COMMON COUNCIL PROCEEDINGS Tuesday, March 27, 2018 - 7:00 P.M. Regular Meeting Common Council Chambers Mayor Morse led in the Pledge of Allegiance at 7:00 PM Roll call was taken PRESENT: ABSENT: Mayor Morse NONE Council President Briggs Council Member Smith Council Member Russell Council Member McCarthy Council Member Napier Council Member Koniowka At 7:00 PM a Public Hearing was conducted update to Zoning Code: PUBLIC NOTICE IS HEREBY GIVEN that the Common Council will hold a public hearing on Tuesday, March 27, 2018 at 7:00 p.m. in the Common Council Chambers of City Hall for a local law to update the zoning code. At 7:01, with no public comment being made, the public hearing adjourned. Council Member Russell made a MOTION to approve the minutes of February 27, 2018 meeting, February 27, 2018 Re-Organization meeting, and March 13, 2018 Special meeting. Council Member Napier seconded the motion. All members voted “AYE”. The motion passed. Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Ordinance No. 2 for the year 2018 AN ORDINANCE ACCEPTING A PERMANENT EASEMENT THROUGH, UNDER, AND ALONG 20 EDWARD STREET Council Member Russell made a MOTION to approve Ordinance No. 2 seconded by Council President Briggs. All members voted “AYE”. Ordinance No. 2 for 2018 passed. Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 16 for the year 2018 A RESOLUTION GRANTING THE STATE OF NEW YORK AUTHORITY TO PERFORM THE INSTALLATION OF LIGHTING FACILITIES AND AGREEMENT TO MAINTAIN LIGHTING FACILITIES INSTALLED VIA STATE-LET CONTRACT Council Member Russell made a MOTION to approve Resolution No. 16 seconded by Council President Briggs. All members voted “AYE”. Resolution No. 16 for 2018 passed. Common Council Regular Meeting 03/27/2018 Page 2 of 4 Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 17 for the year 2018 A RESOLUTION BY THE CITY OF COHOES GRANTING AUTHORITY TO THE STATE OF NEW YORK TO CONSTRUCT GATEWAY LANDSCAPING ON COHOES BOULEVARD (NY ROUTE 787) PROJECT, AND AGREEING TO SUBSEQUENTLY OWN, MAINTAIN, AND REPAIR NEW GATEWAY LANDSCAPING FEATURES Council Member Russell made a MOTION to approve Resolution No. 17 seconded by Council Member Smith. All members voted “AYE”. Resolution No. 17 for 2018 passed. Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 18 for the year 2018 A RESOLUTION GRANTING THE STATE OF NEW YORK AUTHORITY TO PERFORM THE ADJUSTMENT FOR THE OWNER AND AGREEING TO MAINTAIN FACILITIES ADJUSTED VIA STATE-LET CONTRACT Council Member Russell made a MOTION to approve Resolution No. 18 seconded by Council Member Smith. All members voted “AYE”. Resolution No. 18 for 2018 passed. Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 19 for the year 2018 A RESOLUTION GRANTING THE STATE OF NEW YORK AUTHORITY TO PERFORM THE ADJUSTMENT FOR THE OWNER AND AGREEING TO MAINTAIN FACILITIES ADJUSTED VIA STATE-LET CONTRACT Council Member Russell made a MOTION to approve Resolution No. 19 seconded by Council Member Napier. All members voted “AYE”. Resolution No. 19 for 2018 passed. REGARDING THE COLUMBIA STREET PHASE 2 SEWER SEPARATION PROJECT Council Member Napier made a MOTION to approve Resolution No. 20 seconded by Council Member McCarthy. All members voted “AYE”. Resolution No. 20 for 2018 passed. Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 21 for the year 2018 A RESOLUTION ACCEPTING A GRANT AND AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT FOR FUNDING FROM NYSERDA Common Council Regular Meeting 03/27/2018 Page 3 of 4 Council Member Russell made a MOTION to approve Resolution No. 21 seconded by Council Member Smith. All members voted “AYE”. Resolution No. 21 for 2018 passed. Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 22 for the year 2018 A RESOLUTION APPROVING THE SALE OF STREET SIGNS Council Member McCarthy made a MOTION to approve Resolution No. 22 seconded by Council Member Russell. All members voted “AYE”. Resolution No. 22 for 2018 passed. Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 23 for the year 2018 A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A GRANT AGREEMENT UNDER THE NYS ENVIRONMENTAL FACILITIES CORPORATION PROGRAM FOR THE PLANNING OF THE COLUMBIA STREET PHASE II SEWER SEPARATION PROJECT Council Member McCarthy made a MOTION to approve Resolution No. 23 seconded by Council Member Napier. All members voted “AYE”. Resolution No. 23 for 2018 passed. Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 24 for the year 2018 A RESOLUTION APPROVING AN AGREEMENT WITH CHAZEN COMPANIES REGARDING REMSEN STREET PHASE II DESIGN AND CONSTRUCTION Council President Briggs made a MOTION to approve Resolution No. 24 seconded by Council Member Russell. All members voted “AYE”. Resolution No. 24 for 2018 passed. Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 25 for the year 2018 A RESOLUTION APPROVING AN AGREEMENT WITH CHAZEN COMPANIES REGARDING CANAL SQUARE PARK DESIGN AND CONSTRUCTION Council Member Russell made a MOTION to approve Resolution No. 25 seconded by Council Member Napier. All members voted “AYE”. Resolution No. 25 for 2018 passed. Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 26 for the year 2018 A RESOLUTION APPROVING A CONTRACT TO PURCHASE REAL PROPERTY AT 84 REMSEN STREET, COHOES, NY (TAX MAP NO. 10.59-1-20) FROM THE COHOES INDUSTRIAL DEVELOPMENT AGENCY Common Council Regular Meeting 03/27/2018 Page 4 of 4 Council Member Russell made a MOTION to approve Resolution No. 26 seconded by Council Member Smith. All members voted “AYE”. Resolution No. 26 for 2018 passed. Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 27 for the year 2018 A RESOLUTION REQUIRING CONTRACTORS AND SUB-CONTRACTORS ON CERTAIN CONSTRUCTION CONTRACTS TO HAVE APPROVED APPRENTICESHIP AGREEMENTS Council Member Napier made a MOTION to approve Resolution No. 27 seconded by Council Member McCarthy. All members voted “AYE”. Resolution No. 27 for 2018 passed. Public Comment: Tim Thibideau, Massachusetts Ave., “Last time I brought up issues about the Ethics Board. The Council is the selection committee. I have put together a list of things that have happened whether intentionally or unintentionally that should be addressed. I also would like to publically challenge Mr. Kremer to a debate on FOIL law. I am not going to spend the $300.00 to get to get an advisory opinion.” Ed Conlin, Beacon Ave., “My wife and I have been here since 2003; Cohoes has come a long way in not tolerating bigotry and nastiness. The Music Hall has done a good job. People know what they are coming to see. If they don’t like the subject matter, then don’t buy a ticket. I see a lot of disrespect.” Tim Peltier, McDonald Dr., “I have a concern with the water tank.” Mayor Morse, “We just put a bid out to replace them.” At 7:35 PM, Council Member Russell made a MOTION to adjourn.
