MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY SPECIAL MEETING JANUARY 22, 2015 Due to Brown Act requirements, the Regular Meeting of the Council scheduled for January 22, 2015 was cancelled and re-noticed as a Special Meeting on January 20, 2015. CALL TO ORDER CLOSED SESSION CITY COUNCIL MEETING: 5:03 P.M. Roll Call. Present: Denise Loustalot, Mayor Gina Fortino Dickson, Vice Mayor Russell Perdock, Councilmember Bruno Sabatier, Councilmember Joyce Overton, Councilmember Staff: Joan Phillipe, City Manager Ryan R. Jones, City Attorney CLOSED SESSION (A) CONFERENCE WITH LABOR NEGOTIATORS: Agency designated representatives: City Manager Joan Phillipe; Employee organization: Clearlake Municipal Employees Association (B) PURSUANT TO GOVERNMENT CODE SECTION 54957: Public Employee Discipline, Dismissal, and Release Closed Session was adjourned at 5:35 P.M. ACTION: The Council voted in Closed Session 5-0 to approve a settlement agreement with Loretta Krentz regarding her employment with the City of Clearlake. The agreement would make Ms. Krentz’s separation date September 26, 2014. CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:00 P.M. Roll Call. Present: Denise Loustalot, Mayor Gina Fortino Dickson, Vice Mayor Russell Perdock, Councilmember Bruno Sabatier, Councilmember Joyce Overton, Councilmember Staff: Joan Phillipe, City Manager Craig Clausen, Chief of Police Melissa Swanson, City Clerk Chris Becnel, Director of Finance Ryan R. Jones, City Attorney Douglas Herren, Public Works Director INVOCATION/MOMENT OF SILENCE CCM 01-22-15 Page 1 of 4 Pastor Jim Lujan of the Calvary Chapel of Clearlake gave the invocation. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS City Manager Phillipe asked the Council to postpone the Presentation by Sheriff Brian Martin to February 12th. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Overton to approve the agenda as amended above. The motion passed with a 5-0 roll call vote. PRESENTATIONS Presentation of a Donation to the Clearlake Police Department K-9 Unit by Clearlake Church of the Nazarene Comments from Sheriff Brian Martin (Postponed to the February 12th meeting) PUBLIC COMMENT – Pat Llewellyn spoke regarding Citizens Caring for Clearlake, a new non-profit organized to improve Clearlake. She spoke of the need for code enforcement and for people to take pride in their city. She invited the public to attend the organization’s meeting on January 28th at Workforce at 10:45 a.m. Rick Mayo spoke regarding an application for $4M from the State for disaster assistance and his concern that staff and council use the funds for the purposed needs. Evelyn Zientek spoke regarding fence permits and stated she didn’t agree with the nuisance notice she received regarding her new fence. Consent Items Recommended Action 1. Consideration of Extension of Contract with Approve Extension City Manager to June 30, 2015 Items #8, #9 and #10 were pulled by citizen Rick Mayo. He discussed the items with staff. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Sabatier to accept the Consent Calendar Items #1 through #7. The motion passed with a 5-0 roll call vote. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Perdock to accept the Consent Calendar Item #10. The motion passed with a 5-0 roll call vote. ACTION: It was moved by Councilmember Sabatier and seconded by Councilmember Perdock to accept the Consent Calendar Item #8. The motion passed with a 5-0 roll call vote. ACTION: It was moved by Councilmember Perdock and seconded by Councilmember Overton to accept the Consent Calendar Item #9. The motion passed with a 5-0 roll call vote. BUSINESS 11. Discussion /Consideration of the Council’s Conceptual Approval of Development of County Owned Property Located at 15837 18th Avenue, Clearlake CA 95422 (APN 010-043-001), for the Development of a Veteran’s Housing Project as Well as Consideration of Waiving Fees for Any Required Amendments to the General Plan or Zoning Designations City Manager Phillipe gave the staff report. County Supervisor Jeff Smith and Deputy County Administrative Officer Chris Shaver gave a presentation to the Council. Project Developer Bert McChesney of the Veteran’s Resource Center presented a conceptual design and past projects to the Council. ACTION: It was moved by Councilmember Perdock and seconded by Councilmember Sabatier to conceptually approve a Veterans’ housing project located on property currently owned by Lake County within the city’s limits. The motion passed with a 5-0 roll call vote. 12. Discussion on proposed amendments to the current agreements between the City of Clearlake and the Clear Lake Chamber of Commerce and Lake County Youth Services Councilmember Overton recused herself from the discussion and vote because she is the volunteer Executive Director of the Youth Center City Attorney Jones gave the staff report. After discussion with staff, it was the consensus of the Council to allow one use of the Clearlake Senior Community Center per year by the Lake County Youth Services, changing from the proposed three uses. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Mayor Loustalot to approve an amendment to the Lake County Youth Services lease agreement for the Youth Center as amended. The motion passed with a 4-0-1 roll call vote, with Councilmember Overton abstaining. 13. Discussion on current marijuana growing ordinance addressing its effectiveness and possible options for amendment CCM 01-22-15 Page 3 of 4 City Attorney Jones, City Manager Phillipe, Finance Director Becnel, Chief Clausen, and Lake County Fire District Chief Willie Sapeta gave presentations to the Council on this item. ACTION: It was the consensus of the Council to direct staff to draft an ordinance which prohibits indoor and outdoor grows of marijuana and to add an abatement clause to the ordinance, with Councilmember Sabatier dissenting. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Perdock to continue the Council meeting past 10:00 p.m. The motion passed with a 5-0 roll call vote. CITY MANAGER AND COUNCILMEMBER REPORTS ACTION: Councilmember Perdock asked for and received consensus from the Council to bring a discussion of an “Adopt A Park” ordinance on a future agenda. He further received consensus from the Council to discuss a shopping cart ordinance on a future agenda. Additionally, he received consensus from the Council to discuss a “No Camping” ordinance for non-camping areas within the City. ACTION: Councilmember Sabatier asked for and received consensus from the Council to direct staff to draft a letter to Senator McGuire ahead of Councilmember Sabatier’s meeting with the Senator stating the City’s funding needs and priorities and copy the remaining state representatives. He further asked for and received consensus from the Council to review the cost-effectiveness of city staff’s 4/10 schedule and Friday closure. City Manager Phillipe asked the Council to consider the directions given to staff be reviewed at the budget workshops under goals and objectives for the following fiscal year.
