APRIL 12, 2012
CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:00 P.M.
Roll Call. Present: Joey Luiz, Mayor
Jeri Spittler, Vice Mayor
Judy Thein, Councilmember
Joyce Overton, Councilmember
Absent: Curt Giambruno, Councilmember
Staff: Joan Phillipe, Interim City Administrator

AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS
There were no additions or deletions from the agenda.
PRESENTATION
Mayor Luiz presented a Proclamation Declaring April 2012 as Child Abuse Prevention Month to Gina
Fortino-Dixon of the Lake County Office of Education.
Vice Mayor Spittler presented a Proclamation of an Act of Heroism to Lee Buckmaster and Rhonda
Straub.
PUBLIC COMMENT –
Gina Fortino-Dixon spoke regarding the need to reduce panhandling in the city.
CONSENT CALENDAR
1. Warrant Registers – Ratification and Approval of Warrants and Expenditures Certified by the
Director of Finance as Conforming with the Adopted Budget Pursuant to Government Code section
37208.

Office Indicating City’s Exemption from
Filing A Single Audit Report for the Year
Ending 2009
ACTION: It was moved by Vice Mayor Spittler and seconded by Council Member Overton to approve
the Consent Calendar as presented. The motion passed with a voice vote of 4-0-1, with Council
Member Giambruno absent.
BUSINESS
8. Discussion on Banning Smoking in City Parks
Staff report was given by Joan Phillipe. Vice Mayor Spittler gave a PowerPoint presentation.
ACTION: It was the consensus of the Council to table this item until the Chief of Police is present.
9. Public Works Department Monthly Report
Staff report was given by Doug Herren. There was no action by the Council on this item.
10. Decision by State Department of Finance on the $2.4 million in Loans Between the City and the
Former RDA Listed on the ROPS
Staff report was given by Sandra Sato.
ACTION: It was moved by Council Member Overton and seconded by Vice Mayor Spittler to
recommend to the Oversight Board to further consider the approved Recognized Obligation Payment
Schedule based on the disqualification of loans between the City and former Redevelopment Agency by
the State Department of Finance. The motion passed with a voice vote of 4-0-1, with Council Member
Giambruno absent.

CLOSED SESSION
The Council entered Closed Session at 8:03 p.m.

11. Consideration of Resolution No. 2012-13, A Resolution of the City Council of the City of
Clearlake Approving and Authorizing the Mayor to Execute an Employment Agreement with
City Manager (Joan Phillipe)
ACTION: It was moved by Council Member Overton and seconded by Vice Mayor Spittler to adopt
Resolution No. 2012-13, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CLEARLAKE APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE AN
EMPLOYMENT AGREEMENT WITH CITY MANAGER (JOAN PHILLIPE), and read it by title
only. The motion passed with a 4-0-1 voice vote, with Council Member Giambruno absent.
ADJOURNMENT
There being no further business to conduct, the meeting was adjourned at 8:10 P.M.
