MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING AUGUST 8, 2013 CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:00 P.M. Roll Call. Present: Jeri Spittler, Mayor Denise Loustalot, Vice Mayor Gina Fortino Dickson, Councilmember Joyce Overton, Councilmember Joey Luiz, Councilmember Staff: Joan Phillipe, City Manager Mala Subramanian, City Attorney Craig Clausen, Chief of Police Melissa Swanson, City Clerk AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS There were no additions or deletions from the agenda. PRESENTATION 1. Chief Clausen introduced new police officers Travis Parson, Chris Reagan, and Michael Dietrick. 2. Conrad Colbrandt of the Redbud Healthcare District presented a special commendation for Detective Sergeant Nick Bennett, Detective Travis Lenz, and Detective Ryan Peterson for their efforts in obtaining grant funding for investigations of cases of sexual assault. PUBLIC COMMENT – Bruno Sabatier thanked the city staff for helping make the August 3rd Power to the Youth event a success. Consent Items Recommended Action There were no consent items. PUBLIC HEARING 3. Public Hearing to Consider Second Reading and Adoption of Ordinance No. 162-2013, An Ordinance of the City Council of the City of Clearlake Adding Chapter 3-7 to the Clearlake Municipal Code Related to a Transactions and Use Tax for Street and Road Maintenance and Code Enforcement Purposes to be Administered by the State Board of Equalization and Adoption of Resolution No. 2013-13, Submitting to the City of Clearlake’s Voters a Measure Seeking Approval of a Transactions and Use Tax of One Percent for Street and Road Maintenance and Code Enforcement CCM 08-08-13 Page 1 of 3 City Manager Phillipe gave the staff report. Mayor Spittler opened the Public Hearing at 6:23 p.m. Edward Trask spoke against the ordinance. Bruno Sabatier spoke in favor of the tax but stated he was against putting it on the November ballot. Harvey Bateman spoke in favor of the ordinance. Dante DeAmici spoke against the ordinance. Delia Leonard spoke in favor of the ordinance. Bill Shields spoke against putting it on the November ballot. Mike Vandiver spoke in favor of the tax but was against putting it on the November ballot. Carl Webb spoke in favor of the ordinance. Bob Kiel spoke in favor of the ordinance. Mayor Spittler closed the Public Hearing at 6:46 p.m. ACTION: It was moved by Councilmember Luiz and seconded by Vice Mayor Loustalot to adopt Resolution No. 2013-13, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLEARLAKE, LAKE COUNTY, STATE OF CALIFORNIA, SUBMITTING TO THE CITY OF CLEARLAKE’S QUALIFIED VOTERS AT THE NOVEMBER 5, 2013 GENERAL DISTRICT ELECTION A MEASURE SEEKING VOTER APPROVAL OF A TRANSACTIONS (SALES) AND USE TAX OF ONE PERCENT FOR STREET AND ROAD MAINTENANCE AND CODE ENFORCEMENT; ESTABLISHING POLICIES AND PROCEDURES IN CONNECTION WITH SUCH AN ELECTION; DIRECTING THE CITY ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS OF THE MEASURE; AUTHORIZING ARGUMENTS AND THE FILING OF REBUTTAL ARGUMENTS FOR OR AGAINST THE MEASURE; AUTHORIZING THE CITY MANAGER TO APPROPRIATE THE FUNDS NECESSARY TO PAY THE CITY’S COST OF PLACING THE MEASURE ON THE ELECTION BALLOT; DIRECTING THE CITY CLERK TO TAKE STEPS NECESSARY TO PLACE THE MEASURE ON THE BALLOT; AND REQUESTING THAT THE BOARD OF SUPERVISORS OF THE COUNTY OF LAKE DIRECT THE COUNTY ELECTIONS DEPARTMENT TO CONSOLIDATE THE ELECTION WITH THE ESTABLISHED GENERAL DISTRICT ELECTION TO BE HELD ON TUESDAY, NOVEMBER 5, 2013, AND CONDUCT THE ELECTION ON THE CITY’S BEHALF, and read it by title only. The motion passed with a voice vote of 4-0-1, with Mayor Spittler opposed. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Fortino Dickson to hold the second reading and adoption of Ordinance No. 162-2013, An Ordinance of the City Council of the City of Clearlake Adding Chapter 3-7 to the Clearlake Municipal Code Related to a Transaction and Use Tax for Street and Road Maintenance and Code Enforcement Purposes to be Administered by the State Board of Equalization, and read it by title only. The motion passed with a 4- 0-1 voice vote, with Mayor Spittler opposed. Page 2 of 3 BUSINESS 4. Consideration of Resolution No. 2013-14: A Resolution of the City Council of the City of Clearlake Concurring with the Terms, Conditions and Obligations of the Grant Agreement Between the City of Clearlake and the Redbud Health Care District in the Amount of $5,200 and Authorizing Signature by the City Manager and Public Works Director City Manager Phillipe gave the staff report. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Fortino Dickson to adopt Resolution No. 2013-14 and read it by title only (title above). The motion passed with a unanimous voice vote. Mayor Spittler then called for a 15 minute break from 7:40 p.m. to 7:55 p.m. 5. Consideration of Approval of Disencumberment of Highlands Park Improvement Grant Funding City Manager Phillipe gave the staff report. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Fortino Dickson to approve disencumberment of the grant funding. The motion passed with a unanimous voice vote. 6. Review and Discussion on Marijuana Cultivation Ordinance Proposed Language Changes City Manager Phillipe gave the staff report. It was the consensus of the Council to give direction to staff to keep the wording for the fines consistent with the County’s ordinance, to include the wording changes suggested by citizen Ron Green, and to include a provision within the draft ordinance that would “grandfather” existing childcare facilities. CITY MANAGER AND COUNCILMEMBER REPORTS Councilmember Fortino Dickson asked for and received consensus of the Council to put on a future agenda a presentation by Terri Larsen on the training she recently attending which was hosted by Al Gore. Councilmember Luiz asked for and received consensus of the Council to put on the agenda for a discussion of realignment of leadership for the remainder of the calendar year.
