Call to Order/Roll Call A special meeting of the City Council of the City of Commerce City was called to order by Mayor Huseman on April 6, 2020, at 6:02 PM. Present: 9 - Mayor Benjamin Huseman, Mayor Pro Tem Nicole Frank, Council Member Oscar Madera, Council Member Jennifer Allen-Thomas, Council Member Susan Noble, Council Member Jose Guardiola, Council Member Craig Hurst, Council Member Meghan Grimes and Council Member Robyn Smith 2. Consent Agenda A motion was made by Council Member Madera, seconded by Council Member Hurst, to approve the consent agenda as presented. ROLL CALL VOTE: Aye: 9- Mayor Huseman, Mayor Pro Tem Frank, Council Member Madera, Council Member Allen-Thomas, Council Member Noble, Council Member Guardiola, Council Member Hurst, Council Member Grimes and Council Member Smith Ord 2258 AN ORDINANCE AMENDING THE COMMERCE CITY SALES AND USE TAX CODE, ARTICLE I OF CHAPTER 20 OF THE COMMERCE CITY REVISED MUNICIPAL CODE, TO ADOPT AND INCORPORATE CERTAIN STANDARDIZED SALES AND USE TAX DEFINITIONS RECOMMENDED BY THE COLORADO MUNICIPAL LEAGUE AND ACCOMPLISHING RELATED MATTERS Ord 2262 AN ORDINANCE AMENDING THE 2020 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE BULLETPROOF VEST PARTNERSHIP GRANT FUNDS IN THE AMOUNT OF $11,804.60 FOR THE BULLETPROOF VEST PROGRAM IN THE POLICE DEPARTMENT AND THE AUTHORIZATION OF THE EXPENDITURE THEREOF. Commerce City Page 1 City Council Meeting Minutes - Final April 6, 2020 Ord 2264 AN ORDINANCE AMENDING THE 2020 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY APPROPRIATING A PORTION OF THE UNENCUMBERED FUND BALANCE OF THE COMMERCE CITY BRIGHTON SCHOOL DISTRICT USE TAX FUND (CCBSD) IN THE AMOUNT OF $714,450 FOR INSTALLATION OF SYNTHETIC TURF AT STUART MIDDLE SCHOOL AND TRANSFERRING $500,000 FROM THE CCBSD FUND TO THE CIPP FUND FOR SPORTS FIELD IMPROVEMENTS AT THREE LOCATIONS AND AUTHORIZATION OF THE EXPENDITURE THEREOF. Ord 2267 AN ORDINANCE AMENDING THE 2020 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF FUNDS FROM ADAMS COUNTY FOR STATE FUNDS RECEIVED THROUGH THE CENSUS OUTREACH GRANT PROGRAM AND FUNDS FROM THE REGIONAL TRANSPORTATION DISTRICT (RTD) FOR PUBLIC ART AT THE NORTH METRO RAIL LINE AND AUTHORIZING RELATED MATTERS 3. Update on the City’s Response to the COVID-19 Crisis City Manager McBroom, Deputy City Managers Smith and Tinklenberg, Chief Nichols, and Economic Development Director Michelle Claymore provided updates on the city's response to the COVID-19 crisis. A motion was made by Mayor Huseman, seconded by Council Member Hurst, to direct staff to explore the options the city has to waive taxes paid by non-essential businesses while they are not operating during the COVID-19 crisis. ROLL CALL VOTE: 9 - Aye A motion was made by Council Member Grimes, seconded by Council Member Allen-Thomas, to authorize the mayor to sign a letter to Senators Bennet and Gardner and Congressman Perlmutter advocating for COVID-19 relief for cities under 500,000 population. ROLL CALL VOTE: 9 - Aye Approval of Use of Contingency Funds for Participation in County Loan Fund A motion was made by Council Member Madera, seconded by Council Member Noble, to approve the use of the previously-appropriated contingency funds for a local revolving loan fund for participation in county loan fund. ROLL CALL VOTE: 9 - Aye 4. Oil and Gas Monthly Update Commerce City Page 2 City Council Meeting Minutes - Final April 6, 2020 Pres 20-13 Oil and Gas Monthly Update Deputy City Manager Tinklenberg provided the oil and gas monthly update. A motion was made by Council Member Noble to direct staff to prepare an ordinance to instate a moratorium on oil and gas extraction, regional operator agreement, and permit applications until oil and gas regulations are finalized. Motion failed due to lack of second. A motion was made by Mayor Huseman, seconded by Council Member Noble, to direct the city attorney to prepare an ordinance prohibiting acceptance of oil and gas extraction, regional operator agreement, and permit applications from April 1, 2020 to August 1, 2020. VOTE: 7 Aye (Allen-Thomas, Frank, Guardiola, Huseman, Madera, Noble, Smith), 2 - Nay (Grimes, Hurst) 5. Monthly Suncor Update Pres 20-159 Monthly Suncor Update Deputy City Manager Smith provided the monthly Suncor update. 6. 112th Avenue Project Update Deputy City Manager Tinklenberg provided an update on the 112th Avenue project. 7. Traffic Signals Installation Projects Update Deputy City Manager Tinklenberg provided an update on the traffic signal installation projects. 8. Discuss Future Council and Board and Commission Meetings A motion was made by Council Member Grimes, seconded by Mayor Pro Tem Frank, to reinstate regular meetings of the city council for the first and third Monday's of the month only for the purpose to consider critical business and to allow for citizen communication, and to not reinstate study sessions. ROLL CALL VOTE: 9 - Aye 9. Adjourn The meeting adjourned at 9:36 p.m. In accord with the city charter, the city attorney read the title to all ordinances and resolutions adopted by Council at this meeting.
