MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING JULY 11, 2013 CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:00 P.M. Roll Call. Present: Jeri Spittler, Mayor Denise Loustalot, Vice Mayor Gina Fortino Dickson, Councilmember Joyce Overton, Councilmember Absent: Joey Luiz, Councilmember Staff: Joan Phillipe, City Manager Craig Clausen, Chief of Police Melissa Swanson, City Clerk AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS Item #5, Review and Discussion on Marijuana Cultivation Ordinance Proposed Language Changes, was deleted from the agenda. PUBLIC COMMENT – Bob Kiel stated the Lions Club was still accepting donations for the 2014 July 4th fireworks show. Mark Cooper spoke regarding Item #5 (deleted from the agenda therefore qualified under Public Comment). He stated daycare providers do educate the children in their care. He stated he spoke with Mr. Holbrook, Lake County Superintendent of Schools regarding the proposed ordinance and they would like private schools included. He also encouraged the Council to review the city of Lakeport’s recently passed ordinance. Richard Gilmore disagreed with Mr. Cooper and stated he did not agree that daycare providers should be included in the ordinance and that doing so limits his property rights as a medical marijuana user. Dave Hughes stated that the Council should consider banning medical marijuana. He stated even small grows can generate crime and encouraged the Council to review Lakeport’s ordinance. Bill Bennett spoke regarding the odor of tobacco smoke. He stated alcohol and tobacco are as bad or worse than medical marijuana. Ron Green, representing the Emerald Growers Association, stated Lakeport’s ordinance overly restricts medical marijuana and puts the city at risk for a lawsuit. He further stated the Council should remove the criminal penalties from the ordinance. He stated the city attorney was incorrect in the statements made in the city manager’s staff report for the item and stated the city attorney was inexperienced. Terri Larsen stated that registered sex offenders, alcohol, and tobacco should be banned if the Council was considering banning medical marijuana. She stated there is a chemical the Council can require CCM 07-11-13 Page 1 of 3 growers to put on their marijuana plants to eliminate the strong odor. She stated she is against indoor marijuana growing. She stated crime happens regardless of medical marijuana and she is in favor of making marijuana grows a code enforcement issue. She then read a letter to the Council from the Sonoma Civil Rights Action Project (attached). Consent Items Recommended Action 1 Minutes of May 23, June 6, June 13, June 20, Receive and file and June 27, 2013 2 Consideration of a Letter Authorizing the County Authorize the City Manager to Sign the Letter of of Lake to Submit a Regional Used Oil Payment Authorization Program Application on Behalf of the City of Clearlake ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Loustalot to accept the Consent Calendar as presented. The motion passed with a 4-0-1 voice vote, with Councilmember Luiz absent. BUSINESS 3 Presentation by Frank Parker of the United Veterans Council of Lake County on the VetConnect Program There was no action taken by Council on this item. 4 Consideration of Designation of Voting Delegates and Alternate(s) For the League of California Cities Annual Conference in September City Manager Phillipe gave the staff report. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Fortino Dickson to appoint Vice Mayor Loustalot as the voting delegate. The motion passed with a 4-0-1 voice vote, with Councilmember Luiz absent. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Loustalot to appoint Mayor Spittler as the alternate. The motion passed with a 4-0-1 voice vote, with Councilmember Luiz absent. 5 Review and Discussion on Marijuana Cultivation Ordinance Proposed Language Changes This item was deleted from the agenda. 6. Consideration of Adoption of Ordinance No. 2013-161: An Urgency Ordinance of the City of Clearlake Making Findings and Declaring A Temporary Building Moratorium on Lakeshore Drive Between Olympic Drive and Old Highway 53 City Manager Phillipe gave the staff report. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Loustalot to adopt Ordinance No. 2013-161: An Urgency Ordinance of the City of Clearlake Making Findings and Declaring A Temporary Building Moratorium on Lakeshore Drive Between Olympic Drive and Old Page 2 of 3 Highway 53 and read it by title only. The motion passed with a 4-0-1 voice vote, with Councilmember Luiz absent.
