COLBY COMMON COUNCIL April 2, 2024 Page 1 The regular meeting of the Colby Common Council was called to order at 6:30 P.M. by Mayor James Schmidt. On roll call: O’Brien, T Schmidt, Baumgartner, Hesgard, Hederer and Lindeman. Also present were Mayor James Schmidt, Clerk Connie Gurtner and DPW Higley. Agenda was posted by the clerk. The agenda will stand as the order of the meeting. Minutes of the March 5th meeting minutes were pre-read and reviewed. Motion was made by Hesgard, seconded by Hederer to approve the minutes as presented. Motion carried with a voice vote. Financial Statement and Bills were discussed. Motion was made T Schmidt, seconded by Lindeman to approve the financial statement and bills. The amounts approved are as follows: General Fund $404,394.87; Capital Fund $58,218.00; Water Department $39,927.56; Sewer Department $34,527.27; TIF $ 36,269.50; Net payroll $24,000.98. Motion carried with a voice vote. Comments from the Public: Liz Baumgartner spoke for Kevin Hanson asking the city if we were okay for Just Another Music Monday in the city parks. Colby/Abbotsford Police Commission met on March 11th. The commission approved minutes and expenditures. Chief's Report: Bowman reported on the investigation of the recent burglary at Napa Auto Parts in Abbotsford. He said two suspects have been charged and one arrest has been made. A search warrant was obtained for a house in Unity, where stolen property was discovered. Bowman said the K-9 training process was lining up well. He said K-9 Officer Eric English had been doing some training with Clark County Sheriff's Department (CCSD) K-9 Officer Michael English. There are a total of five K-9 officers enrolled in the training program. The CAPD canine (named Hemi) has been selected. Bowman said all CAPD officers will receive RUSH training on how to properly utilize a K-9 during the course of duty. He said the CCSD would provide K-9 coverage as needed while CAPD K-9 Officer English and Hemi are in training. Bowman said all CAPD officers are doing well. He said he is comfortable with the plan moving forward. He said the activity report numbers look good. There were 802 total CAPD activities reported for the month of February 2024. There have been 1,578 total activities reported for the first two months of 2024, compared to 1,377 total activities reported for the first two months of 2023. Meeting Date for April, 2024: The next CAPC meeting will be held at 6:30 p.m. on Monday, April 8, 2024 at the Colby-Abbotsford Police Department. Mayor Schmidt: Mayor Schmidt reported on his meeting of the United Communities of Clark County Meeting. Mayor Schmidt also reported on the Cemetery Annual Meeting. Clerk Gurtner: Clerk Gurtner reported that she will possibly be attending the Wisconsin Municipal Treasurer’s conference at the end of the month. DPW Higley: Charter Communications, 606 N Division St, data wiring; Linda Buchholz, 510 N 4th St, six foot privacy fence; James Schmidt, 201 S 6th St, bathroom remodel; Jeff Vanderhoof, 206 N 2nd St, replace roof. DPW Higley reported on the precipitation and flows for March 2024 at the STP. He also reported on the pumpage of water for March 2024. The new work truck delivered. Marking for the new GIS Mapping has started. Liquor License: The city received an application for a Class “B” Beer License – Socios Tacos LLC, Agent: Estela Herrera, 100 W Clark St. Motion was made by T Schmidt, seconded by Hesgard to approve. Motion carried with a voice vote. Picnic License, Abby Colby Crossings Chamber, Colby Cheese Days: The city received two picnic licenses application from Abby Colby Crossings Chamber for Colby Cheese Days beer tent, N 1st Street Park and S 1st Street Park for July 18, 2024 to July 22, 2024. Motion was made by Lindeman, seconded by Hederer to approve the licenses. Motion carried with a voice vote. Resolution 7-2023 Vacating Herman, Hazel, Part of Lieders & Jackson Streets: The city received a request from Mike Rahm to vacate streets in the Replat of Rahm Estates. Notice has been published in the newspaper and served to the adjacent property owners. Motion was made by O’Brien, seconded by Hederer to approve Resolution 7-2023 as presented. Motion was made by O’Brien, seconded by Hederer to amend Resolution 7-2023 to exclude 122’ of Jackson Street from Resolution 7-2023. Motion carried on a voice vote. Motion was made by Hederer, seconded by Hesgard to approve Resolution 7-2023 as amended. Motion carried with a voice vote. Resolution 7-2023 A Resolution pursuant to Section 66.1003 (4) Wis. Stats., to vacate and discontinue all of Herman Street and Hazel Drive, and the North 144.95 feet of Lieders Street and the South 122 feet of Jackson Street, all of which streets and portions thereof are located in the Replatt of Rahm Estates as located in the COLBY COMMON COUNCIL April 2, 2024 Page 3 North half (N1/2) of the Northwest Fractional Quarter (NW fr'l 1/4) of Section 18, Township 28 North, Range 2 East, in the City of Colby, Marathon County, Wisconsin. WHEREAS, it is deemed that the public interest requires the vacating and discontinuance of the above described public ways in the City of Colby, Marathon County, Wisconsin; AND WHEREAS, the City Council has determined that said public streets should be vacated pursuant to Section 66.1003(4) Wis. Stats.; NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Colby, Wisconsin, as follows: SECTION 1. That since the public interest requires it, the following described and streets and portions of streets are hereby vacated and discontinued: All of Herman Street and Hazel Drive, and the North 144.95 feet of Lieders Street and the South 122 feet of Jackson Street, all of which streets and portions thereof are located in the Replatt of Rahm Estates as located in the North half (N1/2) of the Northwest Fractional Quarter (NW fr'l 1/4) of Section 18, Township 28 North, Range 2 East, in the City of Colby, Marathon County, Wisconsin. Subject to all existing utility easement rights which shall continue pursuant to Section 66.1005(2) Wis. Stats. It being the intention of the Common Council to vacate all streets and portions thereof all fully described in said Replatt of Rahm Estates. SECTION 2. The title to the vacated streets shall be vested in the abutting property owners pursuant to the provisions as set forth in Section 66.1005(1) Wis. Stats. SECTION 3. The City Clerk shall be and she is hereby directed to record a certified copy of this Resolution together with a map o1 the vacated streets and portions of streets vacated as described herein in the Office of the Register of Deeds for Marathon County, Wisconsin. Motion carried with a voice vote. Committee meetings for April: Colby-Abbotsford Police Commission will meet on April 8, 2024 at 6:30 P.M. at the Police Department. City Planning will meet on April 15, 2024 at 6:00 P.M. Central Fire & EMS District will meet on April 18, 2024 at 7:00 P.M. at Station 2.
