MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING MARCH 23, 2017 CALL TO ORDER CLOSED SESSION: 5:00 P.M. Roll Call. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Sabatier to approve the agenda as presented. The motion passed with a unanimous voice vote. PRESENTATION 1. Presentation of a Proclamation Declaring April 2017 as Sexual Assault Awareness Month 2. Presentation by Patty Bruder, NCO, Inc., Mike Dean, Lake County Community Action Group and Jo Bennett, Lake County Council of Church Women United Shoe Program on Community Involvement 3. Presentation of the Clearlake Waste Solutions Annual Report PUBLIC COMMENT Eileen Navarette spoke regarding the homeless issue near Ray’s Food Place. Chris Taliaferro spoke regarding the Veteran’s Project and requested letters of support from Councilmembers. Fire Chief Willie Sapeta spoke regarding the passage of Measure D and thanked the community for their support. Consent Items Recommended Action 4. Warrant Registers Receive and file 5. Review and Approval of Contract Amendment Move approval and authorize the City for Hinderliter De Llamas (HdL) for Professional Manager to sign the First Amendment to Services Professional Services Agreement with Hinderliter De Llamas (HdL) 6. Auditing Services for FYE 2017 City of By motion, authorize Finance Director to Clearlake Financial Statements sign Engagement Letter ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Harris to approve the Consent Calendar as presented. Public Hearing to Confirm Assessment(s) in the Total Amount of $12,500.00 for Administrative Penalties for Failure to Abate Public Nuisance(s) in Accordance with C.M.C. Section(s) 1-5, 1-9, 10- 1.6, 10-1.7, 10-1.9, 10-1.12, 10-2.2(b), 10-2.4, 10-2.5, 10-2.6, 10-2.7, 10-2.8, 10-3.1, 10-3.3, 10-5 and 10-5.6; Resolution No. 2017-17 Code Enforcement Officer Viramontes gave the staff report. #1. 3412 Grey Avenue Mayor Perdock opened the Public Hearing at 6:52 p.m. There was no public comment. #2. 3720 Buckeye Street There was no public comment. #3. 4054 Lansing Avenue There was no public comment. #4. 3845 Mullen Avenue There was no public comment. #5. 15435 Mason Street Owner Stephen Phipps spoke against the assessment. There was no further public comment. The Public Hearing was closed at 7:19 p.m. ACTION: It was moved by Councilmember Harris and seconded by Vice Mayor Sabatier to adopt Resolution No. 2017-17, A Resolution of the City Council of the City of Clearlake Confirm Assessment(s) in the Total Amount of $12,500.00 for Administrative Penalties for Failure to Abate Public Nuisance(s) in Accordance with C.M.C. Section(s) 1-5, 1-9, 10-1.6, 10-1.7, 10-1.9, 10- 1.12, 10-2.2(b), 10-2.4, 10-2.5, 10-2.6, 10-2.7, 10-2.8, 10-3.1, 10-3.3, 10-5 and 10-5.6, and read it by title only. The motion passed with a unanimous roll call vote. BUSINESS 8. Consideration to Authorize the Commencement of Proceedings in Connection with the Refinancing of Certain Outstanding Tax Allocation Bonds, and Appointing the Necessary Consultants in Connection Therewith; Resolution SA-2017-02 CCM 03-23-17 Page 3 of 4 Director of Finance Becnel gave the staff report. ACTION: It was moved by Vice Chair Sabatier and seconded by Member Harris to adopt Resolution No. SA-2017-02, A RESOLUTION OF THE SUCCESSOR AGENCY TO THE CLEARLAKE REDEVELOPMENT AGENCY AUTHORIZING THE COMMENCEMENT OF PROCEEDINGS IN CONNECTION WITH THE REFINANCING OF OUTSTANDING SERIES 2006A AND SERIES 2006B TAX ALLOCATION BONDS, AND APPOINTING THE NECESSARY CONSULTANTS IN CONNECTION THEREWITH, and read it by title only. The motion passed with a unanimous roll call vote. 9. Second Reading of Ordinance No. 195-2017, An Ordinance of the City Council of the City of Clearlake Adding Section 5-24, Chapter 5 of the Clearlake Municipal Code Prohibiting Scavenging City Manager Folsom gave the staff report. ACTION: It was moved by Councilmember Bennett and seconded by Councilmember Harris to hold the second reading of ordinance by title only, waive further reading and adopt Ordinance No. 195- 2017, An Ordinance of the City Council of the City of Clearlake Adding Section 5-24, Chapter 5 of the Clearlake Municipal Code Prohibiting Scavenging. The motion passed with a unanimous roll call vote.
