MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY SPECIAL MEETING SEPTEMBER 26, 2016 CALL TO ORDER SPECIAL CITY COUNCIL MEETING: 5:30 P.M. Roll Call. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 3419 Green Avenue, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-39 Code Enforcement Supervisor Lambert gave the staff report. Vice Mayor Sabatier opened the Public Hearing at 5:35 p.m. Adam Giordano, appellant, spoke against the abatement order. CCM 09-26-16 Page 1 of 8 ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to close the Public Hearing at 5:47 p.m. The motion passed with a unanimous voice vote, with Mayor Perdock absent. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 3875 Schultz Avenue, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-40 Code Enforcement Supervisor Lambert gave the staff report. Vice Mayor Sabatier opened the Public Hearing at 5:50 p.m. An unnamed man spoke against the abatement order. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to close the Public Hearing at 5:55 p.m. The motion passed with a unanimous voice vote, with Mayor Perdock absent. ACTION: It was moved by Councilmember Bennett and seconded by Councilmember Overton to adopt Resolution No 2016-40 denying the appeal. Vice Mayor Sabatier opened the Public Hearing at 5:56 p.m. Ted Barcelon, appellant, spoke against the abatement order. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to close the Public Hearing at 6:04 p.m. The motion passed with a unanimous voice vote, with Mayor Perdock absent. Vice Mayor Sabatier opened the Public Hearing at 6:06 p.m. Teresa and Joseph Lia, appellants, spoke against the abatement order. An unnamed woman spoke in favor of the abatement order. An unnamed man had questions on the abatement order. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to close the Public Hearing at 6:18 p.m. The motion passed with a unanimous voice vote, with Mayor Perdock absent. ACTION: It was moved by Councilmember Bennett and seconded by Councilmember Overton to adopt Resolution No 2016-42 denying the appeal. The motion passed with a unanimous voice vote, with Mayor Perdock absent. 5. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 14910 Davis Avenue, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-43 Code Enforcement Supervisor Lambert gave the staff report. Vice Mayor Sabatier opened the Public Hearing at 6:22 p.m. There were no comments on this item. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to close the Public Hearing at 6:23 p.m. The motion passed with a unanimous voice vote, with Mayor Perdock absent. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to adopt Resolution No 2016-43 denying the appeal. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 15419 Stanyon Street, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-44 Code Enforcement Supervisor Lambert gave the staff report. Vice Mayor Sabatier opened the Public Hearing at 6:26 p.m. Tamara Sutch, appellant, spoke against the abatement order. She entered into evidence a letter from her neighbor, Lloyd Wilborn, against the abatement order. She further entered into evidence photos of her property. Both are attached to the minutes and are a part of the record thereof. An unnamed man spoke against the abatement order. Vice Mayor Sabatier called for a recess from 6:31 p.m. to 6:44 p.m. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to close the Public Hearing at 7:05 p.m. The motion passed with a unanimous voice vote, with Mayor Perdock absent. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to carry over the appeal hearing to the special meeting of October 10th. The motion passed with a unanimous voice vote, with Mayor Perdock absent. 7. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 15820 20th Avenue, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-45 Code Enforcement Supervisor Lambert gave the staff report. Vice Mayor Sabatier opened the Public Hearing at 7:10 p.m. Julio Sanchez, appellant, spoke against the abatement order. An unnamed man had questions on the process. A point of order was called by Councilmember Overton as it was off topic. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to close the Public Hearing at 7:13 p.m. The motion passed with a unanimous voice vote, with Mayor Perdock absent. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to close the Public Hearing at 7:46 p.m. The motion passed with a unanimous voice vote, with Mayor Perdock absent. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to adopt Resolution No 2016-51 denying the appeal. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to close the Public Hearing at 7:49 p.m. The motion passed with a unanimous voice vote, with Mayor Perdock absent.
