MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING JANUARY 28, 2016 CALL TO ORDER CLOSED SESSION CITY COUNCIL MEETING: 5: 30 P.M. Roll Call. Present: Russell Perdock, Mayor Gina Fortino Dickson, Vice Mayor Denise Loustalot, Councilmember Joyce Overton, Councilmember Bruno Sabatier, Councilmember Staff: Greg Folsom, City Manager Ryan R. Jones, City Attorney Tim Celli, Police Lieutenant CCM 01-28-16 Page 1 of 4 Melissa Swanson, City Clerk Chris Becnel, Director of Finance Lee Lambert, Building Inspector INVOCATION/MOMENT OF SILENCE Mayor Perdock led a moment of silence in honor of those who lost their lives in the Challenger disaster. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Sabatier to approve the agenda as presented. The motion passed with a unanimous voice vote. Due to the absence of a presenter, Public Comment and the Consent Calendar were taken before Presentation. PUBLIC COMMENT – There was no public comment Consent Items Recommended Action 1. Warrant Registers Receive and file 2. Minutes of the November 12, November 17, Receive and file December 10, December 15, 2015, and January 14, 2016 meetings 3. Consideration of Second Reading and Adoption Hold the second reading of the ordinance, of Ordinance No. 180-2015, An Ordinance of the read it by title only, waive further reading City of Clearlake Requiring Dogs to be Leashed and adopt Ordinance No. 180-2015 and Owners to Pick Up Dog Waste 4. Consideration of Establishing a Job Description Motion to adopt Resolution No. 2016-04, and Range for Community Development A Resolution of the City Council of the City Manager of Clearlake Approving a Job Description for a Community Development Manager Position, and to read it by title only 5. Award of Contract for Asbestos Survey and Lead- Authorize the City Manager to execute a Based Paint Assessment and Report in contract with Geocon Consultants for a Preparation for Demolition of Structures Located not to exceed amount of $3,800.00 at 14061 Lakeshore Drive CCM 01-28-16 Page 2 of 4 6. Review and Consideration of the ROPS FY 16-17 Approve Resolution No. SA-2016-01, for Both Periods A (July to December) and B authorizing submission of ROPS FY 16-17 (January to June) to the Oversight Board for July 1, 2016 to June 30, 2017 to the Oversight Board 7. Amendment to the Clearlake Police Officer Adopt Resolution No. 2016-05 approving Association Memorandum of Understanding amendment Adding POST Incentive Pay for Dispatchers 8. Award of Contract for Austin Park Master Plan Award contract 9. Offer of Donation of Land to the City of Clearlake Adopt Resolution No. 2016-06 to accept for the Lot Located at 15886 18th Avenue the offer of donation for the property located at 15886 18th Avenue and authorize the City Manager to take whatever actions are necessary to complete the transaction Councilmember Overton removed Item #4. Councilmember Sabatier removed Item #8. Item #4 was discussed by the Council, staff and public. City Manager Folsom gave the staff report. ACTION: It was the consensus of the Council to rework the job description and job title for the position and bring it back for further Council consideration. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Loustalot to accept remainder of the Consent Calendar as presented. The motion passed with a unanimous roll call vote. Item #8 was discussed by the Council, staff and public. City Manager Folsom gave the staff report. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Loustalot to award the contract for the Austin Park Master Plan. The motion passed with a roll call vote of 4-1, with Councilmember Sabatier opposed. PRESENTATION Presentation by the Health Leadership Network Mayor Perdock called for a ten minute break at 7:30 p.m. CCM 01-28-16 Page 3 of 4 BUSINESS 10. Acceptance of Annual Audit Report for FYE 2015; including the Report to Those Charged with Governance and the Appropriations Limit Report Director of Finance Becnel gave the staff report. Auditor Terry Krieg gave a presentation on the audit. Council took no action on this item. 11. Consideration of Second Reading and Adoption of Ordinance No. 181-2016, An Ordinance of the City Council of the City of Clearlake Adding Chapter 18-8 to the Clearlake Municipal Code (Marijuana Cultivation) and Repealing Section 10-7 (Commercial Medical Marijuana Cultivation and Cultivation on Vacant Properties, and Limiting Cultivation Amounts) City Manager Folsom gave the staff report. The provision which changed setbacks from 10 feet to 5 feet was mistakenly changed by staff and was not the direction of the Council, and therefore will be changed back to 10 feet for the February 11th reading. ACTION: It was the consensus of the Council to add to the ordinance a provision that all fines must be paid before the five-year growing ban is lifted. ACTION: It was moved by Councilmember Sabatier and seconded by Councilmember Overton to hold the second reading of the ordinance, read it by title only, waive further reading and set further reading and adoption of the ordinance for February 11th. The motion passed with a unanimous roll call vote. CITY MANAGER AND COUNCILMEMBER REPORTS FUTURE AGENDA ITEMS ADJOURNMENT Mayor Perdock adjourned the meeting at 8:58 p.m. in honor of City Manager Folsom’s father, Mel Folsom, who passed away earlier in the month.
