MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING AUGUST 8, 2019 CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:00 P.M. Roll Call. Present: Russ Cremer, Mayor Dirk Slooten, Vice Mayor Joyce Overton, Councilmember Russ Perdock, Councilmember Phil Harris, Councilmember Staff: Alan Flora, City Manager Crystal Hodgeson, Deputy City Attorney Melissa Swanson, Admin Services Director/City Clerk Andrew White, Police Chief Dave Swartz, Contract City Engineer Lee Lambert, Code Enforcement Supervisor INVOCATION Councilmember Perdock gave the invocation. ADOPTION OF THE AGENDA ACTION: It was moved by Councilmember Overton and seconded by Councilmember Perdock to accept the agenda as presented. The motion passed with a unanimous voice vote. PRESENTATIONS: 1. Presentation by Clearlake Code Enforcement Department PUBLIC COMMENT: Phillip Wilson spoke regarding Valenzuela’s Tire business storing used tires against their building. Second Reading and Adoption of Ordinance Hold second reading and adopt Ordinance No. 231-2019 Amending the Clearlake No. 231-2019 Municipal Code Regarding Reserve Police Officers 6. Acceptance of Annual Audit Report for FYE Receive and file 2018; including the Report to Those Charged with Governance and the Appropriations Limit Report 7. Consideration of Continuation of Declaration By motion keep declaration of emergency of Local Emergency Issued on October 9, 2017 active and set next review for the next and Ratified by Council Action October 12, Council meeting 2017 Vice Mayor Slooten pulled Item #4 for discussion and separate action. ACTION: It was moved by Vice Mayor Slooten and seconded by Councilmember Perdock to accept the remaining items of the Consent Calendar, with the exception of Item #4, as presented. The motion passed with a unanimous voice vote. Vice Mayor Slooten highlighted the Soap Box Derby event as a positive event for the community. ACTION: It was moved by Vice Mayor Slooten and seconded by Councilmember Perdock to accept Item #4 as presented. The motion passed with a unanimous voice vote. BUSINESS: 8. Consideration of Contract with H D Excavating, in the Amount of $45,000.00, for the Abatement of Real Properties Located at 16216 34th Avenue, 14170 Konocti Street, 16052 19th Avenue and 3191 6th Street Code Enforcement Supervisor Lambert gave the staff report. ACTION: It was moved by Vice Mayor Slooten and seconded by Councilmember Perdock to authorize the City Manager to execute a contract with H D Excavating for the abatement of real properties located at 16216 34th Avenue, 14170 Konocti Street, 16052 19th Avenue and 3191 6th Street, for a not to exceed amount of $45,000.00, as part of the City’s CalRecycle Illegal Disposal Site Abatement Grant. The motion passed with a unanimous voice vote. 9. Discussion and Direction Regarding Proposed Animal Shelter Chief White gave the staff report. ACTION: It was the consensus of the Council to approve moving forward with the proposed animal shelter and funding plan. 10. Consideration of Extending a Moratorium on the Establishment of Tobacco Retailing Businesses, Smoke Shops, or Hookah or Vapor Lounges within the City of Clearlake Administrative Services Director/City Clerk Swanson gave the staff report. CCM 08-08-19 Page 2 of 3 ACTION: It was moved by Councilmember Harris and seconded by Councilmember Perdock to adopt Extension of Moratorium – Ordinance No. 232-2019, read it by title only, waive further reading and adopt the Ordinance. The motion passed with a unanimous roll call vote. CITY MANAGER AND COUNCILMEMBER REPORTS FUTURE AGENDA ITEMS CLOSED SESSION: Closed session was cancelled. (1) CONFERENCE WITH LABOR NEGOTIATORS: Pursuant to Government Code Section 54957.6: Agency Designated Representative: City Manager Alan Flora; Employee Organizations: Clearlake Management/Confidential Employees, Clearlake Police Officer Association, Clearlake Municipal Employees Association and Clearlake Middle Management Association. (2) CONFERENCE WITH LEGAL COUNSEL – EXISTING LITIGATION: (Government Code 54956.9) – City of Clearlake v.
