MEMORANDUM OF UNDERSTANDING
This Memorandum of Understanding entered into this 17th day of December, 2019,
by and between the City of Columbus (hereinafter “Columbus”), Kestrel Golf Properties
LLC (hereinafter “Kestrel”) and William N. Hoffman and Julia C. Hoffman (hereinafter
“Hoffman”).
WHEREAS, Kestrel is the owner of Lot 1 of CSM 3981 (Tax Parcel No. 11211
1400.06); and
WHEREAS, Hoffman is the owner of Lot 1 of CSM 4400 (Tax Parcel No. 11211
1187.03); and
WHEREAS, Columbus has a stormwater pipe and facility that goes across, under,
over and through the properties owned by Kestrel and Hoffman; and
WHEREAS, in order to better manage the stormwater issues on the properties
owned by Kestrel and Hoffman, and to better manage the flow of stormwater throughout
this area of Columbus, Kestrel desires to install a control device in the existing stormwater
management facility to regulate the water level and Hoffman desires install drain tile
around the stormwater management facility and connect that facility and the drain tile to
the existing stormwater structure and facility maintained by Columbus; and
WHEREAS, Columbus agrees to allow Kestrel to connect to its existing
stormwater pipe under certain terms and conditions as set forth in this Memorandum of
Understanding.
NOW, THEREFORE, for good and valuable consideration, the receipt of which is
hereby acknowledged, the parties to this agreement do hereby agree as follows:
1. Kestrel and Hoffman shall, at is sole expense, be responsible for constructing any
and all stormwater maintenance facilities on its parcel as it deems appropriate;
provided, the facility constructed by Kestrel has a mechanism which will allow the
flow of stormwater to be regulated by Kestrel and Columbus.
2. Once constructed, Kestrel and Hoffman shall be allowed to connect to the Columbus
stormwater pipe that travels across the Kestrel and Hoffman properties under the
following conditions:
A. Kestrel and Hoffman shall make the connection to the structure maintained
by Columbus at a storm water manhole location to be determined by the City
of Columbus Engineer. The connection shall also be made in a manner
approved by the City Engineer.
B. Once the connection has been established, Kestrel and Hoffman shall be
solely responsible for maintaining and repairing the connection.
C. Kestrel shall be responsible for keeping the connection clean and free of
debris, and also shall be solely responsible for making any repairs to the
Columbus facility that are caused as a result of stormwater flow from
Kestrel’s facility through the Columbus facility.
3. Kestrel agrees to use its best practices in maintaining the level of its stormwater
facility so as to minimize the possibility of flooding in this area and downstream
storm water pipe. Kestrel grants Columbus the authority to adjust the flow of water
from the Kestrel facility if, in the opinion of Columbus, the flow of water is causing,
or may cause, flooding issues downstream from the Kestrel facility.
4. Kestrel shall install flow monitors in locations to be determined by the City of
Columbus Engineer to monitor the flow of stormwater through the Columbus
facility if directed by the City of Columbus.
5. The facility installed by Kestrel, and the connection of the Kestrel facility to the
Columbus facility, shall not be dedicated to the public and shall always remain the
private property of Kestrel.
6. In the event Kestrel fails to perform its obligations under this Memorandum of
Understanding, Columbus shall have the authority to make all repairs to its facility,
including the connection created by Kestrel. In such an event, all associated costs
will be assessed back as a special charge against the Kestrel property pursuant to
§66.0627 Wis. Stats. Said charge shall be a lien on the property and shall be
collected with real estate taxes.
7. This agreement shall run with the land and is binding upon the parties, their
successor and assigns. The persons executing this agreement acknowledge that they
are authorized to do so.

8. Hoffman is made part of this agreement because the Columbus facility travels across
the Hoffman property and Hoffman will have a drain tile pipe that will connect to
the Columbus storm water pipe. Hoffman shall not be personally responsible for
any of the obligations of Kestrel and their improvements and Kestrel will not be
responsible for Hoffman and their improvements as set forth in this agreement.

ORDINANCE NO. ______________
AN ORDINANCE TO CREATE SECTIONS 18-31 THROUGH 18-36 OF THE CITY OF
COLUMBUS CODE OF ORDINANCES CONCERNING BUILDING REGULATIONS
The Common Council of the City of Columbus, Columbia County, Wisconsin, does ordain
as follows:
1. Sections 18-31 and 18-32 are created to now read as follows:
Sec. 18-31. – Administrative Code Sections Adopted.
The following chapters of the Wisconsin Administrative Code, as may be amended
from time to time, are adopted by the City of Columbus and shall be enforced by the
Building Inspector:

SPS 305 Credentials
SPS 316 Electrical Code
SPS 320-325 Uniform Dwelling Code
SPS 327 Campgrounds
SPS 361-366 Commercial Building Code
SPS 375-379 Buildings Constructed Prior to 1914
SPS 381-387 Uniform Plumbing Code
Sec. 18-32. – Existing Codes.
Existing ordinances and local codes shall remain in effect except as and until they
conflict with any provision of the codes adopted pursuant to this Article. To the extent
existing ordinances and codes conflict with the codes adopted under this Article, the terms
set forth in the Wisconsin Administrative Codes shall apply.
2. Sections 18-33 through 18-35 are hereby created to now read as follows:
Sec. 18-33. – Acceptance of Delegation.
The City of Columbus hereby adopts the certified municipality status as described
in SPS 361.60 of the Wisconsin Administrative Code. The City shall assume the following
responsibilities for the Department of Safety and Professional Services (Department):
(a) Provide inspection of commercial buildings with Certified Commercial Building
Inspectors; and
(b) Provide plan review of commercial buildings with Certified Commercial Plan
Reviewers.
Sec. 18-34. – Plan Review.
Drawings, specifications and calculations for all the types of buildings and
structures, except state-owned buildings and structures, to be constructed within the limits
of the City of Columbus shall be submitted to the Building Inspector if the plans are for
any of the following:
(a) A new building or structure containing less than 50,000 cubic feet of total volume;
(b) An addition to a building or structure where the area of the addition results in the
entire building or structure containing less than 50,000 cubic feet of total volume;
(c) An addition containing no more than 2,500 square feet of total floor area and no
more than one floor level, provided the largest roof span does not exceed 18 feet
and the exterior wall height does not exceed 12 feet;
(d) An alteration of a space involving less than 100,000 cubic feet of total volume;
(e) The City of Columbus may waive its jurisdiction for the planned review of a
specific project or types of projects, or components thereof, in which case plans and
specifications shall be submitted to the Department for review and approval; and
(f) The Department may waive its jurisdiction for the plan review of a specific project,
where agreed to by the City of Columbus, in which case plans and specifications
shall be submitted to the Building Inspector for review and approval.
Sec. 18-35. – Plan Submission Procedures.
All commercial buildings, structures and alterations including new buildings and
additions less than 25,000 cubic feet require plan submission as follows:
(a) Building permit application;
(b) Application for review (SBD-118)
(1) Fees per table SPS 302.31-2 and SPS 302.31
(2) Fees apply to all commercial projects
(c) Four sets of plans:
(1) Signed and sealed per SPS 361.31
(2) One set of specifications
(3) Component and system plans
(4) Calculations showing code compliance
3. If any portion of this Ordinance or its application on any person or circumstances is held
invalid, the validity of this Ordinance as a whole or any other provision herein or its
application shall not be affected.

4. This Ordinance shall take effect immediately upon its passage and publication or posting,
as required by law.
