COMMON COUNCIL PROCEEDINGS Tuesday, June 26, 2018 - 7:00 P.M. Regular Meeting Common Council Chambers Mayor Morse led in the Pledge of Allegiance at 7:00 PM Roll call was taken PRESENT: ABSENT: Mayor Morse None Council President Briggs Council Member Smith Council Member Russell Council Member McCarthy Council Member Napier Council Member Koniowka Public Comment: None Council Member Russell made a MOTION to approve the minutes of the May 22, 2018 meeting. Council Member Napier seconded the motion. All members voted “AYE”. The motion passed. Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Ordinance No. 4 for the year 2018 A BOND ORDINANCE, DATED JUNE 26, 2018, OF THE COMMON COUNCIL OF THE CITY OF COHOES, ALBANY COUNTY, NEW YORK (THE “CITY”), AUTHORIZING THE UNDERTAKING OF VARIOUS CAPITAL IMPROVEMENT PROJECTS TO VARIOUS CITY FACILITIES, AT AN ESTIMATED MAXIMUM COST OF $1,900,000, AND AUTHORIZING THE ISSUANCE OF SERIAL BONDS IN AN AGRREGATE PRINCIPAL AMOUNT NOT TO EXCEED $1,900,000 OF THE CITY, PURSUANT TO THE LOCAL FINANCE LAW TO FINANCE SAID PURPOSE, SAID AMOUNT TO BE OFFSET BY ANY FEDERAL, STATE, COUNTY AND/OR LOCAL FUNDS RECEIVED, AND DELEGATING THE POWER TO ISSUE BOND ANTICIPATION NOTES IN ACTICIPATION OF THE SALE OF SUCH BONDS TO THE CITY COMPTROLLER Council Member McCarthy, “Does taking out this bond have any bearing on our bond rate?” Michael Durocher, City Comptroller, “No, this will actually lower our debt ratio; this will not have any effect on our bond rating.” Council Member McCarthy, “We do have a healthy reserve fund, should we take out a bond when we have a reserve fund?” Michael Durocher, “Yes, the reserve fund is for daily operations and expenses.” Council Member Napier, “I know we have the water tower project coming up, there will be no additional costs?” Common Council Regular Meeting 06/26/2018 Page 2 of 3 Mayor Morse, “That has already been taken care of.” Council President Briggs, “Our current rating is AA Minus by Standard and Poor’s, which is extremely strong for a municipality.” Council Member Russell made a MOTION to approve Ordinance No. 4 for the year 2018, seconded by Council President Briggs. Council President Briggs, and Council Members Smith, Russell, McCarthy, and Napier voted “AYE”. Council Member Koniowka voted “NAY”. Ordinance No. 4 for the year 2018 did not pass. Mayor Morse, “In anticipation of this occurrence, a Special Common Council Meeting has already been scheduled and posted for June 27, 2018 at 8:15 AM.” Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 44 for the year 2018 A RESOLUTION ADOPTING A M/WBE PARTICIPATION/EQUAL EMPLOYMENT OPPORTUNITY POLICY STATEMENT WITH RESPECT TO A PROJECT ON 95 REMSEN STREET Council Member Russell made a MOTION to approve Resolution No. 44, seconded by Council Member Napier. All members voted “AYE”. Resolution No. 44 for 2018 passed. Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 45 for the year 2018 A RESOLUTION ADOPTING THE SOLID WASTE MANAGEMENT PLAN OF THE TOWN OF COLONIE PLANNING UNIT Council Member McCarthy made a MOTION to approve Resolution No. 45 seconded by Council President Briggs. Council President Briggs, and Council Members Smith, Russell, and McCarthy voted “AYE”. Council Members Napier and Koniowka voted “NAY”. Resolution No. 45 for 2018 passed. Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 46 for the year 2018 A RESOLUTION AUTHORIZING THE EXECUTION OF A LEASE AGREEMENT REGARDING OFFICE SPACE LOCATED AT THE COHOES PUBLIC LIBRARY Council Member Russell made a MOTION to approve Resolution No. 46 seconded by Council President Briggs. All members voted “AYE”. Resolution No. 46 for 2018 passed. Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 47 for the year 2018 A RESOLUTION APPROVING A PROPOSAL REGARDING THE PAVILION AT CANAL SQUARE PARK Common Council Regular Meeting 06/26/2018 Page 3 of 3 Council Member Russell made a MOTION to approve Resolution No. 47 seconded by Council President Briggs. All members voted “AYE”. Resolution No. 47 for 2018 passed Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka presented Resolution No. 48 for the year 2018 A RESOLUTION AMENDING THE ANNUAL BUDGET FOR FISCAL YEAR 2018 Council Member Russell made a MOTION to approve Resolution No. 48 seconded by Council President Briggs. All members voted “AYE”. Resolution No. 48 for 2018 passed. Budget transfers are attached.
