A motion was made by Mayor Pro Tem Allen-Thomas, seconded by Council Member Grimes, to excuse those members not present. Pledge of Allegiance The Pledge of Allegiance was recited. 3. Executive Session 22-145 An executive session of the City Council pursuant to C.R.S. 24-6-402(4) (f) for the purposes of discussing the employment status of the City Manager and appointment thereof. A motion was made by Council Member Grimes, seconded by Mayor Pro Tem Allen-Thomas, to accept the resignation of City Manager Tinklenberg. VOTE: 8 - Aye, 1 - Excused (Madera) A motion was made by Council Member Grimes, Seconded by Mayor Pro Tem Allen-Thomas, to accept the severance agreement for City Manager. Proclamations and Recognitions 22-148 GFOA Awards for Outstanding Achievement in Popular Financial Reporting, Certificate of Achievement for Excellence in Financial Reporting and Distinguished Budget Presentation Sheryl Carstens, Finance Director, introduced the awards that the Finance Department received. Proc 22-31 Proclamation Declaring August 26th, 2022 as Women's Equality Day in Commerce City, Colorado Kelly LaRu, Diversity, Equity, and Inclusion Commissioner, read the proclamation. A motion was made by Mayor Pro Tem Allen-Thomas, seconded by Council Member Grimes, that this Proclamation be approved. Public Hearings Res 2022-03 A RESOLUTION APPROVING THE AVILLA SETTLERS CROSSING SUBDIVISION GENERALLY LOCATED SOUTH OF E. 100TH AVENUE AND EAST OF TOWER ROAD Mayor Huseman reopened the public hearing. Harry Brennan, City Planner, provided the staff presentation to Council. Harry provided an overview of the case summary including the proposed plat and incorporated updates. Charlie Smith, legal council for the applicant, requested this public hearing be continued for another month. A motion was made by Council Member Grimes, seconded by Mayor Pro Tem Allen-Thomas, to refer this case back to the Planning Commission for another hearing prior to the City Council's next hearing. Motion Failed. VOTE: 4 - Aye (Allen-Thomas, Douglas, Grimes, Noble), 4 - Nay, 1 - Excused (Madera) A motion was made by Council Member Grimes, seconded by Council Member Hurst, that this Resolution be continued to the September 19, 2022 regular meeting. VOTE: 5 - Aye, 2 - Nay (Allen-Thomas, Douglas), 2 - Excused (Madera, Noble) A motion was made by Council Member Grimes, seconded by Council Member Hurst, that this Zoning Ordinances be approved on second & final reading as amended. Administrative Council Business A motion was made by Council Member Ford, seconded by Council Member Hurst, to direct staff to enforce the laws regarding unregistered vehicles in the City's rights of way and direct them to engage immediately with another towing operation to ensure that these vehicles are removed fro the City post haste. VOTE: 8 - Aye, 1 - Excused (Madera) 13. Council Reports Acting City Manager Blakeman highlighted items presented in their weekly report provided to council earlier. The mayor and council reported on their attendance at various meetings and events. A motion was made by Council Member Grimes, seconded by Council Member Davis, to extend the meeting by 15 minutes.
