Call to Order/Roll Call A regular meeting of the City Council of the City of Commerce City was called to order by Mayor Ford on May 6, 2013, at 5:30 PM. Present: 8 - Mayor Sean Ford , Council Member Jim Benson, Council Member Rick A. Teter, Mayor Pro-Tem René Bullock, Council Member Crystal Elliott, Council Member Jason McEldowney, Council Member Steven J. Douglas and Council Member Andrew Amador Excused: 1 - Council Member Jadie Carson 2. Executive Session 13-0018 An executive session pursuant to C.R.S. 24-6-402(4)(e) for the purpose of determining positions relative to matters that may be subject to negotiations concerning an economic development opportunity in Commerce City A motion was made by Mayor Pro-Tem Bullock, seconded by Council Member McEldowney, that this executive session be held pursuant to C.R.S. 24-6-402(4) (e) for the purpose of determining positions relative to matters that may be subject to negotiations concerning an economic development opportunity in Commerce City. Pledge of Allegiance and Posting of Colors The Commerce City Police Color Guard posted the colors and Police Chaplain Pranno gave an invocation. The Pledge of Allegiance was recited. Proclamations and Recognitions Proc 13-01 National Kids to Parks Day proclamation City Attorney Gehler read a proclamation declaring May 18, 2013, as National Kids to Parks Day. Council presented the proclamation to Parks & Recreation Director Carolyn Keith who stated that Commerce City is one of 260 cities throughout the country to participate in this program. A motion was made by Council Member McEldowney, seconded by Council Member Teter, that this Proclamation be approved. VOICE VOTE: Unanimous, all present affirmed. Proc 13-07 Proclamation recognizing May 12 - 18, 2013 as National Police Week and May 15 as Peace Officers' Memorial Day City Attorney Gehler read a proclamation declaring May 12-18, 2013, as National Police Week and May 15, 2013, as Peace Officers' Memorial Day. Council presented the proclamation to Police Chief Smith, Police Chaplain Pranno and other police personnel in attendance. Chief Smith gave special recognition to Office Tom Poe for coordinating all the activities during National Police Week. A motion was made by Council Member McEldowney, seconded by Council Member Teter, that this proclamation be approved. VOICE VOTE: Unanimous, all present affirmed. Proc 13-09 National Day of Prayer Proclamation City Attorney Gehler read a proclamation recognizing May 2, 2013, as National Day of Prayer. Council presented the proclamation to Police Chaplain Pranno. A motion was made by Council Member Elliott, seconded by Mayor Pro-Tem Bullock, that this proclamation be approved. Citizen Communication Mayor Ford invited Boy Scout Troop 211 forward to be recognized. Daniel McCracken, a teacher with Adams 14 School District, introduced one of her students in the FCCLA organization. Two students from the school district have been selected to attend a national conference and are seeking financial support. 7. Approval of Minutes Min 13-30 Minutes of April 1, 2013 A motion was made by Council Member McEldowney, seconded by Mayor Pro-Tem Bullock, that the minutes be approved. VOICE VOTE: Unanimous, all present affirmed. 8. Consent Agenda A motion was made by Mayor Pro Tem Bullock, seconded by Council Member McEldowney, that the consent agenda be approved as presented. Ordinances on 2nd Reading Ord 1955 AN ORDINANCE RE-ESTABLISHING THE BOUNDARIES OF THE FOUR WARDS OF THE CITY OF COMMERCE CITY A motion was made by Council Member McEldowney, seconded by Mayor Pro Tem Bullock, that this ordinance be approved on second & final reading. Presentations Commerce City Page 3 City Council Meeting Minutes - Final May 6, 2013 Pres 13-139 Presentation by DRCOG regarding Commerce City's participation in the Sustainable Communities Initiative Grant Process. DRCOG Director of Regional Planning and Operations Teri Whitmore addressed Council. She stated that DRCOG was awarded a grant of $4.5 million from HUD for regional planning and corridor implementation. DRCOG Representative Craig Carlson spoke to Council and stated they would like Commerce City to sign a consortium agreement. Pres 13-137 QCI Update; Stormwater Utility Fee Implementation Interim Public Works Director Daren Sterling addressed Council. Mr. Sterling stated that back in July of 2012, Council asked staff to research the proposed stormwater fee of $6 per household. Implementation of a stormwater utility program will take 20 months and the remaining steps are: renewing the database, creating a financial and rate policy, public education, billing system implementation and the creation of a customer service and appeals program. Mr. Sterling stated that implementing a stormwater utility fee would free up $875,000 from the general fund and shift it to the utility. Current expenditures are $875,314. Current maintenance activities cost $702,242 per year and include: street sweeping, mowing, inlet cleaning and pipe, culvert and swale repair. Proposed maintenance activities would cost $1,397,000 per year. Identified drainage improvements cost $78 million. City Council feedback included: what the cost of inaction would be, reach out to CML for their presentation to share with the community, map/diagram of the storm sewer system and where our needs are and/or a video presentation that shows how the water flows and system works. Pres 13-144 1st Quarter Work Plan, CIPP and Financial Update City Manager McBroom stated that Council was being presented with two separate work plans: operations and projects. Mr. McBroom reviewed the key events from each department. Council provided Mr. McBroom with positive feedback regarding the format of the reports and the clear and succinct information provided in the reports. Administrative Council Business Council members McEldowney and Bullock moved and seconded to begin the May 20, 2013, meeting at 5:30 pm for the purpose of an executive session. VOICE VOTE: Unanimous; all present affirmed Councilman McEldowney stated that a church group secured land along Chambers Road and worked with city staff to conduct a major clean up effort along the road. He would like to see a formal program started to assist other groups interested in doing the same thing. Councilman Bullock asked to be a non-voting member of Stapleton CAB. Council members McEldowney and Teter moved and seconded to appoint Mayor Pro Tem Bullock as a non-voting member of Stapleton CAB. VOICE VOTE: Unanimous; all present affirmed Councilman Bullock would like to see the executive directory updated and distributed to Council. Councilman Douglas reported hearing from seniors that they were told they could not promote activities to other staff or Council. He also asked for an update on the railroad noise at 96th & Highway 2. Mayor Ford has been invited, by Mayor Hancock, to attend an economic development trip to Tokyo and South Korea. The itinerary includes airport tours. The Mayor invited Council to attend the next Rotary meeting to hear his presentation about DIA. 12. Reports Mayor Ford reported on his attendance at various meetings and events. Councilwoman Carson stated that she and Mayor Pro Tem Bullock will be working with Adams County 14 School Board members to review 50 papers on "If I were Mayor". City Attorney Gehler will be submitting his quarterly report to Council . City Manager McBroom highlighted items from his weekly report. 13. Adjourn In accord with the city charter, the city attorney read the title to all ordinances and resolutions that were adopted by the City Council at this meeting.
