Board of Appeals December 5, 2024 5:00 PM The meeting was called to order at 5:00 PM. Roll Call: Hederer, Hesgard, Lindeman and Raatz. Also present were Bhavik Patel, manager of Rodeway Inn, Jim Wiedeman, owner of Boomtown Fireworks, Trevor Stuttgen of Boomtown Fireworks, Larry Swarr from Village of Curtiss. Jim Weideman presented his proposal and stated that he was unsure what they wanted to do with the property long term, but is interested in a 3 year variance for storage containers and allowance to sell fireworks within the 500 feet of a gas station. He stated that the State Statute is 50 feet and many other places are 150 feet. Bhavik Patel voiced concern about safety with it being so close to the hotel. Randy Hesgard has talked with Fire Chief Mueller and DPW Higley and both are not in favor of approval of the variance. There was discussion on variance law and the issuance of a variance needs to be based on circumstances relating to a unique property and this does not fall under that criteria. Motion was made by Raatz, seconded by Hesgard to NOT approve the two variance requests as presented. Roll Call Vote: Ayes – Hesgard, Hederer, Raatz. Noes – Lindeman. Motion carried to NOT approve the variances. Suggestion was made that they could look into a storage shed or building and work with the city to change the 500 feet fireworks setback requirement. Motion was made by Hesgard, seconded by Lindeman to adjourn. Motion carried with a voice vote. Teri Raatz

CITY OF COLBY NOTICE OF PUBLIC HEARING Vacant Lot on Hodd Drive, Colby PLEASE TAKE NOTICE THAT Boomtown Fireworks LLC has requested a variance at Parcel 211-2802-072-0969, Lot 2 CSM #19144 (200 Block of Hodd Dr), Colby. The variance has been requested to allow for the use of shipping containers to store and sell fireworks. This would require a variance to Ordinance § 480-88 which prohibits the use of shipping containers in certain zoning districts. TAKE FURTHER NOTICE that the Board of Appeals Committee will hold a Public Hearing on Thursday, December 5, 2024 at 5:00 PM to hear all persons desiring to be heard in connection with this variance. The meeting will be held in the Council Chambers at Colby City Hall, 211 W Spence Street, Colby, WI. Connie Gurtner, CMC, WCMC City Clerk
