Call to Order/Roll Call A special meeting of the City Council of the City of Commerce City was called to order by Mayor Huseman on October 25, 2021, at 7:21 PM. A motion was made by Council Member Madera, seconded by Council Member Allen-Thomas, to excuse members not present. VOTE: 8 - Aye, 1 - Excused (Smith) 2. Administrative Council Business 21-162 Action on QCF Request A motion was made by Council Member Madera, seconded by Council Member Noble, to ratify the Quality Community Foundation vote to recommend City Council remove Director Barnett from the Board of Directors. VOTE: 5 - Aye, 2 - Nay (Frank, Hurst), 1 - Abstain (Huseman), 1 - Excused (Smith) 21-160 Extension of Tolling Agreement (Hammer) A motion was made by Council Member Grimes, seconded by Council Member Hurst, to authorize the City Attorney to sign the extension of the tolling agreement. VOTE: 8 - Aye, 1 - Excused (Smith) 3. Presentations Pres 21-555 Reunion Consolidated Development Agreement 4. Executive Session 21-159 An executive session pursuant to C.R.S. 24-6-402(4)(e & f) for the purpose of discussing personnel and negotiation matters relating to the interim City Attorney position. A motion was made by Council Member Hurst, seconded by Council Member Madera, to enter into an executive session pursuant to C.R.S. 24-6-402(4)(e & f) for the purpose of discussing personnel and negotiation matters relating to the interim City Attorney position. VOTE: Aye: 4- Council Member Madera, Council Member Guardiola, Council Member Hurst and Council Member Grimes Nay: 4- Mayor Huseman, Mayor Pro Tem Frank, Mayor Pro Tem Allen-Thomas and Council Member Noble Excused: 1- Council Member Smith 21-161 An executive session pursuant to C.R.S. 24-6-402(4)(e) for the purpose of providing direction on negotiating matters related to the extension of a sales and use tax agreement with Reunion Metropolitan District. A motion was made by Council Member Noble, seconded by Council Member Allen-Thomas, to amend the motion to not provide direction on negotiating matters to extension of current contracts and only provide direction on negotiating matters on new contract terms. VOTE: 2 - Aye (Allen-Thomas, Noble), 6 - Nay, 1 - Excused (Smith). Motion failed. A motion was made by Council Member Madera, seconded by Council Member Grimes, to enter into an executive session pursuant to C.R.S. 24-6-402(4)(e) for the purpose of providing direction on negotiating matters related to the extension of a sales and use tax agreement with Reunion Metropolitan District. VOTE: Aye: 4- Council Member Madera, Council Member Guardiola, Council Member Hurst and Council Member Grimes Nay: 4- Mayor Huseman, Mayor Pro Tem Frank, Mayor Pro Tem Allen-Thomas and Council Member Noble Excused: 1- Council Member Smith 6. There will be the opportunity for public comment at the meeting during citizen communication on the Reunion Consolidated Development Agreement extension. The public can submit their comments live during the meeting via Zoom or in advance in writing to the City Clerk or by mail.
