MINUTES OF THE COHOES PLANNING COMMISSION MEETING HELD ON DECEMBER 3 , 2007 AT 6:30 P.M. IN THE COMMON COUNCIL CHAMBERS OF CITY HALL MEMBERS PRESENT: Chairman Joseph Moloughney Vice-Chairman Clarence Badgley Ms. Sharon Gariepy Mr. Mark DeFruscio MEMBERS ABSENT: Mr. Edward Carboni ALSO PRESENT: Ms. Melissa Ashline-Heil, Planner Ms. Carol Shufelt, Recording Secretary CONSIDERATION OF THE MINUTES OF THE NOVEMBER 5, 2007 MEETING Chairman Moloughney called the meeting to order at 6:30 p.m. Chairman asked the recording secretary to take attendance call. Chairman Moloughney stated the minutes from the November 5, 2007 minutes were previously distributed. Member Gariepy made a motion to approve the minutes of the November 5, 2007 meeting Member DeFruscio seconded the motion, roll of call was taken and the motion passed unanimously. YES NO Sharon Gariepy X Joseph Moloughney X Clarence Badgley X Mark DeFruscio X CONSIDERATION TO APPROVE A MINOR SUBDIVISION PLAN FOR 10 & 12 ELAINE COURT, SUBMITTED BY DAVID BENTLEY David Bentley of 10 & 12 Elaine Court stated that we are moving the lot line so his son can build a house there. Member DeFruscio made a motion to approve Resolution # 43 to approve a minor subdivision for 10 & 12 Elaine Court Member Badgley seconded the motion, roll of call was taken and motion passed unanimously. YES NO Sharon Gariepy X Joseph Moloughney X Clarence Badgley X Mark DeFruscio X CONSIDERATION TO FORWARD ZONING AMENDMENT TO THE ALBANY COUNTY PLANNING BOARD, SUBMITTED BY THE EDDY City Planner explained that when the zoning codes were revised in 2006 they took out nursing homes which was permitted as special use and they replaced it with congregate housing limits it to elderly people and we are trying to broaden the definition we need to expand the SEQR. We cannot approve SEQR until the storm water issues are cleared up. Member DeFruscio made a motion to approve Resolution # 44A to forward a zoning amendment to the Albany County Planning Board Member Badgley seconded the motion, roll of call was taken and motion passed unanimously. YES NO Sharon Gariepy X Joseph Moloughney X Clarence Badgley X Mark DeFruscio X CONSIDERATION OF PRELIMINARY SUBDIVSION AND SITE PLAN REVIEW FOR LION HEART SUBDIVIS ION OFF OF WILLIAMS STREET, SUBMITTED BY RALPH DRAKE Tom Andress engineer for applicant gave an overview of the project. Member Badgley made a motion to approve Resolution # 50 to approve a preliminary site and subdivision plan for the Williams Street project with the addition in the resolution stating that engineering comments to the City will be addressed satisfactorily Member Gariepy seconded the motion, roll of call was taken and motion passed unanimously. YES NO Sharon Gariepy X Joseph Moloughney X Clarence Badgley X Mark DeFruscio X CONSIDERATION OF AMENDING A SUBDIVISION PLAN FOR CAPTAIN ’S LOOKOUT PREVIOUSLY APPROVED BY E RESOLUTION #9 FOR 2006 OF THE COHOES PLANNING COMMISSION, SUBMITTED BY VICT OR GUSH Peter Lynch attorney for the applicant and Mark Jacobsen, engineer gave a brief overview for the project. The property will be subdivided into five subdivision the clubhouse will be included with building 2. They are looking for the Planning Board to amend the Negative Declaration, adopt the project redesign with recommendation to the Common Council to allow the amended Planned Development District (PDD), and to approve the five lot subdivision. Member DeFruscio made a motion to approve Resolution # 47 to amend a subdivision plan for Captain’s Lookout, previously approved by Resolution #09 for 2006 of the Cohoes Planning Commission Member Badgley seconded the motion, roll of call was taken and motion passed unanimously. YES NO Sharon Gariepy X Joseph Moloughney X Clarence Badgley X Mark DeFruscio X  CONSIDERATION OF TOM MCGRATH OF SIPPERL Y AND ASSOCIATES AS PLANNING BOARD ENGINEER Member Gariepy made a motion to approve Resolution # 49 to approve Tom McGrath as planning board engineer with the stipulation anything presented to the planning board from Sipperly and Associates will be reviewed by another engineer Member DeFruscio seconded the motion, roll of call was taken and motion passed unanimously.
