7887 E. 60th Ave. Commerce City Commerce City, CO 80022 c3gov.com Meeting Minutes - Final Liquor License Authority Friday, May 26, 2017 2:00 PM Room 2108 1. Call To Order Hearing Officer called the meeting was called to order at 2:00 p.m. 2. Public Hearings Pres 17-283 New Liquor License - Hotel & Resturant Liquor License Tradicion LLC dba Tradicion Bar and Grill 8383 Rosemary Street Commerce City, CO 80022 Hearing Officer Ablao stated that as a preliminary matter, by statute, a public hearing is not to occur within 30 days from the date an application is filed. This hearing is being held within that 30-day limit and the state has been notified and they are alright with the hearing being held early. The reason is that the original application was filed significantly before May for the transfer of ownership and the 30-day limit is primarily to give both the state and local authorities the ability to process the application in time. Clearly that occurred in this matter. The other reason is to allow the applicant time to petition which the applicant has completed. Hearing Officer Ablao opened the public hearing. Entering their appearance: Refugio Perez, Registration #47459, on behalf of the licensee Sergio Perez, on behalf of the licensee Max Scott, on behalf of the petitioning company Attorney Perez testified that the licensee has been opened for one month without the ability to sell alcohol. There are no other similar licenses within the neighborhood. Mr. Perez stated that the applicant has over 20 years experience in the restaurant business. Serio Perez was sworn in and testified to the hours of operation, his past alcohol violation and that his alcohol service experience comes from being a cashier in a liquor store. Max Scott was sworn in and testified to the alcohol training program his company provides and is available to the applicant. Mr. Scott reviewed the petitioning process followed and the results of the survey. No one came forward to speak in favor or opposition to this license application and the public hearing was closed. Commerce City Page 1 Liquor License Authority Meeting Minutes - Final May 26, 2017 Hearing Officer Ablao made the following findings: The adult inhabitants of the neighborhood desire the issuance of this license. The reasonable requirements of the neighborhood, for this type of license being sought, are currently not being met. The number, type and availability of liquor outlets located in, or near, the neighborhood, do not preclude the issuance of this license. The applicant, at this time, is qualified to conduct the type of business proposed. Hearing Officer Ablao granted the license contingent upon the following: Satisfactory inspection of the licensed premises to ensure the diagram and actual premises match. Satisfactory results of a background investigation. Updated diagram provided to the city clerk's office. 3. Adjourn The meeting adjourned at 2:30 p.m. Commerce City Page 2
