COLBY COMMON COUNCIL September 6, 2022 Page 1 The public hearing to hear persons in relation to Resolution 12-2022 to vacate and discontinue alley was called to order by Mayor Schmidt at 6:30 PM. On roll call: O’Brien, T Schmidt, Baumgartner, Hesgard, Hederer, Lindeman. Also present were Mayor James Schmidt, Clerk Connie Gurtner and DPW Harland Higley Jr. No citizens were present with concerns regarding Resolution 12-2022. Motion was made by Hederer, seconded by Baumgartner to recommend the adoption of Resolution 12-2022 to the full council. Motion was made by Hederer, seconded by Hesgard to adjourn the public hearing. Motion carried with a voice vote. The regular meeting of the Colby Common Council was called to order at 6:35 P.M. by Mayor James Schmidt. On roll call: O’Brien, T Schmidt, Baumgartner, Hesgard, Hederer and Lindeman. Also present were Mayor James Schmidt, Clerk Connie Gurtner, DPW Harland Higley Jr and Mike Voss from MSA. Agenda was posted by the clerk. The agenda will stand as the order of the meeting. Minutes of the August 2nd meeting were pre-read and reviewed. Motion was made by Schmidt, seconded by O’Brien to approve the minutes as presented. Motion carried with a voice vote. Financial Statement and Bills were discussed. Motion was made by Schmidt, seconded by O’Brien to approve the financial statement and bills including pay request #2 – 2nd Street, pay request #4 – Community Dr and Change Order #2 in the amount of $3,359.64. The amounts approved are as follows: General Fund $161,661.46; Capital Fund $539,974.21; TID Fund $1,200.00; Water Department $23,771.07; Sewer Department $20,143.23; Net payroll $23,839.61. Motion carried with a voice vote. Comments from the Public: None. Central Fire & EMS District met on August 18th. The commission approved minutes and treasurer’s report. 2023 Budget: The proposed 2023 budget was discussed and reviewed line by line. The commission moved to submit the 2023 Central Fire & EMS District budget totaling $665,650 to the municipalities for approval. Unity and Frankfort fire contracts due to expire 12/22: The Unity and Frankfort fire contracts were discussed. The commission moved to offer fire coverage contracts to Unity and Frankfort at $9,500.00 each per year with a 2-year contract. COLBY COMMON COUNCIL September 6, 2022 Page 2 Motion was made by Schmidt, seconded by Hederer to approve the 2023 proposed budget from Central Fire & EMS District in the amount of $665,650 with the proposed City of Colby’s contribution of $53,830.07. Motion carried with a voice vote. Parks/Rec/Recycling Committee met on August 23rd. 2022 Budget Updates: DPW Higley stated that everything at the ball park has been repaired except for one pole, 3 LED lights, and 3 other lights that need to be replaced. These are covered by insurance and everything needed has been ordered. There is a delay in shipping with no estimation of arrival. Also, the park has not been sprayed this year yet and will need to be sprayed this fall to help with spring weeds. This is a service that is not completed every year. 2023 Budget: DPW Higley stated that the city is need of new display banners because the ones that exist are getting worn and tattered. There would need to be about 60 ordered. This meeting is to get a wish list and a very rough estimate of what would be needed for the 2023 budget. Currently, the list consists of 60 replacement banners ($11,000), pickle ball court ($400), 5 trees at $200/ piece ($1000), Contingency ($1300), Replace lights at ball field ($1000), Paint bathroom and concession stand ($1300) More lights at South 6th Street Park ($1000). DPW Higley noted that the tree donation/memorial process could be simplified by allowing the donors to choose from a list of 5 trees when they have no preference or specific species that they prefer. Look at taking from park maintenance expense budget to help with park/rec. If the budget allows, the parking lot at South 6th Street Park should be blacktopped in 2022 yet. Harland will get estimates for every item and then email the committee members with this information. Mayor Schmidt: Mayor Schmidt reported on the meeting of the Clark County Economic Development Meeting. Harland Higley: The following building permits were issued: Dan Hederer, 212 S 3rd St, garage roof; Smith Bros, 822 S Division St, concrete slab; M & M Auto, 410 S Division St, new roof; Shane & Jody Underwood, 208 N 6 th St, concrete patio; Jane Holtzhausen, 304 S 3rd St, fix siding; Tom Firnstahl, 704 E Monroe St, blacktop driveway; Mike Hryndej, 202 & 204 E Spence St, new driveway; Penni Cloud, 607 W Dolf St, covered deck, re-shingle, windows, siding, deck & concrete stoop. DPW Higley reported on the precipitation and flows for August 2022 at the STP. He also reported on the pumpage of water for August 2022. Community Drive should be open for traffic tomorrow. COLBY COMMON COUNCIL September 6, 2022 Page 3 Engineer Mike Voss: Street construction projects seem to be on schedule. Picnic License – Knights of Columbus, St Mary’s Fall Festival – 9/11/22: Motion was made by Hederer, seconded by Hesgard to approve the picnic license for the Knights of Columbus on the above dates. Motion carried with a voice vote. Picnic License – Colby Lions Club Bingo Nights – 10/11/22, 11/8/22, 12/13/22, 1/10/22, 2/14/22, 3/14/22: Motion was made by Schmidt, seconded by O’Brien to approve the picnic license for the Colby Lions Club, 103 W Adams St on the above dates. Motion carried with a voice vote. Liquor License, El Rinconcito LLC, 100 W Clark: Motion was made by O’Brien, seconded by Lindeman to approve the Class B combination license for El Rinconcito LLC. Motion carried with a voice vote. Resolution 12-2022 Discontinuation of Alley: Motion was made by Schmidt, seconded by Hesgard to approve Resolution 12-2022 as follows. Motion carried with a voice vote. Resolution #12-2022 A Resolution concerning a written petition pursuant to Section 66.1003(3) Wis. Stats., to discontinue all of the alley as platted and located in the Salter and Sims Addition to the City of Colby, Marathon County, Wisconsin. WHEREAS, a written petition of the owners of more than 50 percent of the frontage of the lots and lands abutting the unpaved alley as platted and located in the Salter and Sims Addition to the City of Colby has been filed with said City of Colby. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Colby, Wisconsin, as follows: SECTION 1. Based upon the fact that no written objections were filed with the City by any of the owners abutting the alley as platted and located in the Salter and Sims Addition to the City of Colby, Marathon County, Wisconsin; NOW, therefore the following described alley is hereby vacated and discontinued, subject to the conditions listed below: All of the alley as platted and located in the Salter and Sims Addition to the City of Colby, Marathon County, Wisconsin. Subject to all existing utility easement rights which shall continue pursuant to Section 66.1005(2) Wis. Stats. SECTION 2. The title to the vacated alley shall be vested in the abutting property owners pursuant to the provisions as set forth in Section 66.1005(1) Wis. Stats. SECTION 3. The City Clerk shall be and she is hereby directed to record a certified copy of this Resolution together with a map of the alley herein above vacated in the Office of the Register of Deeds for Marathon County, Wisconsin. COLBY COMMON COUNCIL September 6, 2022 Page 4 James W Schmidt, Mayor Connie L Gurtner, Clerk Resolution 13-2022 in Recognition of Curt Witynski and Gail Sumi: Motion was made by Hederer, seconded by Hesgard to Resolution 13-2022 as follows. Motion carried with a voice vote. 13-2022 Resolution in Recognition of Curt Witynski and Gail Sumi WHEREAS, since 1987, Curt Witynski has been providing leadership, guidance, and advocacy to benefit the cities and villages of Wisconsin; and WHEREAS, since 2011, Gail Sumi has given voice to, and enlightened and informed Wisconsin’s local leaders through her direction and coordination of the League of Wisconsin Municipalities’ multiple channels of communication, including editing and production of The Municipality; and WHEREAS, Mr. Witynski and Ms. Sumi have been thought leaders and trusted advisors for local officials, both elected and appointed; and WHEREAS, Curt Witynski and Gail Sumi have contributed in countless ways to the prosperity and success of local government in Wisconsin; and WHEREAS, in addition to their tireless efforts on behalf of municipal government, Curt Witynski and Gail Sumi have been role models for thousands of local leaders; and WHEREAS, Mr. Witynski and Ms. Sumi will be retiring from daily service to local government at the end of calendar year 2022, NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Colby expresses its profound gratitude to Curt Witynski and Gail Sumi for their service; and BE IT FINALLY RESOLVED that City Council of the City of Colby congratulates them both on their careers of leadership and wishes them well in future endeavors. James W Schmidt, Mayor Connie L Gurtner, Clerk Delta Dental Renewal: Motion was made by Schmidt, seconded by Baumgartner to approve the Delta Dental Renewal for 1/1/23.The rate increased 1.99% from $118.57 to $120.94. Motion carried with a voice vote. COLBY COMMON COUNCIL September 6, 2022 Page 5 Committee meetings for September: Colby-Abbotsford Police Commission will meet on September 12, 2022 at 6:30 P.M. at the Police Department. Central Fire & EMS will meet on Thursday, September 15, 2022 at 7:00 P.M. at Station 2. Parks/Rec/Recycling Committee will meet on September 14, 2022 at 6:30 PM. Finance Committee will meet on October 3th at 6:00 P.M. with the October council meeting to immediately follow the finance meeting. The October council meeting will be Monday, October 3rd at 6:30 PM or immediately following budget. Public Works will meet on Monday, September 19th at 7:00 PM. Colby-Abbotsford Police Commission met on August 8th. Closed Session: Motion was made by Hederer, seconded by O’Brien to go into closed session at 6:33 p.m. per state Stats 19.85 (1) (c) Considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility. Purpose: Discuss Officer Wages and Proposed Extension of the Union Contract Roll call vote: Baumgartner, Hederer, Hesgard, Lindeman, O’Brien, Schmidt. Motion carried. Motion was made by O’Brien, seconded by Hederer to go back into open session. Roll call vote: Baumgartner, Hederer, Hesgard, Lindeman, O’Brien, Schmidt. Motion carried. The commission approved minutes and expenditures. Chief's Report: Officer Wagner said the K-9 was deployed four times in July, resulting in four arrests. There were 916 total CAPD activities reported for the month of July, with a year-to-date total of 5,701, compared to 5,781 total CAPD activities reported for the first seven months of 2021. Officer Wagner said the vehicles were all running fine. He said Brandon Nelson began his Academy Training at NTC in Wausau this week. President Schmidt said he would present a sympathy card to the Bauer family on behalf of the CAPC members. Meeting Date for September 2022: The next CAPC meeting will be held at 6:30 p.m. on Monday, September 12, 2022, at the CAPD. Motion was made by Schmidt, seconded by O’Brien to approve the acceptance of donations from area businesses and individuals for the purpose of fully funding CAPD wage increases for a three-year period. Said funds shall be put into a dedicated account for payment of the wage increases, additional wage taxes and additional WRS expenses, with the 2022 Police Budget being amended to reflect these donations. Agreements will be provided in writing from the donors making pledges for future donations. Motion carried with a voice vote. Motion was made by Schmidt, seconded by Hederer to approve a $3.00 per hour wage increase for CAPD Patrolmen retroactive to August 7, 2022. Wage rates COLBY COMMON COUNCIL September 6, 2022 Page 6 would be set as follows: 2022, $30.00/hour; 2023, $30.95/hour; 2024, $31.93/hour, per agreement with the Police Union. Motion carried with a voice vote. Motion was made by Schmidt, seconded by Lindeman to approve $3.00 per hour wage increases for Police Chief Bauer (old rate $37.00 to $40.00), Lieutenant Alex Bowman (old rate $28.84 to $31.84), and Police Secretary Jessica Weich (old rate $21.00 to $24.00) retroactive to August 7, 2022. Motion carried with a voice vote. Motion was made by Schmidt, seconded by Hederer to approve extending the Police Union Contract to December 31, 2025, with a wage increase of 3% effective January 1, 2025, setting the 2025 hourly wage rate of $32.88 for CAPD Patrolmen, with all other conditions of the Police Union Contract remaining the same, per agreement with the Police Union.
