Call to Order – Meeting was called to order at 6:32 PM 2. Determination of Quorum – Thom, Meyers, Hackman, Lyons and McCabe were present. Schreiber staffed the meeting. 3. Notice of Posted Meeting – Meeting was noticed in accordance with state and local laws. 4. Approve Agenda – Motion by Lyons, second by McCabe to approve the agenda as presented. Motion passed 5-0. 5. Approve Minutes from Previous Meeting – Motion by McCabe, second by Hackman to approve the 1- 18-21 minutes as presented. Motion passed 5-0 6. Citizen Comments – No Comments were received. 7. CDA Financial Reports- City Loan Fund and Façade Program – Staff provided an overview of the financial reports for the Revolving Loan Fund and Façade Program. 8. Unfinished Business a. Discuss CDA participation in the Electrical Vehicle charging project – Staff provided an update on the status of the EV charging project. The next steps was to get support for tourism commission and council to fund the remaining gap in the process. Staff was directed to follow up with water and light to clarify the costs of running an electrical line to the charging station. b. Review of updated Façade Program guidelines - Staff provided an overview of the updated program guidelines to ensure the modifications reflected the discussion at the 1-18-21 meeting. The consensus was that no further changes were needed to the guidelines at this time. 9. New Business a. Review and discussion of Draft CDA Bylaws – Staff reviewed a draft of the CDA bylaws. The updated bylaws are needed to clarify the role of the CDA with the city. Several edits were made and the CDA recommended that the changes should be brought back to the CDA for review before they were forwarded to council for approval. b. Review and discussion of Draft Marketing Plan – Staff reviewed the draft marketing plan for the CDA. The CDA made several suggestions to update the marketing plan. Staff noted the budget is still under development and will return to the CDA when better refined. 10. CDA Financial Reports- City Loan Fund and Façade Program – Staff provided an update on the status of the loan fund and façade program. 8. Unfinished Business a. Discuss CDA participation in the Electrical Vehicle charging project – Staff updated the CDA regarding the electrical vehicle charging station project. The project has been discussed at several CDA meetings. The consensus was to move forward with support of the project. Motion by Meyers, second by McCabe for the CDA to commit up to $2,000 towards the Electrical Vehicle Project. Motion passed 4-0 with Lyons abstaining. b. Review and take potential action on Draft CDA Bylaws - Staff reviewed the updated bylaws with the CDA. The consensus was that suggested edits were ready to go to council for review. Motion by Meyers, second by McCabe to approve the bylaws with suggested edits. 9. New Business - None 10. Adjournment – Motion by Lyons, second by McCabe to adjourn the meeting. Pavilion Window Restoration Project – Phase 3: 1. Contractor recommendation & donation approved by council 3-2-2021: Noted. 2. Building permit fee: The $165 fee paid by City. 3. Attorney fees – Paul Johnson: $833 fee paid by City. CHLPC appreciates the good-faith working relationship with the City. Meyers questioned if the fees could be taken from the “new projects” fund budgeted to CHLPC through the City. However, those funds have already been designated to our Façade Improvement Fund. 4. Timeframe for project – May 11 – June 9. Noted B. Façade Improvement Grant – Meeting on 3-23-2021: Fredericks & Salzwedel met with Mayor Thom and Matt Schreiber and agreed to partner with Columbus Development Association on downtown historic structures, for our Facasde Inprovement Grant program, following state Historical guidelines. Meyers will forward the approved donation policy. It was agreed to set up a CHLPC Façade Improvement account. C. SOP – Amy Jo Meyers: Salzwedel made a motion to table the Standard Operating Procedures (an itinerary for bringing projects to Council) until next Month. Lukasavitz seconded it. Motion carried. D. Summer Concert Series 2021 –August/September – discussion – Local Vocals schedule: Will address the issue again following the possible expiration of the May 5 Covid-19 mandate. Fredericks will contact Local Vocals about an August 22 date. Providing the fact that the mandate is lifted, we will approach CCDC for a picnic license. Comment was made to recommend City have their own picnic license for City sponsored events. E. Historic designations – meeting with John Tish – State Historical Society – Carolyn/Lisa Wolf: Tabled until next meeting, at which time Fredericks will contact Lisa Wolf about setting up a Zoom meeting with Tish to meet with Commissioners to discuss necessary steps as a refresher course, or hold a special meeting if Jason Tish is allowed to travel again to meet with commissioners. Altschwager informed the Commission of the upcoming 100th anniversary of the Whitney Chapel. Will contact Ulrich for information from the CHLPC files. Question was raised as to the use of CHLPC property (i.e. photos, documents, etc.) Salzwedel and Hermanson will check with the State and set up a procedural policy to handle situations. F. Resthaven bathroom/improvement project – presentation & pictures from Ruth Hermanson. Discussion on moving forward and COW agenda: Hermanson distributed information she, Jenny Schultz, and Amy Jo Meyers obtained regarding the bathrooms and other updates needed at the Resthaven, interior and exterior. Following discussion, it was agreed to have Fredericks & Salzwedel meet with Mayor Arnold & Administrator Ellefson as Step 1 in working together on the project. G. CHLPC/City website – will ask Jan to work on this when she returns from Arizona: Noted. 8. New Business: A. Bills: None. B. 4th of July booklet – CHLPC ad/payment: Hermanson made a motion to pay $120 for the ad out of the CHLPC account. Altschwager seconded it. Motion carried. C. Resthaven account at F&M – donations: Following discussion, Salzwedel made a motion to transfer $30,101.65 from CHLPC Account # 18754 (which includes donations made to the Resthaven) to a “Resthaven Improvement “ Account. Hermanson seconded it. Motion carried. D. Elevator flooring: Meyers reported that the carpeting in the elevator has been replaced with tile looking laminate product and paid by the City as maintenance expense. Projects such as this reiterate the need for good communication between City and CHLPC to preserve the integrity of historic properties. E. Application for Certificate of Appropriateness – Façade Improvements – Sarah Wiersma – 122 W. James St: Lukasavitz made a motion to accept the Application. Salzwedel seconded it. Motion carried. Notation was made to have her apply for a façade improvement grant. F. CAE Honor Trees – selection and location: After viewing the selection of trees offered, Salzwedel made a motion to choose the Cleveland Pear to be placed at a location that complements the Pavilion. Lukasavitz seconded it. Motion carried. CHLPC will work with CAE and DPW on a good location for the trees. Diggers hotline should be called to see where the utilities are located prior to choosing a location. G. CHLPC garden: The grounds and shrubs have been cleaned up, mulched, & pruned thanks to Phil Kaschub & Fredericks. Ulrich will be placing flowers to accent. H. DPW Director/projects contact - Dave Duernberger: Duernberger is no longer an employee of the City. Meyers will remain CHLPC contact. I. Pavilion ADA entryway – discussion: Tabled. J. Pavilion stairs: Meyers reported that a proposal was ready to be sent out. Following discussion, it was agreed to check into a composite material as an all-time maintenance free product, and acceptable to State Historical requirements. K. Hwy 73 bridge replacement – Angela Hronek – Mead & Hunt Engineering Firm: This is a State funded 2023 project, but being a historical structure, have asked to meet with City historical representative to discuss options as to what to do with it. Fredericks will represent CHLPC. L. WAHPC Conference – April 23 & 24: Fredericks passed out the Agenda for anyone wishing to attend the virtual seminars. 9. Council Liaison Report: Gray absent. 10. COLUMBUS WATER & LIGHT COMMISSION MEETING APRIL 15, 2021 CWL Commission President Lang called the CWL Commission meeting to order at 6:00 pm. Commissioners present: Lang, Andler, Olson and Basten. Also, present at the meeting was CWL Lead Lineman David Koenig, Co-Superintendent Hammer and Co-Superintendent Kaltenberg. Excused Adams and Schulze It was reported that the City Clerk, as required by appropriate Wisconsin Statutes, had given proper public notice of the meeting. The Agenda for the meeting was approved on a motion by Olson, second by Andler. Motion carried. Visitor’s Comments and Utility Communications: Included in the packet was an article “Everything you need to know about Wisconsin’s water towers: The good, the ‘evil,’ and the people who swim in your drinking water” by AnnMarie Hilton, USA Today Network. The Consent Agenda which consisted of the March 18th CWL Commission Meeting minutes, Monthly Treasurer’s Report and the Outage Report, was approved on a motion from Andler, second by Olson. Motion carried. UNFINISHED BUSINESS: There was no unfinished business. NEW BUSINESS: Cash Disbursements/Accounts Payable Reports: The Commission reviewed the March Cash Disbursements Report. Checks numbered 22037-22072 and 36 wire and ACH transfers, totaled $757,886.93. The Commission reviewed the Accounts Payable Report and ordered paid 36 requests totaling $414,882.03. Motion by Andler, second by Olson, to approve paying the 35 requests from the AP Report. Roll call vote, Olson aye, Basten aye, Lang aye and Andler aye. Motion carried. Reports were approved and placed on file. Annual Report to City Council: By ordinance the CWL Commission, is required to give a report to the City Council at the first Council meeting in May. In the past, the report was given by a Commission member and over the last few years with the Mayor’s and the City Administrator’s approval, Co-Superintendent Kaltenberg has included the report in the City Council packets. From section 102-60 of the City of Columbus Ordinances ‘The water and light commission shall at the first meeting of the city council in May, make a full report of its operations to the council.’ Long Range Planning Review: The annual calendar for CWL Commission meeting topics indicates that April is the month for a discussion on long range planning and review for CWL. The Commission reviewed the attached list of past, current and upcoming projects. REPORTS: Financial Report was given by Co-Sup’t Kaltenberg and placed on file. Mayor Comments: The Mayor was excused this evening. Co-Superintendent Kaltenberg’s Report:  On April 1st, Co-Sup’t Kaltenberg had a conference call with Alex from WPPI to go over the new solar set up for residential customers and to make sure the general ledger accounts were correct for the new stat codes. CWL had a customer with a solar contract that had expired and with solar becoming more affordable CWL had to adjust according to the Solar Tariff that is currently in place. COMMISSION MEETING APRIL 15, 2021 PAGE 2  On April 6th, Accounting Clerk Koenig-Fry and Co-Sup’t Kaltenberg had a conference call with Stephanie and Alex from WPPI as part of the utilization review follow up discussion. CWL implemented and trained on “Balance Transfers”. This will allow staff member to transfer credits or balances to current customer accounts that had a previous credit or balance on a different account/location. This only can be done with owners or tenants that now currently own so not to effect any future tax roll amounts.  On April 7th, Co-Sup’t Hammer, Lead Lineman Koenig and Co-Sup’t Kaltenberg had a Microsoft Teams Meeting with Jill Frank from OpenPoint to discuss the options for the setup of work order numbering, type, classification and categorizing.  On April 8th, Accounting Clerk Koenig-Fry and Co-Sup’t Kaltenberg participated in the NorthStar Remote Actions Disconnect/Reconnect Webinar held by WPPI. CWL will be sending out disconnect letters on April 8th and will disconnect on April 21st.  On April 8th, Co-Sup’t Hammer and Co-Sup’t Kaltenberg attended a Microsoft Teams meeting webinar ‘APPA Rally Recap & Government Relations Webinar” held by Joseph Owen, Director of Government Relations, WPPI. The webinar recapped the legislative priorities conveyed to the Wisconsin and Michigan Congressional delegation by the 49 public power officials representing 24 communities who virtually attended the 2021 APPA Legislative Rally. Joseph covered the federal and state actions pertaining to COVID recovery, climate policy and infrastructure and discussed emerging proposals of interest to public power utilities if applicable.  CWL’s crew is unable to progress on the AMI Water Meter Project. Currently the back plates have not been received. To date, 2,225 of 2,337 water meters have been converted to AMI. Co-Superintendent Hammer’s Report The CWL crew has been working on the following for the past 4 weeks; Open Point – Field Work Assist WWTP as needed. Others present: CPD Chief Weiner, City Counsel Liaison Trina Reid. 3) Notice of compliance with Open Meeting law—Notice of Meeting and Posted Agenda by Olson. 4) Motion by Rule, to approve agenda. Seconded by O’Donnell. Motion carried unanimously. 5) Motion to approve minutes of meeting of 03/15/2021 by Sumnicht, seconded by O’Donnell. Motion carried unanimously. 6) Public Comments: None. 7) New Business. Kianovsky advised that he is familiar with one of the applicants anticipated to be interviewed for CPD lieutenant’s position through Kianovsky’s employment representing Dodge County, and that he planned to advise that applicant of intent to not consider information obtained about the applicant through that employment during the CPD interview and application process, and also that he did not intend to use any information regarding that applicant obtained through the interview and application process for CPD in his role as an employee of Dodge County. Motion by Kianovky to convene in Closed Session per State Statute 19.85(1)(c) to consider employment, promotion, compensation, or performance evaluation data of any public employee over which the PFC has jurisdiction or exercises responsibility, specifically to interview candidates for Columbus Police Department Lieutenant position. PFC then reconvened in open session at 8:03 p.m. Kianovsky noted that in addition to the advisory noted above, the applicant (Konkel) was advised that if requested, Kianovsky would recuse from the interview and consideration of applicant Konkel. New Business a) Review and make recommendation to the Common Council regarding application by the Columbus School District for the proposed Certified Survey Map for the Columbus Elementary School located at 200 Fuller Street. - Staff presented an overview of the CSM indicating that the CSM was needed to allow the project to meet the requirements of the zoning code. Motion by Theilen, second by Basten to recommend that council approve the CSM as presented. Motion passed 4-0. b) Public Hearing – Regarding the request of Columbus School District for a conditional use permit to construct a building addition to the Columbus Elementary School located at 200 Fuller Street. – The chairperson opened the public hearing. Staff stated that that addition to the Columbus Elementary School needed a Conditional Use Permit per 114-73 of Columbus Municipal Code. The chairperson asked 3 times if anybody wanted speak regarding the project. Nobody commented on the project. The chairperson closed the public hearing. c) Deliberate and make recommendation to the Council regarding the request of Columbus School District for a conditional use permit to construct a building addition to the Columbus Elementary School located at 200 Fuller Street. – Staff reviewed the plans and noted that the applicant may modify the plans to address staff comments. The chairperson closed the public hearing. g) Deliberate and make recommendation to the Council regarding the request of Cave Enterprises Operations LLC for a Conditional Use Permit to construct an additional drive through facility on parcel number 11211-908.04 located at 101 Dix Street. - Staff requested that the Plan Commission table the application until the applicant can revise the site plan to show the correct property boundaries. Motion by Theilen, second by Basten to table the Conditional Use Permit application for 101 Dix Street. Motion passed 4-0. 8. Unfinished Business a) Deliberate and make recommendation to the Council regarding an ordinance to create Section 114-19 of the City of Columbus Code of Ordinances establishing Individual Solar Energy Systems. - The common council requested that the ordinance return to the Plan Commission for further refinement before it would return to council. The amount of taxes billed was $12,340.25. The corrected tax amount should have been $6161.08. Capitol Scale plans to pay the second half of the taxes by the July 31 due date. The City would then refund $6179.17; the difference of what was billed, and the actual amount of tax due. When taxes are collected on an incorrectly assessed property, the taxpayer is due to receive those funds incorrectly charged. Because the City issues property tax bills, we are responsible for refunding the taxpayer for the entire amount, even though the money collected has already been distributed to the other taxing jurisdictions. In turn, the City will file a request with the Department of Revenue to receive repayment for the proportional amount of incorrectly collected funds. The Department of Revenue will then notify each taxing jurisdiction of the amounts to pay back to the City of Columbus. Dickason Columbus, WI 53925 Dear Pat, The assessor has found an error in the 2020 assessment and tax bill for a real estate parcel in the City of Columbus. After the tax bill was issued, it was brought to the Assessors attention that a location land adjustment had been removed during 2020 market update and not placed back on the property. The parcel is as follows: 2020 Actual Assessment 2020 Corrected Assessment 11211 1087.02 $545,800 $272,500 The actual amount of taxes billed was $12,340.25, including stormwater management fees. The corrected tax amount is $6,161.08 including those fees. Therefore, the total overage in taxes billed equals $6,179.17. This assessment error qualifies as a “palpable error” under Wisconsin Statutes 74.33 and is therefore subject to refunded or rescinded taxes. Since the tax bill has been paid, I would recommend the City to Refund the overage on the tax bill for 2020. The procedure for refunding property tax is described in Wisconsin statutes, chapters 70.43 and 74.41. Essentially, the City must pay the overage to the property owner. Then apply for a chargeback through the Department of Revenue. I apologize for this error and any inconvenience it may cause for you or the City. To submit a letter of intent WHS needs an email stating your intent to apply for a grant and an outline of your proposal.
