PUBLIC SAFETY COMMITTEE MEETING MINUTES February 19.2020 -4:00 P.M. City Hall Conference Room Attending: Councilman Jeff Henley, Chair; Councilman Ron Erb; Councilman Vondell Richmond; Councilman Travis Holleman; Councilwoman Wanda Smith others Present: Building & codes Interim Director David Smith, Police chief Alonzo Ansley, Fire chief Freddie Montgomery, Building official/Deputy Director Justin crosby, police Deputy Chief David Crockarell, City Attorney Lance Baker, Paula McWhirter, Gina Johnson The meeting was called to order at 4:00 p.m. by Chairman Henley and it was noted there was a quorum present. Minutes from the January 15, 2020 and January 30,2020 meetings were approved by the committee after a motion was made by Councilwoman Smith, seconded by Councilman Richmond. BUILDING & CODES DEPARTMENT: o David Smith presented the department's monthly report and gave a brief overview of the department's stats and stated he would entertain any questions. He thanked the committee for supporting the new plumbing permit fee relative to new residential construction at last month's meeting. r Mr. Smith introduced Justin Crosby, Building Official/Deputy Director. o Councilwoman Smith had questions regarding the zone and specific use of the structure located, at 423 Ford Street. Mr. Smith advised the structure in question is zoned R-3 and the Young Life facility as well as the mixed use (residential capacity) that they plan for is all permissible in the R-3 zone. Mr. Smith further explained the Young Life Organizarion is the same concept as the Wesley Foundation and Baptist Student Center. This type construction requires extensive separation requirements and is a sprinklered building. Councilwoman Smith stated she wants to ensure all the proper guidelines are being followed and Mr. Smith assured her they are. r Councilwoman Smith voiced concems regarding the Mana Cald located on D Street in New Providence. Councilwoman Smith stated she has received several complaints conceming its location, zoning and specific use, etc. After general discussion Lance Baker stated any further comments/discussion should be in an Attomey-Client privilege meeting with the Committee and,/or full Council to discuss specifics. Mr. Baker advised he will provide the Committee with articles and citations to specific statutes prior to scheduling the meeting. POLICE DEPARTMENT: o chiefAnsley presented the department's monthly report and advised he would answer any questions. o Chief Ansley introduced Deputy Chief David Crockarell and also informed the Members that Jim Knoll, PIO for the department will be retiring March 31,2020. o chief Ansley stated the department has hired I I nerv officers and they will be sworn in on March 2.2020. FIRE DEPARTMENT: o Chief Montgomery presented the department's monthly report and gave a brief breakdown by Division and stated he would answer any questions. o Chief Montgomery provided a follow up to a question regarding burn pemits by informing the Committee residents can now call 931-645-7454 on the day they plan to bum to see if buming is allowed. The key factors in whether open buming may occur are the date and the wind speed. o clarksville Fire Rescue Maintenance Division did agreatjob and saved the city approximately $10,000 by repairing the bumper on Ladder 10. The truck was recently involved in a fender bender. COMMITTEE COUNCIL ACTION REQUIRED chairman Henley asked David smith to explain the "Pending Home Improvement License." Mr. Smith gave a detailed overview stating the license would be required for residential remodeling projects from $3,000 to $24,999 (total cost or contract, including materials and labor). According to Mr. Smith this type of license will protect the consumer, especially when it comes to storm chasers because the license would require the individual(s) to provide insurance and workers compensation in addition to their license. Mr. Smith advised the Members the Building & Code Department has been approached by both Councilman Burkhart and the Home Builders Association (HBA) advocating adopting the states practice of the Home Improvement License. Mr. Smith further advised the Committee larger cities and most large counties in the State of Tennessee recognize and enforce this regulation. Councilwoman Smith asked, in addition to unlicensed individual(s), how can the consumer be protected from being "ripped off' from licensed contractors? Mr. Smith stated although preventing this is difficult there are avenues at the State level to report such actions when the individual is licensed. Chairman Henley asked Mr. Smith to forward the Members copies of the state law as well as MTAS articles explaining the license prior to Committee action. CITY COUNCIL ACTION REQUIRED ORDINANCE 63-2019-20 TO ESTABLISH A TEMPORARY PROHIBITION OR MORATORIUM ON ELECTRIC MOTORIZED BICYCLIES, SCOOTERS, AND SKATEBOARDS. Lance Baker stated as requested at the January 15,2020 Public Safety Committee meeting this version is temporary and ifapproved w-ill last until midnight on September 3, 2020 expiring automatically unless further action is taken. Councilwoman Smith, Councilman Erb and Councilman Richmond expressed concems regarding liability to the City, safety issues and regulating enforcement. After lengthy discussion among the Members motion to approve Ordinance 63-2019-20 was made by Councilman Erb and seconded by Councilman fuchmond. The vote lor the motion was three (3) in favor and two (2) against (Councilman Henley and councilman Holleman). councilman Erb made a motion to amend ordinance 63-2019-20 by establishing a permanent indefinite ban on electric motorized bicycles, scooters, and skateboards. The motion was seconded by councilman Richmond. The vote for the motion was thee (3) in favor and two (2) against (Councilman Henley and Councilman Holleman). ADJOURNMENT There being no further discussion motion to adjoum was made by councilman Richmond, seconded by Councilman Erb and approved by the committee.
