Jones, City Attorney William Clemans, City Engineer INVOCATION/MOMENT OF SILENCE Mayor Loustalot led a moment of silence. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Sabatier CCM 12-10-15 Page 2 of 5 to approve the agenda as presented. The motion passed with a unanimous roll call vote. PUBLIC COMMENT – Chuck Leonard announced that former Councilmember Roy Simons had passed away in October. Bill Shields spoke against City Hall being open only four days a week. Preston Dickson with AT&T introduced himself as the Government Liason. Charles Everich spoke regarding a fire break around his house which has a problem with traffic, erosion, and trash. Consent Items Recommended Action 1. Warrant Registers Receive and file 2. Consideration of Second Reading and Adoption of Hold the second reading of the ordinance, Ordinance No. 178-2015, An Ordinance of the City read it by title only, waive further reading Council of the City of Clearlake Adding Section 10-8 and adopt Ordinance No. 178-2015 to Chapter X of the Clearlake Municipal Code Relating to the Regulation of Shopping Carts ACTION: It was moved by Councilmember Perdock and seconded by Vice Mayor Fortino Dickson to accept the Consent Calendar as presented. The motion passed with a unanimous roll call vote. BUSINESS 3. Introduction and First Reading of Ordinance No. 179-2015, an Ordinance of the City Council of the City of Clearlake Adding Section 5-10.1(a) of Chapter V, Police Regulations, to the Clearlake Municipal Code, Relating to Conduct in the Public Parks and Beaches Lt. Celli gave the staff report. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Perdock to introduce Ordinance No. 179-2015 by title only, waive further reading, and to schedule for second reading and adoption at the January 14, 2016 regularly scheduled Council meeting. The motion passed with a unanimous roll call vote. 4. Introduction and First reading of Ordinance No. 180-2015, An Ordinance of the City Council of the City of Clearlake Amending Section 7-2.5 and Adding Sections 7-5.5 and Section 7-5.6, of Chapter 7, Animal Control, to the Clearlake Municipal Code, Relating to Responsible Dog Ownership City Manager Folsom gave the staff report. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Sabatier to remove the provision in the ordinance that exempts people aged 65 and older from the CCM 12-10-15 Page 3 of 5 ordinance, introduce Ordinance No. 180-2015 by title only, waiver further reading, and to schedule second reading and adoption at the January 14, 2016 regularly scheduled Council meeting. The motion passed with a unanimous roll call vote. 5. Introduction and First reading of Ordinance No. 181-2015, An Ordinance of the City Council of the City of Clearlake Amending Section 5-10.8 of Chapter 5, Police Regulations, to the Clearlake Municipal Code, Relating to Dogs in Parks City Manager Folsom gave the staff report. Council took no action on this item. Councilmember Overton recused herself from Item 6 due to the fact that she is the Executive Director of the Youth Center, which has storage items in the Austin Resort buildings. She left the dais at 7:35 p.m. 6. Direction to Staff Regarding the City-Owned Austin Resort Buildings City Manager Folsom gave the staff report. ACTION: It was the consensus of the Council to direct staff to develop the property as a commercial property to its highest and best use to generate income for the City. Further, the Council gave direction to staff to demolish the building located on the property at 14061 Lakeshore Drive. It was also the consensus of the Council to bring the Lakeshore Drive Corridor Plan to a future agenda for discussion and possible amendment. Councilmember Sabatier recused himself from Item 7 due to the fact that he participates in planning youth events at parks and the Community Senior Center. Councilmember Overton recused herself from Item 7 due to the fact that she is the Executive Director of the Highlands Senior Service Center and also participates in planning youth events at parks and the Community Senior Center. 7. Consideration of Updating the Rental Fee Waiver Policy for the Clearlake Community Senior Center and City Parks City Clerk Swanson gave the staff report. ACTION: It was moved by Councilmember Perdock and seconded by Mayor Loustalot to adopt the updated policy. The motion passed with a roll call vote of 3-0-2, with Councilmembers Overton and Sabatier abstaining. Councilmembers Overton and Sabatier returned to the dais at 8:05 p.m. CITY MANAGER AND COUNCILMEMBER REPORTS CCM 12-10-15 Page 4 of 5 APPOINTMENT OF THE 2016 MAYOR AND VICE MAYOR ACTION: Councilmember Overton nominated and Councilmember Sabatier seconded Councilmember Perdock as 2016 Mayor. The nomination passed with a unanimous roll call vote. Mayor Loustalot nominated and Councilmember Perdock seconded Vice Mayor Fortino Dickson as 2016 Vice Mayor. The nomination passed with a unanimous roll call vote. FUTURE AGENDA ITEMS Councilmember Sabatier asked for and received consensus to bring a discussion about a warming center to a future agenda.
