MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING MARCH 22, 2018 CALL TO ORDER CLOSED SESSION: 5:30 P.M. Roll Call. Present: Bruno Sabatier, Mayor Phil Harris, Vice Mayor Nick Bennett, Councilmember Joyce Overton, Councilmember Staff: Greg Folsom, City Manager Ryan Jones, City Attorney (1) CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION pursuant to Government Code §54956.9 – Significant exposure to litigation pursuant to paragraph (2) of subdivision (d) of Section 54956.9: 1 potential case. (2) CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION pursuant to Government Code §54956.9 – Significant exposure to litigation pursuant to paragraph (4) of subdivision (d) of Section 54956.9: 1 potential case. (3) CONFERENCE WITH LEGAL COUNSEL – EXISTING LITIGATION (Government Code 54956.9) – Harris v. City of Clearlake, Case No. 18-15373, United States Court of Appeals for the Ninth Circuit No reportable action was taken by the Council in Closed Session. There being no further business of the Council, Closed Session adjourned at 5:55 p.m. CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:01 P.M. Roll Call. Present: Bruno Sabatier, Mayor Phil Harris, Vice Mayor Nick Bennett, Councilmember Joyce Overton, Councilmember Staff: Greg Folsom, City Manager Ryan Jones, City Attorney Tim Celli, Interim Chief of Police CCM 03-22-18 Page 1 of 4 Jan Brejska, Recording Secretary Alan Flora, Director of Finance Doug Herren, Director of Public Works INVOCATION Pastor Dale Rogers gave the invocation. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS There were no changes to the agenda. ACTION: It was moved by Vice-Mayor Harris and seconded by Councilmember Overton to approve the agenda as presented. The motion passed with a unanimous voice vote. PRESENTATION 1. Presentation of a Proclamation Declaring Vietnam Veteran’s Day 2. Presentation by Pacific Gas & Electric Company 3. Presentation of the Annual Public, Education and Government Channel’s Annual Report 4. Presentation of the Clearlake Waste Solutions 2017 Annual Report 5. Presentation by Adventist Health Clearlake on the 340B Drug Program PUBLIC COMMENT Pete Gascoigne spoke regarding illegal fruit and vegetable stands. Gary Faulkner spoke regarding red tagged properties. Consent Items Recommended Action 1.Warrant Registers Receive and file 2.Minutes of the January 4, January 11, January 25, Receive and file and February 1, 2018 Meetings 3.Consideration of Continuation of Declaration of By motion keep declaration of emergency Local Emergency Issued on October 9, 2017 and active and set next review for April 12, Ratified by Council Action October 12, 2017 2018 4.Consideration of Adoption of the Facilities Adopt resolution Coordinator/Deputy City Clerk Position ACTION: It was moved by Vice Mayor Harris and seconded by Councilmember Bennett to CCM 03-22-18 Page 2 of 4 approve the Consent Calendar as presented. The motion passed with a unanimous voice vote. PUBLIC HEARING: 10. Public Hearing to Consider Adoption of a Development Agreement with Eric Sklar, Clearlake Growth Fund No. 1, for Commercial Cannabis Operations City Manager Folsom gave the staff report. Mayor Sabatier opened the Public Hearing at 7:14pm. Eric Sklar gave a statement in favor of adoption. Chris Jennings stated 5% is too high. Mayor Sabatier closed the Public Hearing at 7:18pm. ACTION: It was moved by Councilmember Bennett and seconded by Councilmember Overton to hold first reading of Ordinance No. 205-2018, read by title only, waiver further reading, and set second reading and adoption for April 12, 2018. The motion passed with a unanimous roll call vote. Mayor Sabatier called for a 5 minute break. BUSINESS: 11. Consideration of Appointment of a New Council Member to Fill the Vacant Term Ending November 2018 City Manager Folsom gave the staff report. James Reed, Sheryl Alman, Dirk Slooten and Russ Cremer were present to answer any questions. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to approve Resolution No. 2018-11 A Resolution of the City Council of the City of Clearlake Appointing a Member to Fill the Office of City Council Member Russell Perdock as a Result of Resignation. Pursuant to Government Code Section 36512 Russell Cremer is hereby appointed as a member of the Clearlake City Council and shall serve for the unexpired term of the former incumbent, Russell Perdock. The motion passed with a unanimous roll call vote.
