ACTION: It was moved by Vice Mayor Sabatier and seconded by Council Member Bennett to approve the agenda as amended. The motion passed with a unanimous voice vote. PRESENTATION 1. Public Hearing to Confirm Assessment(s) in the Total Amount of $47,500 for Administrative Penalties for Failure to Abate Public Nuisance(s) in Accordance with C.M.C. Section(s) 1-5, 1-9, 10- 1.6, 10-1.7, 10-1.9, 10-1.12, 10-2.2(b), 10-2.4, 10-2.5, 10-2.6, 10-2.7, 10-2.8, 10-3.1, 10-3.3, 10-5 and 10-5.6 Code Enforcement Officer Viramontes gave the staff report for Items #1 through #6. 1. 3619 Sycamore Street Mayor Perdock opened the Public Hearing at 6:24 p.m. Chuck Leonard spoke in favor of the assessments. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Bennett to close the Public Hearing at 6:26 p.m. The motion passed with a unanimous voice vote. 2. 15237 Taft Drive Mayor Perdock opened the Public Hearing at 6:30 p.m. Sheryl Almon asked questions of staff. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Overton to close the Public Hearing at 6:31 p.m. The motion passed with a unanimous voice vote. 3. 3539 Sycamore Street CCM 07-27-17 Page 2 of 6 Mayor Perdock opened the Public Hearing at 6:40 p.m. There was no public comment. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Harris to close the Public Hearing at 6:40 p.m. The motion passed with a unanimous voice vote. 4. 4414 Old Highway 53 This assessment was removed from the Public Hearing by staff due to compliance. 5. 5644 Huron Avenue This property owner gave written testimony submitted to the City Clerk which is attached to these minutes and hereby made part of the record. Mayor Perdock opened the Public Hearing at 6:48 p.m. There was no public comment. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Sabatier to close the Public Hearing at 6:48 p.m. The motion passed with a unanimous voice vote. 6. 15950 29th Avenue This item was removed from the Public Hearing by staff due to compliance. 7. 3411 Brown Street Code Enforcement Officer Steve Felder gave the staff report for Items #7 through #10. Mayor Perdock opened the Public Hearing at 6:52 p.m. Sheryl Almon spoke in favor of assessment. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Harris to close the Public Hearing at 6:55 p.m. The motion passed with a unanimous voice vote. 8. 16735 Cache Creek Lane Mayor Perdock opened the Public Hearing at 6:55 p.m. There was no public comment. ACTION: It was moved by Councilmember Harris and seconded by Vice Mayor Sabatier to close the Public Hearing at 6:57 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Harris to close the Public Hearing at 7:08 p.m. The motion passed with a unanimous voice vote. 10. 15783 40th Avenue Mayor Perdock opened the Public Hearing at 7:11 p.m. There was no public comment. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Sabatier to close the Public Hearing at 7:11 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Harris to adopt Resolution No. 2017-47, with the changes noted above, confirming assessments. The motion passed with a unanimous roll call vote. 7. Public Hearing to Hear and Act upon an Abatement Order Appeal Hearing Referencing Real Property Located at 16224 42nd Avenue Clearlake, CA 95422 in Accordance with C.M.C. section(s) 18-9.110, 18-9.120, 18-9.130 and 18-10 In Its Entirety This item was deleted from the agenda. 8. Public Hearing to Confirm Assessment(s) in the Total Amount of $30,528.94 for Abatement of 14709 Palmer Avenue, In Accordance with C.M.C. Section(s) 10-1.6, 10-1.8, 10-2.1, 10-2.2, 10-2.7(c) and 10-5.1 – 10-5.4 Code Enforcement Supervisor Lambert gave the staff report. Mayor Perdock opened the Public Hearing at 7:16 p.m. There was no public comment. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Overton to close the Public Hearing at 7:16 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Councilmember Harris and seconded by Councilmember Overton to adopt Resolution No. 2017-39 confirming assessment. The motion passed with a unanimous roll call vote. Mayor Perdock opened the Public Hearing at 7:21 p.m. There was no public comment. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Overton to close the Public Hearing at 7:22 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Bennett to adopt Resolution No. 2017-40 confirming assessments. The motion passed with a unanimous roll call vote. Mayor Perdock called for a break from 7:20 p.m. to 7:32 p.m. BUSINESS 10. Consideration of Second Reading and Adoption of 198-2017, an Ordinance Amending Section 4 of Chapter XI of the Clearlake Municipal Code Establishing Universal Garbage Service, Providing Rules and Regulations Governing the Collection, Handling and Disposal of Solid Waste and Other Operating Regulations City Manager Folsom gave the staff report. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Harris to hold the second reading of Ordinance No. 198-2017 by title only, waive further reading, and adopt the ordinance. The motion passed with a 4-1 roll call vote, with Councilmember Overton against. 11. Discussion of Potential Collaboration with Adventist Health City Manager Folsom gave the staff report. Rebecca Southwick, Adventist Health Development Director was present to answer questions. ACTION: It was the consensus of the Council to give direction to staff to move forward with a feasibility study (paid for by Adventist Health) for partnerships on projects with Adventist Health. 12. Discussion of Potential Improvements at the Community Center City Manager Folsom gave the staff report. CCM 07-27-17 Page 5 of 6 ACTION: It was the consensus of the Council to give staff direction to spend the funds as prioritized by staff and the Highlands Senior Service Center staff. 13. Consideration of Cancellation of the September 14, 2017 Regular Council Meeting City Clerk Swanson gave the staff report. ACTION: It was moved by Councilmember Harris and seconded by Councilmember Overton to approve cancellation of the September 14th meeting. The motion passed with a unanimous voice vote. CITY MANAGER AND COUNCILMEMBER REPORTS FUTURE AGENDA ITEMS ACTION: Vice Mayor Sabatier asked for and received consensus to place a permitting or registration process for people to be onsite working on red-tagged homes on a future agenda.
