MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING AUGUST 20, 2020 The virtual meeting was held via Zoom in accordance with Governor Newsom’s Executive Order N- 25-20 and Executive Order N-29-20. CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:00 P.M. Roll Call. Present: Russ Cremer, Mayor Dirk Slooten, Vice Mayor Phil Harris, Councilmember Joyce Overton, Councilmember Russ Perdock, Councilmember Staff: Alan Flora, City Manager Andrew White, Police Chief Ryan Jones, City Attorney Melissa Swanson, Administrative Services Director/City Clerk Tina Viramontes, Deputy City Clerk Tim Hobbs, Police Lieutenant INVOCATION Bob Meyer gave the invocation. ADOPTION OF THE AGENDA ACTION: It was moved by Councilmember Harris and seconded by Councilmember Overton to adopt the agenda. The motion passed with a unanimous roll call vote. PRESENTATION Chief White was presented with his POST Executive Certificate. 1. Presentation of August’s Adoptable Dogs 2. Disposal of Surplus Vehicles, Resolution No. Adopt resolution 2020-34 6. Authorization to purchase two (2) trailer Waive the competitive formal bidding mounted mobile traffic signals, with motion process pursuant to Clearlake Municipal sensors and controllers, to replace flaggers in Code Section 3-4.5 and authorize the right-of-way work zones purchase of a Mobile Traffic Signal System 7. Adopting the 1st Amendment to the FY 2020- Adopt resolution 21 Budget (Resolution No. 2020-27) Appropriating Funding for Public Safety Communications Equipment, Resolution No. 2020-35 8. Adoption of a Resolution Approving an Adopt resolution Allocation of Funding and the Execution of a Grant Agreement and any Amendments thereto from the CDBG-DR Program for $1,157,983 for the Multi-Family Housing Program, Resolution No. 2020-36 Councilmember Overton asked for Item #8 to be removed from the Consent agenda to be discussed separately. ACTION: It was moved by Councilmember Perdock and seconded by Councilmember Harris to accept the Consent Calendar Items #1 through #7 as presented. The motion passed with a unanimous roll call vote. City Manager Flora gave the staff report for Item #8. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Slooten to adopt Resolution No. 2020-36. The motion passed with a unanimous roll call vote. BUSINESS: 9. Consideration of Designation of Voting Delegates and Alternate(s) For the League of California Cities Annual Conference in October Administrative Services Director/City Clerk Swanson gave the staff report. ACTION: It was moved by Councilmember Perdock and seconded by Councilmember Harris to designate Councilmember Overton as voting delegate, and Mayor Cremer and Vice Mayor Slooten as alternates. The motion passed with a unanimous roll call vote. 10. First Reading of Ordinance Amending the Clearlake Municipal Code Relating to Universal Collection and Authorizing Administrative Citations to Collect Unpaid Debt CCMin 08-20-20 Page 2 of 3 Chief White gave the staff report. ACTION: It was moved by Councilmember Harris and seconded by Councilmember Overton to hold a first reading of Ordinance No. 244-2020: AN ORDINANCE AMENDING SECTION 11-4 OF CHAPTER 11 OF THE CLEARLAKE MUNICIPAL CODE RELATING TO UNIVERSAL COLLECTION, read by title only and set second reading for the September 3, 2020 meeting. The motion passed with a unanimous roll call vote. 11. First Reading of Ordinance No. 245-2020 An Ordinance Amending Clearlake Municipal Code Chapter 2, Section 2-1.2 Increasing the Salary of City Council Members City Attorney Jones gave the staff report. ACTION: It was moved by Councilmember Harris and seconded by Councilmember Perdock to hold a first reading of Ordinance No. 245-2020: An Ordinance Amending Clearlake Municipal Code Chapter 2, Section 2-1.2 Increasing the Salary of City Council Members, read by title only and set second reading for the September 3, 2020 meeting. The motion passed with a roll call vote of 4-1, with Vice Mayor Slooten against. 12. Discussion and Possible Direction Regarding Commercial Cannabis Permits City Manager Flora gave the staff report. ACTION: It was the consensus of the Council to direct staff to bring forward an ordinance modifying the current commercial cannabis regulations to eliminate the limitation of the number of cannabis business licenses at a future agenda. CITY MANAGER AND COUNCILMEMBER REPORTS FUTURE AGENDA ITEMS CLOSED SESSION (1) CONFERENCE WITH LEGAL COUNSEL – PENDING LITIGATION: Initiation of Litigation pursuant to Government Code Section 54956.9: Two potential cases City Attorney Jones announced there was no action during closed session.
