MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY SPECIAL/REGULAR MEETING FEBRUARY 8, 2018 CALL TO ORDER SPECIAL MEETING: 5:00 P.M. Roll Call. Present: Bruno Sabatier, Mayor Phil Harris, Vice Mayor Nick Bennett, Councilmember Joyce Overton, Councilmember Staff: Greg Folsom, City Manager Ryan Jones, City Attorney Chris Becnel, Director of Finance Tim Celli, Interim Police Chief Melissa Swanson, City Clerk Martin Snyder, Police Sergeant 1. Mid-Year Financial Review FYE 2018 Finance Director Becnel gave the staff report. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Harris to approve Resolution No. 2018-06, A Resolution of the City Council of the City of Clearlake Adopting the City of Clearlake Mid-Year Budget Adjustments to the FYE 2018 Budget. The motion passed with a unanimous roll call vote. There being no further business of the Council, the Special Meeting adjourned at 5:55 p.m. CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:03 P.M. Roll Call. Present: Bruno Sabatier, Mayor Phil Harris, Vice Mayor Nick Bennett, Councilmember Joyce Overton, Councilmember Staff: Greg Folsom, City Manager Ryan Jones, City Attorney Russ Hildebrandt, Deputy City Attorney Tim Celli, Interim Chief of Police Melissa Swanson, City Clerk CCM 02-08-18 Page 1 of 4 Chris Becnel, Director of Finance Doug Herren, Director of Public Works Adeline Brown, Engineering Technician INVOCATION/MOMENT OF SILENCE Mayor Sabatier called for a moment of silence. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS There were no changes to the agenda. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Harris to approve the agenda as presented. The motion passed with a unanimous voice vote. PRESENTATION 1. Presentation of a Proclamation Declaring February 2018 as Black History Month PUBLIC COMMENT Sheryl Almon spoke regarding Community Watch. Bill Shields spoke regarding the City buying property at 14141 Lakeshore Drive. Consent Items Recommended Action 2.Warrant Registers Receive and file 3.Consideration of Continuation of Declaration of By motion keep declaration of emergency Local Emergency Issued on October 9, 2017 and active and set next review for March 8, Ratified by Council Action October 12, 2017 2018 ACTION: It was moved by Vice Mayor Harris and seconded by Councilmember Bennett to approve the Consent Calendar as presented. The motion passed with a unanimous voice vote. BUSINESS: 4. Discussion of Possible Improvements to Baseball Fields and Potential Extension of Use Agreement with South Shore Little League Regarding Haverty Field and Redbud Park Ball Fields City Manager Folsom gave the staff report. Helen Mitcham, Secretary/Treasurer of the South Shore Little League, was present to answer questions. CCM 02-08-18 Page 2 of 4 ACTION: It was the consensus of the Council to direct staff to work with the SSLL to bring forward a long-term lease and improvements to the ball fields. PUBLIC HEARING: 5. Public Hearing to Consider Approval of resolution approving the Commitment of CDBG Program Income Funds for Code Enforcement and updated Program Income Reuse Agreement Finance Director Becnel gave the staff report. Mayor Sabatier opened the Public Hearing at 6:54 p.m. Sheryl Almon asked questions on the subject. Rick Mayo asked questions on the subject. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to close the Public Hearing. The motion passed with a unanimous voice vote. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Harris to adopt Resolution No. 2018 – 07, A Resolution of the City Council of the City of Clearlake Approving the Commitment of CDBG Program Income Funds for Code Enforcement and updated Program Income Reuse Agreement. The motion passed with a unanimous roll call vote. 6. Public Hearing to Hold First Reading of Commercial Cannabis Ordinance No. 203-2018 Amending the Existing Commercial Cannabis Ordinance City Manager Folsom gave the staff report. Mayor Sabatier opened the Public Hearing at 7:12 p.m. Jeremy Mayfield spoke in favor of allowing grows on both sides of the highway and additional permits. Henry Bornstein suggested language clarification in the ordinance. Howard Levin spoke in favor of allowing grows on both sides of the highway and additional permits. Chris Jennings spoke regarding allowing more businesses under the ordinance. ACTION: It was moved by Vice Mayor Harris and seconded by Mayor Sabatier to close the Public Hearing at 7:30. The motion passed with a unanimous voice vote. ACTION: It was moved by Vice Mayor Harris and seconded by Councilmember Overton to hold the first reading of Ordinance No. 203-2018, read by title only, waive further reading and set CCM 02-08-18 Page 3 of 4 second reading and adoption for February 22nd, 2018. The motion passed with a unanimous roll call vote. BUSINESS (CONTINUED): 7. Consideration of Award of Contract for Design Services for the Highlands Park Improvement Project City Manager Folsom gave the staff report. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Harris to authorize the City Manager to execute a contract with Melton Design Group for an amount not to exceed $94,420.00. The motion passed with a unanimous voice vote.
