COLBY COMMON COUNCIL March 5, 2024 Page 1 The regular meeting of the Colby Common Council was called to order at 6:30 P.M. by Mayor James Schmidt. On roll call: O’Brien, T Schmidt, Baumgartner, Hesgard, Hederer and Lindeman. Also present were Mayor James Schmidt, Clerk Connie Gurtner and DPW Higley. Agenda was posted by the clerk. The agenda will stand as the order of the meeting. Eric English introduced our new officer Noemi Fuentes Ramirez. Minutes of the February 7th meeting minutes were pre-read and reviewed. Motion was made by Schmidt, seconded by Hesgard to approve the minutes as presented. Motion carried with a voice vote. Financial Statement and Bills were discussed. Motion was made Hederer, seconded by Baumgartner to approve the financial statement and bills. The amounts approved are as follows: General Fund $715,977.24; Water Department $39,661.54; Sewer Department $28,682.07; Net payroll $40,203.24. Motion carried with a voice vote. Motion was made by Hederer, seconded by O’Brien to approve Change Order #1 for Switlick & Sons for the Hwy 13 Watermain Project as presented. Motion carried with a voice vote. Motion was made by T Schmidt, seconded by O’Brien to approve pay request #3 (final) for Switlick & Sons for the Hwy 13 Watermain Project as presented. Motion carried with a voice vote. Public Comment: Joe Mueller asked the council to consider changing the signage on the emergency services building from Colby Department to Central Fire & EMS District. He has a quote from Stratford Sign Company in the amount of $4,820. The city will discuss at a future committee meeting. Colby/Abbotsford Police Commission met on February 14th. The commission approved minutes and expenditures. Expenditure of $6,448.48 for Full Setup on 2024 Durango: The commission voted to approve the expenditure of $6,448.48 for the full equipment setup on the 2024 Durango as presented. Chief Bowman said some updates were needed on the equipment to be transferred from the former squad car. He said some components didn't fit properly, the light bar had to be replaced and the radio was upgraded to a Motorola. Other costs have gone up. Motion was made by Schmidt, seconded by Hederer to approve the expenditure of $6,448.48 for the full equipment setup on the 2024 Durango as presented. Motion carried with a voice vote. COLBY COMMON COUNCIL March 5, 2024 Page 2 Expenditure of $15,000 for New K9/K9 Officer Training: The commission voted to approve the expenditure of $15,000 for New K9 Officer/Officer Training. President Schmidt said there was currently $36,179 in the K9 Designated Fund. Chief Bowman said the all-inclusive training was scheduled March 11-April 12. He said K9 Officer Eric English was matched up with a Dutch Shepherd breed dog from Czechoslovakia. Motion was made by Schmidt, seconded by O’Brien to approve the expenditure of $15,000 for New K9 Officer/Officer Training. Motion carried with a voice vote. Chief's Report: Chief Bowman said overtime expense was up in January. He said it "had been a little crazy" due to some big calls, including domestic incidents, a stabbing and a suicide in Shortner Park. "All our officers are great, they all work hard and they all get along with each other," Chief Bowman said. He said Officer Noemi Fuentes-Ramirez Ana would be assigned to her own squad car next week. He said she had a good personality and was doing a good job. She speaks fluent Spanish, which has also been an asset. Chief Bowman said Officer Kaden Goodwin began training with Officer Lemay on Feb. 6. Chief Bowman said Officer Goodwin was a good fit for the CAPD. SRO Officer Brandon Nelson was being assigned full-time to the Colby School District starting the week of February 19. His regular shift is 7:30 am-3:30 pm Monday-Friday. He will also be asked to be visible at dances, athletic events, etc. Chief Bowman said Computer TR, the clerks at the city halls and Police Secretary Jessica Weich had all been very helpful in the police chief transition. Hederer said he appreciated the job everyone was doing on behalf of the CAPD. There were 776 total CAPD activities reported for the month of January 2024, compared to 787 total activities for the first month of 2023. Meeting date for March 2024: The next CAPC meeting will be held at 6:30 p.m. on Monday, March 11, 2024 at the CAPD. Central Fire & EMS District met on February 15th. Minutes were distributed prior to the meeting. City Planning Committee met on March 4th. Recap of Meeting 2 Items: Susan Badtke reviewed the goals for the meeting and recapped information from the previous meeting. Cultural/Historic Resources Element: Susan reviewed our current plan’s historical and cultural trends along with goals and objectives. Policy and recommendations were discussed in detail and the general concession was to continue to encourage the culture and history in our community, but not to keep items in the plan that include enforcement through preservation or Main Street Programs. COLBY COMMON COUNCIL March 5, 2024 Page 3 Transportation Element: The main transportation network in the city includes State Highway 13, County Highway N and local roads. The current rail is not operational, but some historic opportunities have been discussed with the existing tracks. With recent annexation, State Highway 29 should be added because it now runs adjacent to the city limits. Existing sidewalks were reviewed and the city’s plan for future sidewalk requirements. The goals and objectives for the city’s transportation were reviewed and discussed. Utilities and Community Facilities Element: The continuing search for water in the city was discussed. Susan will get the number of private homes not connected to the sanitary sewer from DPW Higley or Clerk Gurtner. The current capacity of our sewer plant is 67%. The committee reviewed a list all different community facilities and short term or long term needs. The committee took each section of the utilities and community facilities and added/deleted policies, goals and objectives. Next Steps and Meeting Date: Discuss Ag and Natural resources Element, Discuss Land Use Elements and Discuss Intergovernmental Cooperation Element and Implementation Element. The committee will meet on April 15, 2024 at 6:00 PM and May 21, 2024 at 6:00 PM. Review/Recommendation of SCS Site Plan Submittal: The committee voted to approve the recommendation to the council of the SCS Site Plan submittal subject to final stormwater, CSM, landscaping plan and photometrics. Motion was made by Schmidt, seconded by Hesgard to approve the SCS Site Plan submittal subject to final stormwater, CSM, landscaping plan and photometrics. Motion carried with voice vote. Mayor Schmidt: Mayor Schmidt reported on his meeting of the Clark County Economic Development and the McDevco Meeting. Mayor Schmidt appointed Harland Higley to serve a 3 year term on the Colby Cemetery Association. Motion was made by Hederer, seconded by Hesgard to approve the appointment. Motion carried with a voice vote. Clerk Gurtner: Clerk Gurtner distributed invitations for the Colby Economic Development Corporation Open Discussion Meeting on April 10, 2024. DPW Higley: DPW Higley reported on the precipitation and flows for February 2024 at the STP. He also reported on the pumpage of water for February 2024. Building Permits issued: Aguilera Enterprises, 304 S Division St, drywall, bathroom and kitchen remodel; Wells A & W, 1210 N Division St, signs and paint; Jayme Prein-Malzahn, 801 W Spence St, addition to current shed; Steven Kadolph, 204 S 2nd St, re-roof; Melody Powell, 109 S 4th St, re-roof; Chad and Cindy Pagelsdorf, 705 W Dolf St, replace windows. COLBY COMMON COUNCIL March 5, 2024 Page 4 There was a water main break today at the intersection of County N and 7 th Street. Ordinance #2024-2 Ordinance Repealing and Recreating Section 393-8 Stormwater Management and Erosion Control: Motion was made by Schmidt, seconded by O’Brien to approve Ordinance #2024-2 Ordinance Repealing and Recreating Section 393-8 Stormwater Management and Erosion Control as presented. Motion carried with a voice vote. Ordinance # 2024-2 Ordinance Repealing and Recreating Section §393-8 Stormwater Management and Erosion Control Land-disturbing activities subject to stormwater runoff control (condensed version) E. (2) Regardless of proposed land use: a) The proposed development shall not increase peak flow rates of storm runoff from that which would have resulted from the same storm occurring over the site with the land in its predevelopment condition, for storms of twenty-four hour duration and recurrence intervals of two, five, 10, 25, 50 and 100 years; and b) The volume of storm runoff resulting from the ten-year storm of twenty-four hour duration shall not be greater after development than would have resulted from the same storm occurring over the site with the land in its predevelopment condition. c) Where Subsection E(2)(a) and/or (b) are is found to be unacceptable or inevitable on the proposed site by the City Engineer, the applicant shall specify an off-site area to meet there provision and provide a suitable alternative contribution or determined in negotiation with the City Engineer. Signed: Mayor Schmidt Attest: Connie Gurtner Cost Estimates for City ArcGIS Online System & LSL Toolkit: The city received an estimate for GIS Mapping in the amount of $32,000. In addition, there are costs to purchase software to access and update this information from ArcGIS. The one-time fee for activation and set up of this program is $11,750 and includes three phases. Motion was made by Baumgartner, seconded by Hederer to approve the purchase at a total of $43,750. Motion carried with a voice vote. Committee meetings for March: Colby-Abbotsford Police Commission will meet on March 11, 2024 at 6:30 P.M. at the Police Department. Central Fire & COLBY COMMON COUNCIL March 5, 2024 Page 5 EMS District will meet on March 21, 2023 at 7:00 P.M. at Station 2. The annual cemetery meeting is March 26, 2024 at 7:00 PM at the Colby City Hall. April Council Meeting: The Spring Election is Tuesday, April 4th and we have been using the council room for the elections. It was determined that we will meet on the same night and just meet in the basement. Adjourn: Motion was made by Hederer, seconded by Schmidt to adjourn at 7:34 P.M. Motion carried with a voice vote.
