MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING FEBRUARY 27, 2014 CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:01 P.M. Roll Call. Present: Denise Loustalot, Mayor Gina Fortino Dickson, Vice Mayor Joey Luiz, Councilmember Joyce Overton, Councilmember Jeri Spittler, Councilmember Staff: Joan Phillipe, City Manager Craig Clausen, Chief of Police Adeline Brown, Deputy City Clerk AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS City Manager Phillipe requested Item #7 under Business, Verbal Report on Approval by Lake County Youth Services for Participation San Francisco Giants Youth Baseball Program, be moved to be heard under Presentation. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Overton to move Business Item #7, Verbal Report on Approval by Lake County Youth Services for Participation San Francisco Giants Youth Baseball Program, to Presentation. The motion passed with a unanimous roll call vote. PRESENTATIONS 7. Verbal Report on Approval by Lake County Youth Services for Participation San Francisco Giants Youth Baseball Program (Item moved from Business). PUBLIC COMMENT – Bill Shields spoke regarding the representation of seniors. Jesse Ivey spoke about the marijuana cultivation ordinance. Consent Items Recommended Action 1. Consideration of Adoption of Resolution No. Adopt resolution 2014-04: A Resolution of the City Council of the City of Clearlake Authorizing the Surplus of A 1998 Ford Crown Victoria Volunteer in Policing Vehicle and Transfer to the Lake County Fire Protection CCM 02-27-14 Page 1 of 4 District for Training Purposes 3. Request to Authorize the City Manager to Execute Authorize City Manager to execute agreement in an a Professional Engineering Contract with Coastland amount not to exceed $25,000 Civil Engineering for Design of the Olympic Drive and Old Hwy 53 street Maintenance Project for an Amount Not to Exceed $25,000 4. Minutes of the January 8, 2014 Lake County Receive and file Vector Control District ACTION: It was moved by Councilmember Luiz and seconded by Councilmember Overton to approve the Consent Calendar as presented. The motion passed with a 5-0 voice vote. PUBLIC HEARING 14. Public Hearing to Consider Submission of Community Development Block Grant (CDBG) Applications City Manager Phillipe gave the staff report. Mayor Loustalot opened the public hearing. There was no public comment. Mayor Loustalot closed the public hearing. ACTION: Council provided additional comments and gave direction to staff on the submission of the CDBG applications. BUSINESS 5. Presentation of the June 2013 Speed Zone Study Completed for the City of Clearlake by Phillip Dow, P.E. Lake County Area Planning Council (APC) and Request for Adoption of Resolution No. 2014-2: A Resolution of the City Council of the City of Clearlake Adopting the 2013 Speed Zone Study Phil Dow of the Lake County APC gave the report. ACTION: It was moved by Councilmember Luiz and seconded by Vice Mayor Fortino Dickson to adopt Resolution No. 2014-2: A Resolution of the City Council of the City of Clearlake Adopting the 2013 Speed Zone Study, and read by title only. The motion passed with a unanimous roll call vote of 5- 0. 6. Continued Discussion on Presenting A Sales Tax Measure to the Voters Where the Following Actions May Be Considered: A. Introduction and First Reading of An Ordinance of the City Council of the City of Clearlake Adding Chapter 3-7 to the Clearlake Municipal Code Related to a Transactions and Use Tax for Citywide Cleanup and Improvement to be Administered by the State Board of Equalization; OR B. Introduction and First Reading of An Ordinance of the City Council of the City of Clearlake Adding Chapter 3-7 to the Clearlake Municipal Code Related to a Transactions and Use Tax for Street and Road Maintenance and Code Enforcement Purposes to be Administered by the State Board of Equalization; AND Page 2 of 4  C. Consideration of Adoption of Resolution No. 2013- ____: A Resolution of the City Council for the City of Clearlake, Lake County, State of California, Submitting to the City of Clearlake’s Qualified Voters at the June 3, 2013 (or November 4, 2014) General District Election a Measure Seeking Voter Approval of a Transactions (Sales) and Use Tax of One Percent for (or some lesser number) for Citywide Cleanup and Improvement; Establishing Policies and Procedures in Connection with Such An Election; Directing the City Attorney to Prepare An Impartial Analysis of the Measure; Authorizing Arguments and the Filing of Rebuttal Arguments for or Against the Measure; Authorizing the City Manager to Appropriate the funds Necessary to Pay the City’s Cost of Placing the Measure on the Election Ballot Directing the City Clerk to Take Steps Necessary to Place the Measure on the Ballot and Requesting that the Board of Supervisors of the County of Lake Direct the County Elections Department to Consolidate the Election with the Established General District Election to be Held on Tuesday, June 3, 2014, and Conduct the Election on the City’s Behalf; OR D. ACTION: It was moved by Councilmember Luiz and seconded by Mayor Loustalot to adopt a Resolution with the number to be determined by staff and read it by title only: A Resolution of the City Council for the City of Clearlake, Lake County, State of California, Submitting to the City of Clearlake’s Qualified Voters at the June 3, 2013 General District Election a Measure Seeking Voter Approval of a Transactions (Sales) and Use Tax of One Percent, Establishing Policies and Procedures in Connection with Such An Election; Directing the City Attorney to Prepare An Impartial Analysis of the Measure; Authorizing Arguments and the Filing of Rebuttal Arguments for or Against the Measure; Authorizing the City Manager to Appropriate the funds Necessary to Pay the City’s Cost of Placing the Measure on the Election Ballot Directing the City Clerk to Take Steps Necessary to Place the Measure on the Ballot and Requesting that the Board of Supervisors of the County of Lake Direct the County Elections Department to Consolidate the Election with the Established General District Election to be Held on Tuesday, June 3, 2014, and Conduct the Election on the City’s Behalf. The motion passed with a 3-2 roll call vote, with Councilmembers Overton and Spittler voting against. ACTION: It was moved by Councilmember Luiz and seconded by Mayor Loustalot to hold the first reading and introduction of an Ordinance with the number to be determined by staff and read it by title only: An Ordinance of the City Council of the City of Clearlake Adding Chapter 3-7 to the Clearlake Municipal Code Related to a Transactions and Use Tax to be Administered by the State Page 3 of 4 Board of Equalization, and set the second Public Hearing on March 27th. The motion passed with a 4-1 roll call vote, with Councilmember Spittler abstaining. 7. Verbal Report on Approval by Lake County Youth Services for Participation San Francisco Giants Youth Baseball Program Recommended Action: Informational only, no action required This item was moved to Presentations. CITY MANAGER AND COUNCILMEMBER REPORTS ACTION: Mayor Loustalot asked for and received a consensus of the Council to place a discussion of Councilmember health benefits on a future agenda.
