MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING FEBRUARY 14, 2019 CALL TO ORDER WORKSHOP: 4:00 P.M. Roll Call. Mid-Year Budget Workshop Assistant City Manager Flora gave the staff report. ACTION: It was the consensus of the Council to amend the 2018-19 Fiscal Year Budget to include changes as recommended by staff which will be brought to the February 28th Council meeting. The workshop adjourned at 5:07 p.m. The Council held a reception for Retired District 2 County of Lake Supervisor Jeff Smith from 5:30 p.m. to 6:00 p.m. CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:00 P.M. ADOPTION OF THE AGENDA City Manager Folsom asked the Council to delete Item #2, Presentation of the Clear Lake Chamber of Commerce’s Annual Report and to move Item #14, Adoption of Urgency Ordinance Amending Chapter 18, Article 18-5.1000 Regarding Residential Housing Standards for Manufactured and Mobile Homes, to the first item. ACTION: It was moved by Councilmember Slooten and seconded by Councilmember Overton to adopt the changes to the agenda. The motion passed with a unanimous voice vote, with Councilmember Harris absent. BUSINESS: 14. Adoption of Urgency Ordinance Amending Chapter 18, Article 18-5.1000 Regarding Residential Housing Standards for Manufactured and Mobile Homes City Attorney Jones gave the staff report. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Slooten to approve Ordinance No. 224-2019: An Urgency Ordinance Amending Chapter 18, Article 18- 5.1000 of the Clearlake Municipal Code regarding residential housing standards for manufactured and mobile homes, read by title only and adopt said ordinance as an urgency ordinance. The motion passed with a unanimous roll call vote, with Councilmember Harris absent. Mayor Bennett left the meeting at 6:10 p.m. due to illness. PRESENTATION 1. Appointment of City Treasurer for the Appoint the City Manager as Acting City Unexpired Term Ending November 2022 Treasurer to Fulfill the Unexpired Term Ending November 2022 10. Adopt Changes to the Strategic Plan Approve changes to the Strategic Plan ACTION: It was moved by Councilmember Slooten and seconded by Councilmember Overton to approve the Consent Calendar as presented. The motion passed with a unanimous voice vote, with Mayor Bennett and Councilmember Harris absent. PUBLIC HEARING: 11. Consideration of Development Agreement with Erin McCarrick and Clearlake Ventures, LLC for a Commercial Cannabis Operation Vice Mayor Cremer opened the Public Hearing at 6:41 p.m. Assistant City Manager Flora gave the staff report. The applicant was present to answer questions. There were no public comments. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Slooten to hold first reading of Ordinance No. 223-2019, read it by title only, waive further reading and set second reading and adoption for February 28, 2019. The motion passed with a unanimous voice vote, with Mayor Bennett and Councilmember Harris absent. 12. Public Hearing and Adoption of Ordinance Amending the Clearlake Municipal Code Related to the Issuance, Handling, Appeals and Penalties of Administrative Citations, Amending the General Penalty for Violations, Adjusting Penalties for Cannabis Related Violations and Providing for the Immediate Imposition of Fines in Specified Circumstances CCM 02-14-19 Page 3 of 5 Vice Mayor Cremer opened the Public Hearing at 6:45 p.m. Chief White gave the staff report. There was no public comment. ACTION: It was moved by Councilmember Slooten and seconded by Councilmember Overton to hold first reading of Ordinance No. 222-2019, read it by title only, waive further reading and set second reading and adoption for February 28, 2019. The motion passed with a unanimous voice vote, with Mayor Bennett and Councilmember Harris absent. 13. Consideration of Resolution No. 2019-08, a Resolution of the City Council of the City of Clearlake Authorizing Submittal of Application to HCD for Community Development Block Grant Program City Manager Folsom gave the staff report. Vice Mayor Cremer opened the Public Hearing at 6:52 p.m. There were no public comments. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Slooten to adopt Resolution No. 2019-08 Authorizing Submittal of Application to HCD for Community Development Block Program. The motion passed with a unanimous voice vote, with Mayor Bennett and Councilmember Harris absent. BUSINESS: 15. Consideration of Increasing the Clearlake Planning Commission Salary; Ordinance No. 225- 2019 ACTION: It was moved by Councilmember Slooten and seconded by Councilmember Overton to hold first reading of Ordinance No. 225-2019, An Ordinance of the City Council of the City of Clearlake Amending Section 2-9.5 to Revise Provisions Relating to Planning Commission Members’ Salary, read it by title only and set second reading and adoption for February 28, 2019. The motion passed with a unanimous voice vote, with Mayor Bennett and Councilmember Harris absent. 16. Award of Contract for Demolition of Structures Lt. Hobbs gave the staff report. ACTION: It was the consensus of the Council to direct staff to review a local preference for bids on a future agenda. CCM 02-14-19 Page 4 of 5 This item was tabled due to Overton’s possible conflict of interest. She owns a home within 1000 feet of one of the properties.
