1. Call To Order
Hearing Officer Ablao called the meeting to order at 11:00 a.m.
2. Public Hearings
Pres 18-209 Application for a 3.2% Beer Off Premise License of Leevers
Supermarkets, Inc dba Save-A-Lot Commerce City at 7290 Monaco St
Hearing Officer Ablao opened the public hearing.
Entering their appearance:
Adam Stapen, Registration #27506, on behalf of the applicant
Lou Florez, on behalf of the applicant
Eva Garretson, on behalf of the petitioning company
Eva Garretson was sworn in and testified to the petition process and results. The
results were 68% in favor of issuing the license.
Lou Florez was sworn in and testified to his work experience related to alcohol sales.
Mr. Florez provided the applicant's history and business concept. The company is
seeking licenses in multiple jurisdictions and has implemented a program focusing on
the sale of alcohol for all employees. He reviewed the controls in place to prevent the
sale of alcohol to minors.
No one appeared to speak in favor, or opposition to, the issuance of the license and
the public hearing was closed.
Hearing Officer Ablao made the following findings:
The adults inhabitants of the neighborhood do favor issuance of the license.
The reasonable requirements of the neighborhood, for the license type being sought,
do not preclude issuance of the license.
The number, type and availability of outlets located in or near the neighborhood, do not
preclude the issuance of the license.
The applicant is qualified, at this time, to conduct the type of license proposed.
Hearing Officer Ablao approved the application with the following conditions:

Submittal of an updated diagram within seven days.
Satisfactory inspection of the licensed premises.
Compliance with all rules, regulations and municipal ordinances.

7-Eleven, Inc dba 7-Eleven Store # 38170A at 5605 E 56th Ave
Hearing Office Ablao opened the public hearing.
Entering an appearance:
Attorney Kevin Coates, Registration #25995, on behalf of the applicant
Brandon Meadows, on behalf of the applicant
Ruthe Tsehaye, on behalf of the applicant
Carol Johnson, on behalf of the petition company
Attorney Coates testified that the applicant is a franchisor/franchisee relationship with
Ms.Tsehaye being the franchisee. She currently holds four other licenses and was
employed with Seven-Eleven, for many years, with no history of alcohol violations. Mr.
Coates stated there are no other alcohol outlets in the neighborhood and the petition
was overwhelmingly in support of issuance of the license. He stated that the diagram
included in the application is a mirror image of what the actual layout is. The petition
survey results were 100% in favor of the license and there are no similar licenses
within the boundary.
In response to questions from the authority, Ms. Teshaye responded that her husband
holds a liquor license in Denver.
No one appeared to speak in favor, or opposition, to issuing the license and the public
hearing portion was closed.
Hearing Officer Ablao made the following findings:
The evidence presented, as well as the documents and submitions with the
application, do support that the adult inhabitants of the neighborhood do desre the
issuance of the license.
The reasonable requirements of the neighborhood, for the license type being sought,
are not currently being met as there are no other liquor licenses in the neighborhood.
The number, type and availability of outlets located do not preclude the issuance of
the license.
The applicant is qualified, at this time, to conduct the type of license proposed.
Hearing Officer Ablao approved the application with the following conditions:
Satisfactory inspection of the finished premises by the police department.
Compliance with the liquor code, rules, regulations and municipal ordinances.
An ameded diagram to be submitted within seven days.
