Call To Order Hearing Officer Ablao called the meeting to order at 1:00 p.m. 2. Public Hearings Pres 17-126 Application for a medical marijuana-infused product manufacturer license and a retail marijuana products manufacturing license submitted by Makers MIPS, LLC. to be located at 9690 Dallas St. Unit L Hearing Officer Ablao opened the public hearing. Senior Assistant City Attorney Rachel Allen appeared on behalf of the city. Rachel Gillette, Registration #39876, appeared on behalf of the applicant. Sammy Masri was sworn in by the hearing officer. He testified to his professional background that included work in the marijuana industry. Mr. Masri provided information on the business operation as it relates to compliance with all state and local laws and regulations. He stated that there will be no live plants on the premises and he will have approximately five (5) employees. In response to questions from Attorney Allen, Mr. Masri will be producing edible oils and he has not had any previous violations. Hearing Officer Ablao stated that the city's files are the official record of the application. In response to questions, Mr. Masri testified that he has no firm contracts for his product yet. He briefly described the infusion process as closed-loop hydrocarbon and is drafting a standard operating procedure for operating the equipment. Eva Garretson with Liquor Licensing Professionals was sworn in and testified to the process, methodology and results of the neighborhood petition. In response to questions, Ms. Garretson testified that the petition has a margin of error of +/- 16%. Russell Atkinson, 9690 Dallas St. Unit K, business owner, appeared before the authority and was sworn in. Mr. Atkinson testified that there are several marijuana businesses moving in and have not negatively impacted the neighborhood. Parking has been the only issue and he appreciates the communication from the applicant. Mr. Atkinson was unavailable to sign the petition, but would have signed in support of the application. Commerce City Page 1 Marijuana Licensing Authority Meeting Minutes - Final February 24, 2017 There was no further testimony and the public hearing was closed. Hearing Officer Ablao made the following findings: The adult inhabitants of the neighborhood do desire the issuance of the license. The applicant, at this time, is qualified to conduct the type of business proposed. The information presented satisfies the requirement of state and local law regarding marijuana businesses. The application is approved with the following conditions: The applicant complies with all recommendations in the industrial hygienist's report. Obtain an extraction permit approved by the fire district prior to conducting any extraction operations. Satisfactory inspection by the building and fire departments within 180 days to determine compliance with the respective codes. Satisfactory inspection by the police department within 180 days to determine compliance with the diagram submitted with the application. Compliance with state marijuana code, rules, regulations and all municipal ordinances governing the operation of the marijuana business. 3.
