MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY SPECIAL MEETING OCTOBER 10, 2016 CALL TO ORDER SPECIAL CITY COUNCIL MEETING: 5:30 P.M. Roll Call. Present: Russell Perdock, Mayor Bruno Sabatier, Vice Mayor Nick Bennett, Councilmember Joyce Overton, Councilmember Staff: Greg Folsom, City Manager Ryan Jones, City Attorney Tim Hobbs, Police Sergeant Melissa Swanson, City Clerk Chris Becnel, Director of Finance Chelsea Banks, Code Enforcement Technician Tina Viramontes, Code Enforcement Officer Steve Felder, Code Enforcement Officer PUBLIC HEARING 1. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 4316 Hill Avenue, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-54 Code Enforcement Technician Banks gave the staff report. Mayor Perdock opened the Public Hearing at 5:36 p.m. There was no public comment. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to close the Public Hearing at 5:36 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Sabatier to adopt Resolution No 2016-54 denying the appeal. The motion passed with a unanimous voice vote. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 14604 Palmer Avenue, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-55 Code Enforcement Technician Banks gave the staff report. Mayor Perdock opened the Public Hearing at 5:38 p.m. There was no public comment. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to close the Public Hearing at 5:38 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Overton to adopt Resolution No 2016-55 denying the appeal. The motion passed with a unanimous voice vote. 3. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 16092 10th Avenue, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-56 Code Enforcement Technician Banks gave the staff report. Mayor Perdock opened the Public Hearing at 5:39 p.m. There was no public comment. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Bennett to close the Public Hearing at 5:39 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Overton to adopt Resolution No 2016-56 denying the appeal. The motion passed with a unanimous voice vote. 4. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 16034 18th Avenue, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-57 Code Enforcement Technician Banks gave the staff report. Mayor Perdock opened the Public Hearing at 5:41 p.m. CCM 10-10-16 Page 2 of 6 Estella Creel, appellant, spoke against the abatement order. She brought photos of her property, which are attached to these minutes and hereby made a part of the record therein. Chuck Leonard spoke in favor of the abatement order. Estella Creel, appellant, spoke again against the abatement order. Steve Felder, Code Enforcement Officer, gave testimony regarding the abatement order. Estella Creel, appellant, rebutted Officer Felder’s testimony. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to close the Public Hearing at 5:58 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Councilmember Bennett and seconded by Vice Mayor Sabatier to adopt Resolution No 2016-57 denying the appeal. The motion passed with a unanimous voice vote. 5. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 15800 20th Avenue, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-58 Code Enforcement Technician Banks gave the staff report. Mayor Perdock opened the Public Hearing at 6:02 p.m. Guadalupe Ponce, appellant, stated the marijuana has been removed and provided photos, which are attached to these minutes and hereby made a part of the record therein. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Sabatier to close the Public Hearing at 6:04 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to adopt Resolution No 2016-58 denying the appeal. The motion passed with a unanimous voice vote. 6. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 15831 21st Avenue, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-59 Code Enforcement Technician Banks gave the staff report. Mayor Perdock opened the Public Hearing at 6:06 p.m. CCM 10-10-16 Page 3 of 6 Samuel Nava, appellant, spoke against the abatement order. He stated the marijuana has been removed from the property. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Sabatier to close the Public Hearing at 6:07 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to adopt Resolution No 2016-59 denying the appeal. The motion passed with a unanimous voice vote. 7. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 15841 21st Avenue, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-60 Code Enforcement Technician Banks gave the staff report. Mayor Perdock opened the Public Hearing at 6:09 p.m. There was no public comment on this item. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Sabatier to close the Public Hearing at 6:09 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to adopt Resolution No 2016-60 denying the appeal. The motion passed with a unanimous voice vote. 8. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 15880 42nd Avenue, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-61 Code Enforcement Technician Banks gave the staff report. Mayor Perdock opened the Public Hearing at 6:11 p.m. There was no public comment on this item. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Sabatier to close the Public Hearing at 6:11 p.m. The motion passed with a unanimous voice vote. The motion passed with a unanimous voice vote. 9. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 15928 45th Avenue, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-62 Code Enforcement Technician Banks gave the staff report. Mayor Perdock opened the Public Hearing at 6:13 p.m. There was no public comment on this item. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Overton to close the Public Hearing at 6:13 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Overton to adopt Resolution No 2016-62 denying the appeal. The motion passed with a unanimous voice vote. 10. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 15945 45th Avenue, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-63 Code Enforcement Technician Banks gave the staff report. Mayor Perdock opened the Public Hearing at 6:15 p.m. Councilmember Overton recused herself from the discussion and determination due to a working relationship with the appellant, Gregory Wright, and left the dais at 6:22 p.m. Gregory Wright, appellant, spoke against the assessment. ACTION: It was moved by Councilmember Bennett and seconded by Vice Mayor Sabatier to close the Public Hearing at 6:29 p.m. The motion passed with a unanimous voice vote, with Councilmember Overton abstaining. ACTION: It was moved by Councilmember Bennett and seconded by Vice Mayor Sabatier to adopt Resolution No 2016-63 denying the appeal. The motion passed with a unanimous voice vote, with Councilmember Overton abstaining. Councilmember Overton returned to the dais at 6:31 p.m. CCM 10-10-16 Page 5 of 6 11. Public Hearing to Hold and Act Upon an Abatement Order Appeal Hearing Referencing Real Property Located at 15419 Stanyon Street, Clearlake CA 95422 in Accordance with Clearlake Municipal code Sections 18-8.110, 18-8.120, 18-8.130 and 18-10 in its Entirety; Resolution No. 2016-44 Code Enforcement Technician Banks gave the staff report. Mayor Perdock opened the Public Hearing at 6:33 p.m. Tamara Sutch, appellant, spoke against the abatement order. Rick Mayo asked questions of the process answered by staff. Chuck Leonard spoke in favor of the abatement order. Phil Harris spoke in favor of granting the appeal. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Overton to close the Public Hearing at 6:48 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Bennett to adopt Resolution No 2016-44 denying the appeal. The motion passed with a unanimous voice vote.
