ACTION: The Council unanimously voted to authorize the City Manager to enter into a settlement agreement in Case No. CV 414715, Anthony Spittler, et al. v. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Overton to approve the agenda as presented. The motion passed with a unanimous voice vote. PRESENTATION 1. Presentation of a Proclamation Declaring February 2016 as Black History Month PUBLIC COMMENT – Nichole Cook announced that Citizens Caring for Clearlake would be cleaning up the Borax Lake area on Valentine’s Day. Estelle Creel spoke regarding the animal control building and the lack of a proper facility. Consent Items Recommended Action 2. Warrant Registers Receive and file 3. Consideration of Resolution No. 2016-07, a Adopt Resolution Resolution of the City Council of the City of Clearlake Authorizing Submittal of Application for Payment Programs and Related Authorizations ACTION: It was moved by Councilmember Sabatier and seconded by Vice Mayor Fortino Dickson to approve the Consent Calendar as presented. The motion passed with a unanimous roll call vote. BUSINESS 6. Consideration of a New Sign at Valentine Field Which Names the Softball Field at Redbud Park in Honor of Mr. and Mrs. Dale Valentine CCM 02-11-16 Page 2 of 4 City Manager Folsom gave the staff report. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Loustalot to approve the new sign in Valentine Field softball field area. The motion passed with a unanimous roll call vote. 7. Consideration of Second Reading and Adoption of Ordinance No. 181-2016, An Ordinance of the City Council of the City of Clearlake Adding Chapter 18-8 to the Clearlake Municipal Code (Marijuana Cultivation) and Repealing Section 10-7 (Commercial Medical Marijuana Cultivation and Cultivation on Vacant Properties, and Limiting Cultivation Amounts) City Manager Folsom gave the staff report. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Loustalot to hold the second reading of the ordinance, read it by title only, Ordinance No. 181- 2016, An Ordinance of the City Council of the City of Clearlake Adding Chapter 18-8 to the Clearlake Municipal Code (Marijuana Cultivation) and Repealing Section 10-7 (Commercial Medical Marijuana Cultivation and Cultivation on Vacant Properties, and Limiting Cultivation Amounts), waive further reading and adopt Ordinance No. 181-2016. The motion passed with a unanimous roll call vote. 8. Introduction and First Reading of Ordinance No. 182-2016, an Ordinance of the City of Clearlake Prohibiting Camping on Private Property City Manager Folsom gave the staff report. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Sabatier to hold the first reading of the ordinance, read it by title only, Ordinance No. 182-2016, an Ordinance of the City of Clearlake Prohibiting Camping on Private Property, waive further reading and recommend second reading at the February 25th meeting. The motion passed with a unanimous roll call vote. 9. Introduction and First Reading of Ordinance No. 183-2016, an Ordinance of the City of Clearlake Amending Chapter VII, Animal Control, of the Clearlake Municipal Code City Manager Folsom gave the staff report. ACTION: It was moved by Councilmember Loustalot and seconded by Vice Mayor Fortino Dickson to hold the first reading of the ordinance, read it by title only, Ordinance No. 183-2016, an Ordinance of the City of Clearlake Amending Chapter VII, Animal Control, of the Clearlake Municipal Code, waive further reading and schedule second reading and adoption at the February 25th meeting. The motion passed with a unanimous roll call vote. CCM 02-11-16 Page 3 of 4 10. Consideration of an Ad Hoc Committee to Review and Recommend a Committee and Commission Appointment Policy City Manager Folsom gave the staff report. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Sabatier to confirm Mayor’s appointment of Councilmembers Loustalot and Overton to work with the City Manager and the City Clerk to develop a Committee/Commission Appointment Policy for Council consideration. Further, it was the consensus of the Council to appoint public members and one or two Planning Commissioners for this ad hoc committee. CITY MANAGER AND COUNCILMEMBER REPORTS FUTURE AGENDA ITEMS ACTION: Councilmember Sabatier asked for and received consensus to discuss adding an ad hoc marketing committee on a future agenda.
