Present: Jeri Spittler, Mayor Denise Loustalot, Vice Mayor Gina Fortino Dickson, Councilmember Joyce Overton, Councilmember Joey Luiz, Councilmember Staff: Joan Phillipe, City Manager Melissa Swanson, City Clerk Douglas Herren, Director of Public Works Tim Celli, Police Lieutenant AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS City Manager Joan Phillipe announced a change to Item #12, Presentation by Scott DeLeon, Director of Lake County Department of Water Resources, on the Aquatic Plant Management on Clear Lake, and stated that Mr. DeLeon was unable to make the meeting and Gary Hansen, the County of Lake Water Resources Coordinator, was present in his place. PRESENTATION 1. Mayor Spittler presented a Certificate of Appreciation to Tatonka Trading Company. 2. Mayor Spittler presented a Certificate of Appreciation to the Lakeshore Lions Club for the 4th of July Festivities PUBLIC COMMENT – CCM 07-25-13 Page 1 of 4 There was no public comment. Consideration of a Claim for Damages From Reject Claim Kim Lorenzetti Citizen Rick Mayo pulled item #7 from the Consent Calendar. Vice Mayor Loustalot pulled item #5 from the Consent Calendar. ACTION: It was moved by Councilmember Luiz and seconded by Councilmember Overton to approve Items #1 through #4, #6, and Items #8 through #10 as presented. The motion passed with a 5-0 voice vote. Vice Mayor Loustalot presented the staff report for Item #5 and read the Police Department statistics to the public. ACTION: It was moved by Councilmember Luiz and seconded by Councilmember Overton to approve Item #5. The motion passed with a 5-0 voice vote. Rick Mayo discussed Item #7 with the Council and staff. ACTION: It was moved by Councilmember Luiz and seconded by Councilmember Fortino Dickson to approve Item #7. The motion passed with a 5-0 voice vote. PUBLIC HEARING 11. Public Hearing to Consider Introduction and First Reading of Ordinance No. 162-2013, An Ordinance of the City Council of the City of Clearlake Adding Chapter 3-7 to the Clearlake Municipal Code Related to a Transactions and Use Tax for Street and Road Maintenance and Code Enforcement Purposes to be Administered by the State Board of Equalization Page 2 of 4  Recommended Action: Hold Public Hearing, introduce Ordinance by title only, waive further reading, and schedule for a public hearing and second reading and adoption at the August 8, 2013 regularly scheduled Council meeting City Manager Phillipe gave the staff report. Mayor Spittler opened the Public Hearing at 6:29 p.m. Aqeela El Amin Bakheit had questions on the ordinance which City Manager Phillipe answered. Jack Troyer spoke in favor of the ordinance and would like the private roads included in the plan. Carl Webb spoke in favor of the ordinance. Terri Larsen spoke in favor of the ordinance but against holding the election in November. Rick Mayor spoke in favor of the ordinance. Caroline Chavez spoke in favor of the ordinance. Pete Loustalot spoke in favor of the ordinance. Chuck Leonard spoke in favor of the ordinance. Dave Hughes spoke in favor of the ordinance. Bob Kiel spoke in favor of the ordinance. Estelle Creel asked questions about the ordinance which City Manager Phillipe answered. She spoke against the ordinance. Jim Scholz spoke in favor of the ordinance. Peter Shifman spoke against the ordinance. Bill Shields spoke against the ordinance. Carl Webb again spoke in favor. Estelle Creel again asked questions about the ordinance which were answered. Mayor Spittler closed the Public Hearing at 7:04 p.m. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Loustalot to hold the first reading of Ordinance No. 162-2013, An Ordinance of the City Council of the City of Clearlake Adding Chapter 3-7 to the Clearlake Municipal Code Related to a Transaction and Use Tax for Street and Road Maintenance and Code Enforcement Purposes to be Administered by the State Board of Equalization, and read it by title only, and schedule the second reading and adoption for the August 8, 2013 regularly scheduled Council meeting. The motion passed with a 4-0-1 voice vote, with Mayor Spittler opposed. BUSINESS Page 3 of 4 12. Presentation by Scott DeLeon, Director of Lake County Department of Water Resources, on the Aquatic Plant Management on Clear Lake Lake County Water Resources Coordinator Gary Hansen presented information to the Council. Council took no action on this item. 13. Presentation by Dr. Jamesina Scott, Manager and Research Director of the Lake County Vector Control District, on the Integrated Vector Management Program Dr. Scott presented information to the Council. No action was taken by the Council on this item. 14. Presentation by Phil Dow of the Lake County/City Area Planning Council on the Pomo Road Proposal to Make it a One-Way Street ACTION: It was moved by Councilmember Overton and seconded by Councilmember Fortino Dickson to remove the school buses off of Pomo Road. The motion was passed with a 4-0-1 voice vote, with Mayor Spittler opposed. Consensus was then reached by Council to monitor this action for a period of time. ACTION: It was moved by Councilmember Luiz and seconded by Vice Mayor Loustalot to hold the public hearing to consider the Pomo Road proposal to make it a one-way street. The motion passed with a 3-0-2 voice vote, with Councilmembers Overton and Fortino Dickson opposed.
