MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY SPECIAL MEETING SEPTEMBER 19, 2018 CALL TO ORDER SPECIAL CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY MEETING: 5:03 P.M. Roll Call. Council Present: Bruno Sabatier, Mayor Phil Harris, Vice Mayor Nick Bennett, Councilmember Russ Cremer, Councilmember Absent: Joyce Overton, Councilmember Staff: Greg Folsom, City Manager Alan Flora, Assistant City Manager Andrew White, Chief of Police Ryan Jones, City Attorney Melissa Swanson, City Clerk Steve Felder, Code Enforcement Officer Lee Lambert, Code Enforcement Supervisor BUSINESS: 5. Consideration of Councilmember Appointment to Hazard Mitigation Planning Committee City Manager Folsom asked Council to hear Item #5 first on the agenda then recess to 6:00 p.m. for the Public Hearing, which had been publicly noticed for 6:00 p.m. City Manager Folsom gave the staff report. Mayor Sabatier stated he would like to appoint Councilmember Bennett. ACTION: It was moved by Vice Mayor Harris and seconded by Councilmember Cremer to approve Councilmember Bennett’s appointment to the Hazard Mitigation Planning Committee. The motion passed with a unanimous roll call vote, with Councilmember Overton absent. 1. Consideration of Abatement Order Appeal Hearing Referencing Real Property Located at 3215 12th Street Clearlake, CA 95422 in Accordance with C.M.C. section(s) 18-9.110, 18-9.120, 18-9.130 and 18-10 in Its Entirety Code Enforcement Supervisor Lambert gave the staff report. Mayor Sabatier opened the Public Hearing at 6:03 p.m. CCM 09-19-18 SPL Page 1 of 3 Appellant Ennis Lark spoke in favor of granting the appeal. A unnamed individual, representing the owner, Quigg and Company, Inc., spoke in favor of granting the appeal. ACTION: It was moved by Vice Mayor Harris and seconded by Councilmember Cremer to approve Resolution No 2018-33, denying the appeal and to read it by title only. The motion passed with a unanimous roll call vote, with Councilmember Overton absent. 2. Consideration of Abatement Order Appeal Hearing Referencing Real Property Located at 15582 21st Avenue Clearlake, CA 95422 in Accordance with C.M.C. section(s) 18-9.110, 18-9.120, 18-9.130 and 18-10 in Its Entirety Code Enforcement Officer Felder gave the staff report. Appellant Jimmy Hathcock spoke in favor of granting the appeal. ACTION: It was moved by Councilmember Bennett and seconded by Vice Mayor Harris to approve Resolution No 2018-34, denying the appeal and to read it by title only. The motion passed with a unanimous roll call vote, with Councilmember Overton absent. 3. Consideration of Administrative Citation Appeal Hearing Referencing Real Property Located at 15800 20th Avenue Clearlake, CA 95422 in Accordance with C.M.C. section(s) 10-1.9 and 18-11 in Their Entirety Code Enforcement Officer Felder gave the staff report. Appellant Isabel Rivera spoke in favor of granting the appeal. ACTION: It was moved by Councilmember Cremer and seconded by Vice Harris to approve Resolution No 2018-35, denying the appeal and to read it by title only. The motion passed with a unanimous roll call vote, with Councilmember Overton absent. 4. Consideration of Administrative Citation Appeal Hearing Referencing Real Property Located at 3351 10th Street Clearlake, CA 95422 in Accordance with C.M.C. section(s) 10-1.9 and 18-11 in Their Entirety Code Enforcement Supervisor Lambert gave the staff report. There was no one present to speak on this item. ACTION: It was moved by Vice Mayor Harris and seconded by Councilmember Bennett to approve Resolution No 2018-36, denying the appeal and to read it by title only. The motion passed with a unanimous roll call vote, with Councilmember Overton absent. CCM 09-19-18 SPL Page 2 of 3 ACTION: Vice Mayor Harris asked for and received a consensus of the Council to direct staff to review administrative citation fees and bring a report to the Council for consideration of increasing the fees.
