Call to Order/Roll Call A regular meeting of the City Council of the City of Commerce City was called to order by Mayor Ford on August 19, 2013, at 5:30 PM. Council members Bullock and Douglas moved and seconded to excuse Councilwoman Carson from this meeting. Executive Session 13-0034 An executive session pursuant to C.R.S. 24-6-402(4)(e) for the purpose of determining positions and developing strategy for negotiating with Adams County regarding the number of municipal inmates housed at the Adams County Jail A motion was made by Mayor Pro-Tem Bullock, seconded by Council Member Teter, that an executive session, pursuant to CRS 24-6-402(4)(e) for the purpose of determining positions and developing strategy for negotiating with Adams County regarding the number of municipal inmates housed at the Adams County jail, be held. Proclamations and Recognitions Congressman Perlmutter was recognized as being in attendance and was invited to address Council. He stated that Colorado is ahead of the country in regard to the implementation of the Health Care Act and has heard the concerns of Council regarding train noise down the Highway 2 Corridor. 13-0032 Commerce City Police Department Earns State Accreditation Frederick Police Chief Gary Barbour appeared before Council on behalf of the Colorado Association of Chiefs of Police to present Chief Smith with state accreditation of the police force. Proc 13-14 Proclamation declaring Aug. 19 - 23 as Safety Net Clinic Week City Attorney Gehler read a proclamation declaring the week of August 19-23 as Safety Net Clinic Week in Commerce City. Mayor and Council presented the proclamation to Norma Portnoy, Executive Director of Community Health Services. A motion was made by Council Member McEldowney, seconded by Mayor Pro-Tem Bullock, that this proclamation be approved. Citizen Communication United Power Representatives Troy Whitman and Tom Green appeared before Council on behalf of United Power to present them with the city's patron's capital credit check in the amount of $8,257.61. 7. Approval of Minutes Min 13-53 Special Meeting Minutes of August 12, 2013 A motion was made by Council Member McEldowney, seconded by Council Member Teter, that the Minutes be approved. ROLL CALL VOTE: Aye: 8- Mayor Ford, Council Member Benson, Council Member Teter, Mayor Pro-Tem Bullock, Council Member Elliott, Council Member McEldowney, Council Member Douglas and Council Member Amador Commerce City Page 2 City Council Meeting Minutes - Final August 19, 2013 Res 2013-52 RESOLUTION SUBMITTING TO THE ELECTORS OF THE CITY OF COMMERCE CITY AT THE REGULAR ELECTION TO BE HELD NOVEMBER 5, 2013 THE QUESTION OF WHETHER SECTION 3.1 OF THE CITY CHARTER OF THE CITY OF COMMERCE CITY SHOULD BE CHANGED TO PROVIDE THAT REGULAR MUNICIPAL ELECTIONS SHALL BE HELD AS COORDINATED ELECTIONS IN ADAMS COUNTY, COLORADO HELD IN ODD-NUMBERED YEARS AND SETTING THE LANGUAGE THEREFOR This Resolution was adopted Ord 1971 AN ORDINANCE AMENDING THE 2013 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO, BY APPROPRIATING A PORTION OF THE UNENCUMBERED FUND BALANCE OF THE GENERAL FUND IN THE AMOUNT OF $186,046 AND TRANSFERRING A PORTION OF THE UNENCUMBERED FUND BALANCE IN THE GENERAL FUND TO THE FOLLOWING: GRANT FUND IN THE AMOUNT OF $37,000 AND THE FACILITY SERVICES FUND IN THE AMOUNT OF $235,200; TRANSFERRING $1,000,000 FROM THE SOLID WASTE FUND TO THE CIPP FUND, $561,745 FROM THE IMPACT FEES FUND TO THE CIPP FUND AND APPROPRIATING A PORTION OF THE UNENCUMBERED FUND BALANCE IN THE CIPP FUND IN THE AMOUNT OF $250,000; THE FLEET MANAGEMENT FUND IN THE AMOUNT OF $58,000; URBAN RENEWAL AUTHORITY FUND IN THE AMOUNT OF $66,675 AND THE POLICE DONATION FUND IN THE AMOUNT OF $33,689 FOR A TOTAL AMOUNT OF $2,428,355 AND REAFFIRMING PRIOR APPROPRIATIONS AND AUTHORIZING THE EXPENDITURE THEREOF. This Ordinance was approved on second & final reading 9. Resolutions Res 2013-49 Resolution approving business incentives for TMAC II Enterprises , LLC. A motion was made by Mayor Pro-Tem Bullock, seconded by Council Member McEldowney, that this Resolution be adopted. VOTE: Aye: 8- Mayor Ford, Council Member Benson, Council Member Teter, Mayor Pro-Tem Bullock, Council Member Elliott, Council Member McEldowney, Council Member Douglas and Council Member Amador Commerce City Page 3 City Council Meeting Minutes - Final August 19, 2013 Res 2013-51 RESOLUTION SUBMITTING TO THE ELECTORS OF THE CITY OF COMMERCE CITY AT THE REGULAR ELECTION TO BE HELD NOVEMBER 5, 2013, THE QUESTION OF WHETHER THE DEBT AND SALES AND USE TAX OF THE CITY OF COMMERCE CITY SHOULD BE INCREASED IN THE AMOUNTS SET FORTH IN SUCH QUESTION AND SETTING THE LANGUAGE THEREFOR Communications Director Halstead addressed Council. Ms. Halstead stated that the resolution presented to Council tonight for their consideration is the end result of a two-year process that included the formation of a community stakeholder group, numerous meetings, outreaches and two surveys. There are five projects identified for the one cent sales tax increase. Community input: Sue Schwartz, 1007 Carson Wy. Garfield, Denver City Attorney Gehler read an email from a citizen and Mayor Ford read a letter from Councilwoman Carson. A motion was made by Council Member McEldowney, seconded by Council Member Benson, that this Resolution be adopted. Ordinances on 1st Reading Ord 1968 AN ORDINANCE AMENDING SECTIONS 1-3003 AND 1-3004 OF THE COMMERCE CITY REVISED MUNICIPAL CODE ESTABLISHING GENERAL PENALTIES AND AUTHORIZING THE USE OF CERTAIN OTHER REMEDIES TO ENFORCE THE PROVISIONS OF SAID CODE A motion was made by Mayor Pro-Tem Bullock, seconded by Council Member McEldowney, that this Ordinance be introduced by council as seated and approved on first reading. VOTE: Aye: 8- Mayor Ford, Council Member Benson, Council Member Teter, Mayor Pro-Tem Bullock, Council Member Elliott, Council Member McEldowney, Council Member Douglas and Council Member Amador Ord 1973 An ordinance repealing and reenacting articles i and ii, chapter 11 of the commerce city revised municipal code regarding the model traffic code and adopting the 2010 edition of the model traffic code for Colorado by reference. A motion was made by Mayor Pro-Tem Bullock, seconded by Council Member Teter, that this Ordinance be continued. Presentations Pres 13-290 RTD update - Upcoming request for proposal (RFP) Jim Starling, RTD, stated that the North Metro Line will cover 18.5 miles, with 8 stations serving the line. RTD received an unsolicited proposal in Feb 2013 that had merit and the Board of Directors agreed to put out another RFP. The scope of services includes design/build in 3 phases: Union St., 72 nd Ave & SE, SW & Central Extensions. Pres 13-217 Budget Presentation - City Manager's Office City Manager McBroom presented the department's budget. The proposed budget shows a decrease in salaries and benefits based on finalization of the staffing requirements Pres 13-218 Budget Presentation - Economic Development Walt Williams reported a reduction of overall budget ; asking for 1 new replacement position; budget enhancement for the Derby Resource Center. Key Initiatives include the Greyhound Park redevelopment. Pres 13-222 Budget Presentation - Legal City Attorney Robert Gehler presented his office's proposed 2014 budget. No increases indicated. Pres 13-285 Budget Presentation: Communications & Intergovernmental Relations Division Communications Director Michelle Halstead presented the proposed 2014 budget for the division. Council expressed support for increased engagement in legislative affairs. Pres 13-294 Budget Presentation - City Clerk City Clerk Laura Bauer presented the proposed 2014 budget for the City Clerk's Office. Council inquired about the success of the passport service and asked about adding a citizen engagement module to Legistar. Administrative Council Business Mayor Ford indicated the possibility that Council might need to draft a letter to Adams County regarding the use of the the jail. Council members Bullock and McEldowney moved and seconded to authorize Mayor Ford to sign a letter addressed to Adams County regarding the use of the jail on behalf of City Council. VOICE VOTE: Unanimous; all present affirmed Mayor Pro Tem Bullock stated he would be bringing forth a proclamation in September for Council's support regarding veterans. Councilman McEldowney reported on a heaved sidewalk behind the 7-Eleven at 104th. 13. Reports City Manager McBroom highlighted his weekly update to City Council. City Attorney Gehler provided a brief update. Mayor Ford looking for evaluation forms for City Manager, City Attorney, and the Municipal Judge. Mayor Ford also reported on various events and meetings attended by members of City Council. 14.
