MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING AUGUST 22, 2013 CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:00 P.M. Roll Call. Present: Jeri Spittler, Mayor Denise Loustalot, Vice Mayor Gina Fortino Dickson, Councilmember Joyce Overton, Councilmember Joey Luiz, Councilmember Staff: Joan Phillipe, City Manager Kara Ueda, City Attorney Craig Clausen, Chief of Police Melissa Swanson, City Clerk PUBLIC COMMENT – Mike Dunlap spoke to the audience on the Brown Act and accused members of the Council of violating the Brown Act by having a serial meeting on a radio show. Terri Larsen spoke regarding a councilmember’s behavior on Facebook and verbally stated a “cease and desist” to that councilmember. Bill Shields spoke against the road tax and spending unbudgeted funds on putting it on the ballot. Shirley Howland thanked the Council for not publicly supporting the recall of Sheriff Rivero and complimented Mayor Spittler on her good job. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS (taken out of agenda order) City Manager Phillipe introduced the City Attorney and announced a correction to the minutes on the consent calendar to state that Chief Clausen was not present at the July 25th meeting due to being on vacation. Consent Items Recommended Action 1. Warrant Registers Receive and file 2. Minutes of the July 25 and August 8, 2013 Receive and file Meetings 3. Receipt of and Response to 2012-13 Grand Jury Authorize the City’s response to the Report Report 4. Proclamation for Anni Garvin’s 100th Birthday Receive and file on August 18th, 2013 CCM 08-22-13 Page 1 of 2 ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Loustalot to adopt the Consent Calendar as presented, with the change to the July 25th minutes to reflect Chief Clausen’s absence. The motion passed with a unanimous voice vote. BUSINESS 5. Consideration of an Agreement with the Society for the Prevention of Cruelty to Animals, Kelseyville Branch, for Animal Control Services City Manager Phillipe gave the staff report. ACTION: It was moved by Councilmember Luiz and seconded by Councilmember Fortino Dickson to authorize the City Manager to sign an agreement for service between the City of Clearlake and the Society for Prevention of Cruelty to Animals of Clearlake for animal control services. The motion passed with a unanimous voice vote. Mayor Spittler called for a break from 6:45 p.m. to 6:54 p.m. 6. Consideration of Appointment of Mayor for the Remainder of Calendar Year 2013 Councilmember Luiz presented this item. ACTION: It was moved by Vice Mayor Loustalot and seconded by Councilmember Luiz to appoint a mayor for the remainder of the calendar year 2013 to be replaced. The motion passed with a roll call vote of 3-0-2, with Mayor Spittler and Councilmember Overton opposed. ACTION: It was moved by Councilmember Fortino Dickson and seconded by Councilmember Luiz to appoint Councilmember Overton as mayor for the remainder of the calendar year. The motion passed with a voice vote of 4-0-1, with Councilmember Spittler abstaining. Councilmember Spittler left the dais at 9:38 p.m. ACTION: It was the consensus of the Council to find a mediator to assist the Council in realigning itself. Vice Mayor Loustalot called for a short recess from 9:40 p.m. to 9:50 p.m. CITY MANAGER AND COUNCILMEMBER REPORTS This item was tabled to the next meeting.
