City Council Meeting Minutes ___________________________________________________________________________________________ THURSDAY, AUGUST 17, 2017 CITY HALL COUNCIL CHAMBERS CITY OF COLUMBIA CITY, COLUMBIA COUNTY, OREGON AGENDA ITEM 1 CALL TO ORDER/ROLL CALL: CONVENED: Mayor Young called the regular meeting to order at 6:00 p.m. Mayor Young delivered the invocation and led the flag salute. COUNCIL MEMBERS PRESENT: Mayor Cheryl A. Young Councilor Karli Ebert Councilor Nell Harrison Councilor Sally Ann Marson Councilor Gordon Thistle COUNCIL MEMBERS ABSENT: None ALSO PRESENT: Micah Rogers, Public Works Superintendent Michael McGlothlin, Chief of Police Leahnette Rivers, City Administrator/Recorder ATTORNEY PRESENT: None A quorum was present and due notice had been published. AGENDA ITEM 2 PUBLIC HEARINGS: 2.1 Public Hearing: To hear public testimony about the proposed adoption of a Resolution authorizing a loan from the Safe Drinking Water Revolving Loan Fund by entering into a Financing Contract with the Oregon Infrastructure Finance Authority. The loan will not exceed $762,000, with $228,600 eligible for principal forgiveness, a 20-year term, and an interest rate that will not exceed 2.26%. Joe Turner of Columbia City asked if water rates would increase as a result of this loan. Leahnette said there are no planned water increases tied directly to this loan. Joe asked what the project entails. Leahnette said the project involves the restoration of the upper reservoir (recoating the tank interior, repairs as needed, repainting the exterior of the tank), the addition of seismic upgrades to the City's two steel reservoirs, the replacement of very old and undersized water main on I Street, First Street and The Strand, the replacement of old fire hydrants, and the addition of new fire hydrants. She noted that the old water main was probably installed in the 1920's or 1930's and the joints contain lead. 2 - Regular City Council Meeting August 17, 2017 Joe asked for a specific breakdown of the individual project costs. Leahnette said she did not have that information readily available, but she would send it to him via email following the meeting. Joe Turner asked what the engineered rating is for the seismic improvements. Leahnette said off hand, she was not sure, but she offered to send Joe additional information about the specific design of the seismic upgrades later via email. She noted that 75% of the seismic upgrade costs will be paid for using FEMA Hazard Mitigation grant funds. AGENDA ITEM 3 CITIZEN INPUT: None. AGENDA ITEM 4 COUNCIL REPORTS: 4.1 Parks Committee: Chair Marson said the minutes from the last meeting were included in the meeting packet, and the next meeting will be held next Tuesday. 4.2 Water and Sewer Committee: No report. 4.3 Street Committee: Leahnette said the new pavement is finished at the end of Sixth Street and it looks great. Council reviewed an email dated August 2, 2017, from Nancy Girard of Columbia City requesting a yield or stop sign be installed at the corner of Lincoln and Sixth Streets, and a "dead end" or "no outlet" sign be installed at the north end of Sixth Street. Nancy indicated that they get a lot of turn around traffic in their driveway because people think it is a through street. Councilor Marson said she's seen several people turn around at the north end of Sixth Street. It was the consensus of the Council that a "no outlet" sign be installed on Sixth Street at Lincoln Street, and Chair Marson said the Sixth Street paving work is expected to occur sometime next week. Chief McGlothlin agreed that a yield or stop sign is needed in the intersection. It was the consensus of the Council that a yield sign be added to Lincoln Street at Sixth Street. Council considered a verbal request from Al and Margaret Teasley of Columbia City asking that "children playing" signs be added to Eighth Street between I and K Streets. It was the consensus of the Council that "children playing" signs be added to Eighth Street. Councilor Marson inquired about the replacement of the centerline reflector buttons on the corner of Fifth and J Streets. Micah said the snow plow removed the last ones, which were raised. He said now they are investigating the purchase of reflectors that will be recessed into the asphalt. Chief McGlothlin suggested signage be added to the First and F Street intersection, where a motor vehicle accident recently occurred. It was the consensus of the Council that a yield sign be added to F Street on both sides of First Street. Micah said he received a citizen request to add a stop or yield sign to the Seventh and Penn Street intersection. Micah suggested adding a yield or stop sign on Penn Street on the west side of Seventh Street. No objections were heard. The Council reviewed a letter dated August 9, 2017 from Kit Gardes, Friends of the Columbia City Community Library President, requesting the closure of Second Street between E and G Streets and the closure of F Street between First and Second Streets 3 - Regular City Council Meeting August 17, 2017 from 6 am to 3 pm on Saturday, September 16, 2017, for the City Celebration Show 'n Shine Car Show. MOVED (MARSON), SECONDED (HARRISON) AND CARRIED UNANIMOUSLY TO APPROVE THE STREET CLOSURE REQUEST. 4.4 Audit Committee: No report. 4.5 Hazard Mitigation Planning Group: Councilor Ebert said the Hazard Mitigation Planning Group will meet at the end of August to finalize the Prepare Fair details. 4.6 Other Reports: None. AGENDA ITEM 5 CONSENT AGENDA: 5.1 Bills paid with check numbers 20387 and 20455 during the month of July 2017. 5.2 Minutes of the Regular City Council Meeting on July 20, 2017. 5.3 Financial Reports for the period ending June 30, 2017 (preliminary). 5.4 Financial Reports for the period ending July 31, 2017. 5.5 Activities report from the Public Works Superintendent. 5.6 Activities report from the City Administration. MOVED (MARSON), SECONDED (THISTLE) AND CARRIED UNANIMOUSLY BY ROLL CALL VOTE TO APPROVE THE CONSENT AGENDA. AGENDA ITEM 6 UNFINISHED BUSINESS: 6.1 Discussion of the local regulation of marijuana. This topic was discussed in the Workshop Session held prior to the City Council meeting. Therefore, no further discussion or consideration occurred. AGENDA ITEM 7 NEW BUSINESS: 7.1 Franchise Extension Agreement: Franchise Extension Agreement between the City of Columbia City and the Columbia River People's Utility District. MOVED (HARRISON), SECONDED (THISTLE) AND CARRIED UNANIMOUSLY TO APPROVE SIGNATURE TO THE FRANCHISE EXTENSION AGREEMENT. 7.2 Release of Lien: Release of lien established by Resolution No. 17-1179-R; a Resolution assessing unpaid water and sewer utility charges, fees and accrued interest as a lien against property described as Tax Account No. 5121-CD-01610, located at 2735 Sixth Street. MOVED (MARSON), SECONDED (HARRISON) AND CARRIED UNANIMOUSLY TO AUTHORIZE SIGNATURE TO THE RELEASE OF LIEN. 7.3 Council Bill No. 17-824; Resolution No. 17-1197-R: A Resolution of the City of Columbia City, Oregon, authorizing a loan from the Safe Drinking Water Revolving Loan Fund by entering into a finance contract with the Oregon Infrastructure Finance Authority. MOVED (MARSON), SECONDED (EBERT) AND CARRIED UNANIMOUSLY TO ADOPT COUNCIL BILL NO. 17-824. 7.4 Council Bill No. 17-825: An Ordinance amending Ordinance No. 400, providing for licenses upon trades, shops, occupations, professions, businesses, and callings for the purpose of revenue and regulation; providing for the method of 4 - Regular City Council Meeting August 17, 2017 issuing licenses; and providing penalties for violation thereof; declaring an emergency. Leahnette suggested the City Council take no action on Council Bill No. 17-825. She said after discussing this topic with League of Oregon Cities staff, she learned that most of the City business license ordinances throughout the state contain similar language about businesses complying with federal regulations. However, the City can still certify that it does not ban marijuana establishments and qualify for a share of the tax distribution so long as it does not revoke any marijuana establishment business licenses due to non- compliance with federal regulations. The City Council took no action on Council Bill No. 17-825. 7.5 Sewer Connection and Pretreatment Program Implementation Agreement: Sewer Connection and Pretreatment Program Implementation Agreement between the City of St. Helens and the City of Columbia City. Micah said the City of St. Helens treats our sewer, and the changes in this agreement give the City of St. Helens the authority it needs to properly enforce all of the rules associated with sewer treatment, including commercial and industrial connections. Leahnette explained that the Department of Environmental Quality is requiring these changes, but the changes don't really have much of an impact on anything that we do because we already comply with the changes. MOVED (THISTLE), SECONDED (MARSON) AND CARRIED UNANIMOUSLY TO APPROVE SIGNATURE TO THE SEWER CONNECTION AND PRETREATMENT PROGRAM IMPLEMENTATION AGREEMENT. Leahnette noted that staff will be preparing some amendments to our Sewer Ordinance to bring it into compliance with this newly amended agreement. AGENDA ITEM 8 OTHER BUSINESS: Police Department: Chief McGlothlin said department staff spent the great part of a day on the shooting range this past Monday. He said Officer Bubar will be getting married on August 26, and then taking a honeymoon vacation. He said shortly after Officer Bubar returns to work, he'll be leaving to attend the Police Basic Academy. He said his first day in the Academy will be September 11th. Councilor Marson commended the Police Department for their vacation premise check efforts. Public Works Department: Micah said the department has been really busy with several construction projects around the City.
