also present. CONSIDERATION OF SETTLEMENTS Liberty Park Development, LLC v. City Mr. Baker said the Plaintiff submitted a settlement demand of $116,500.00 for soil remediation work in connection with building the access road to the restaurant, including some taxes the Plaintiff had already paid, and in exchange the Plaintiff would dismiss all claims in the lawsuit against the City. Mr. Baker noted the Plaintiff had previously paid $230,000 to the City in a separate issue. Councillady Streetman made a motion to authorize a settlement in the amount of $116,500. The motion was seconded by Councillady Guzman. A voice vote was taken; the motion passed without objection. Laurie Marquis v. City Mr. Baker said the City’s motion to dismiss and motion for summary judgement in this case had been denied by the Court. The plaintiff submitted a settlement  demand of $195,000.00. Upon the advice of the City Attorney, Councilman Chandler made a motion to reject this demand. The motion was seconded by Councillady Streetman. A voice vote was taken; the motion passed without objection. ADJOURNMENT The meeting was adjourned at 4:11 p.m.
