MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING OCTOBER 12, 2017 CALL TO ORDER CLOSED SESSION: 5:30 P.M. Roll Call. Present: Bruno Sabatier, Vice Mayor Nick Bennett, Councilmember Phil Harris, Councilmember Absent: Joyce Overton, Councilmember Russell Perdock, Mayor Staff: Greg Folsom, City Manager Ryan Jones, City Attorney Melissa Swanson, City Clerk (1) CONFERENCE WITH LEGAL COUNSEL--ANTICIPATED LITIGATION Significant exposure to litigation pursuant to Government Code Section 54956.9(d)(2) – 1 potential case No reportable action was taken by the Council in Closed Session. CCM 10-12-17 Page 1 of 4 AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS City Manager Folsom requested an emergency item be added to the agenda as Item #1: A Verbal Update on the Sulphur Fire and Ratification of the Proclamation by the Director of Emergency Services Declaring a Local Emergency and Set Next Review of Said Proclamation for the October 26, 2017 Regular Council Meeting; Resolution No. 2017-78. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Harris to add the item as an emergency item on the agenda as the emergency arose after the agenda was published and the need to take action is immediate, and approve the agenda as amended. The motion passed with a unanimous roll call vote. BUSINESS (ITEM 1 ADDED) 1. Verbal Update of the Sulphur Fire and Ratification of the Proclamation by the Director of Emergency Services Declaring a Local Emergency and Set Next Review of Said Proclamation for the October 26, 2017 Regular Council Meeting; Resolution No. 2017-78 City Manager Folsom gave the staff report. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Overton to adopt Resolution No. 2017-78, ratifying the Proclamation by the Director of Emergency Services Declaring a Local Emergency and set next review of said proclamation for the October 26, 2017 regular Council meeting. The motion passed with a unanimous roll call vote. PRESENTATION 2. Presentation of a Proclamation Declaring October 2017 as Domestic Violence Awareness Month 3. Presentation of a Proclamation Declaring October 2017 as Breast Cancer Awareness Month 4. Presentation by City Clerk Swanson of the City’s Halloween Trick or Treat Party Information PUBLIC COMMENT Jeff Smith would like a power pole permit on vacant lots for fire victims and suggested a variance for this. Linda Lee Briggs spoke regarding the possibility of a civil defense siren. Consent Items Recommended Action 5. Warrant Registers Receive and file CCM 10-12-17 Page 2 of 4 6. Consideration of Declaring Surplus Property, Adopt resolution Resolution No. 2017-77 7. Consideration of Second Reading and Hold second reading of Ordinance No. Adoption of 199-2017, , An Ordinance of the City 199-2017 by title only, waive further Council of the City of Clearlake Setting Forth reading, and adopt ordinance Procedures for Expediting Permitting Processing for Electric Vehicle Charging Systems Citizen Mike Vandiver pulled Item #7 for separate discussion and action. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Harris to approve Items #5 and #6 on the Consent Calendar as presented. The motion passed with a unanimous voice vote. Item #7 was discussed by staff and Mr. Vandiver’s questions were answered. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Harris to hold second reading of Ordinance No. 199-2017 by title only, waive further reading, and adopt the ordinance. The motion passed with a unanimous roll call vote. PUBLIC HEARING 8. Public Hearing to Consider Commercial Cannabis Ordinance No. 200-2017 and Ordinance No. 201-2017 Amending the Marijuana Dispensary Ordinance City Manager Folsom gave the staff report. Mayor Perdock opened the Public Hearing at 7:17 p.m. Mike Vandiver suggested six permits instead of twelve. Russ Cremer spoke regarding the lack of median income and upscale housing in the city and spoke against the ordinance. Eric Sclar spoke in favor of the ordinance. Linda Lee Briggs had questions on the ordinance. Liz Byrd spoke in favor of the ordinance. ACTION: It was moved by Councilmember Harris and seconded by Councilmember Overton to close the Public Hearing. The motion passed with a unanimous voice vote. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Overton to hold First Reading of Ordinance No. 200-2017 (commercial cannabis) and read by title only, waive CCM 10-12-17 Page 3 of 4 further reading, and hold the second reading on October 26th, 2017, amending the ordinance to exclude the Provensalia property from the CB overlay zone. The motion passed with a unanimous roll call vote. ACTION: It was moved by Councilmember Harris and seconded by Vice Mayor Sabatier to hold First Reading of Ordinance No. 201-2017 amending the marijuana dispensary regulations, and read by title only, waive further reading, and hold the second reading on October 26th, 2017. The motion passed with a unanimous roll call vote.
