MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY SPECIAL MEETING SEPTEMBER 6, 2018 CALL TO ORDER SPECIAL CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY MEETING: 5:01 P.M. Roll Call. Council Present: Bruno Sabatier, Mayor Phil Harris, Vice Mayor Nick Bennett, Councilmember Russ Cremer, Councilmember Joyce Overton, Councilmember Staff: Greg Folsom, City Manager Alan Flora, Assistant City Manager Andrew White, Chief of Police Ryan Jones, City Attorney Tina Viramontes, Deputy City Clerk Steve Felder, Code Enforcement Officer Lee Lambert, Code Enforcement Supervisor Alan Pyeatt, Contract City Engineer Consent Items Recommended Action 1. Consideration of Continuation of Declaration of By motion keep declaration of emergency Local Emergency Issued on October 9, 2017 and active and set next review for September Ratified by Council Action October 12, 2017 27, 2018 ACTION: It was moved by Councilmember Overton and seconded by Councilmember Bennett to accept the Consent Calendar as presented. The motion passed with a unanimous voice vote. BUSINESS: 2. Consideration of Approval of Amendment #2 to the Agreement between the City of Clearlake and the Southshore Little League for the Use of Haverty Field and Redbud Park Baseball Fields City Manager Folsom gave the staff report. Helen Mitcham with the Southshore Little League spoke on behalf of the organization. ACTION: It was moved by Vice Mayor Harris and seconded by Councilmember Cremer to approve Amendment #2 to the Agreement between the City of Clearlake and the Southshore Little League for the Use of Haverty Field and Redbud Park Baseball Fields. The motion passed with a unanimous roll call vote. CCM 09-06-18 SPL Page 1 of 2 3. Consideration of Confirmation of Assessments in the Total Amount of $37,500 for Administrative Penalties for Failure to Abate Public Nuisance in Accordance with C.M.C. Sections 1- 5, 1-9, 10-1.6, 10-1.7, 10-1.9, 10-1.12, 10-2.2(b), 10-2.4, 10-2.5, 10-2.6, 10-2.7, 10-2.8, 10-3.1, 10- 3.3, 10-5 and 10-5.6 Code Enforcement Supervisor Lambert gave the staff report. He asked to exclude property #2, 3034 5th Street due to compliance being met by the property owner. Mayor Sabatier opened the Public Hearing at 5:50 p.m. Robert Hipcuss, neighbor of property #1, 12900 Plumas Street, spoke in favor of the assessment. Amber Temple, daughter of the owner of property #8, 15908 35th Avenue, asked for an extension before the assessment. Chuck Leonard encouraged the Council to increase penalties, not decrease them. The tenant (no name given) of property #11, 15708 24th Avenue, spoke against the assessment and stated he is working on clearing the violations. Mayor Sabatier closed the Public Hearing after the comments. ACTION: It was moved by Vice Mayor Harris and seconded by Councilmember Overton to adopt Resolution No. 2018-32 Confirming Special Assessments and Approving Lien Against Real Properties, excluding property #2, 3034 5th Street. The motion passed with a unanimous roll call vote. 4. Consideration of Award of Aggregate Crushing Services Contract Contract City Engineer Pyeatt gave the staff report. ACTION: It was moved by Vice Mayor Harris and seconded by Councilmember Bennett to authorize City Manager to enter into contract with Piazza Construction for Aggregate Crushing Services in the amount of $98,765 and authorize the City Manager to approve up to 10% for additional unforeseen contract amendments. The motion passed with a unanimous voice vote. 5. Consideration of Letter of Support for Lake Transit Authority Transit Hub Project City Manager Folsom gave the staff report. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Cremer to authorize Mayor to sign letter of support. The motion passed with a unanimous voice vote.
